J S 2 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING PROVISIONS FOR HOLDING A NONPARTISAN PRIMARY ELECTION ON MARCH 14, 2000, FOR THE NOMINATION OF CANDIDATES FOR THE OFFICE OF MAYOR, AND FOR HOLDING A LATER GENERAL MUNICIPAL ELECTION ON MARCH 28, 2000, UNLESS SAID OFFICE HAS BEEN FILLED IN THE NONPARTISAN PRIMARY ELECTION; PROVIDING FOR THE REGISTRATION OF PERSONS QUALIFIED TO VOTE IN SAID NONPARTISAN PRIMARY AND GENERAL ELECTIONS; DESCRIBING PERSONS QUALIFIED TO VOTE IN SAID NONPARTISAN PRIMARY AND GENERAL MUNICIPAL ELECTIONS; DESCRIBING THE REGISTRATION BOOKS AND RECORDS MAINTAINED UNDER THE PROVISIONS OF THE GENERAL LAWS OF FLORIDA AND CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH THE CITY HAS ADOPTED AND DESIRES TO USE FOR HOLDING SUCH NONPARTISAN PRIMARY AND GENERAL MUNICIPAL ELECTIONS; DESIGNATING AND APPOINTING THE CITY CLERK AS THE OFFICIAL REPRESENTATIVE OF THE CITY COMMISSION WITH RESPECT TO THE USE OF SUCH REGISTRATION BOOKS AND RECORDS; AND DIRECTING THE CITY CLERK TO GIVE NOTICE BY PUBLICATION OF THE ADOPTION OF THIS RESOLUTION AND THE PROVISIONS HEREOF. WHEREAS, pursuant to Resolution No. 99-614, adopted July 27, 1999, an election called for a special municipal election be held on November 2, 1999, to set forth a proposed Charter Amendment question, known as Charter Amendment No. 1, at which the electorate of the City of Miami would vote on the question to establish a "Strong Mayor -Commission" CITY Cf,}i►UeSSION &fEEI r_!v GG OF 0 t C .1 7 1'999 Resolution No. form of government and to provide for an election for the office of Mayor to be held on March 14, 2000; and WHEREAS, on November 2, 1999, the electorate of the City of Miami approved Charter Amendment No. 1; and WHEREAS, it is now in order for the City Commission to officially call for a nonpartisan primary election and a general municipal election to be held on March 14, 2000 and March 28, 2000 respectively, unless a mayor is elected at the nonpartisan primary election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In accordance with the provisions of Section 7 of the City Charter (Chapter 10847, Laws of Florida, 1925, as amended), a nonpartisan primary election is hereby directed to be held in the City of Miami, Florida, at the Polling places designated on the list attached hereto and made a part hereof and referred to as Exhibit No. 1 on Tuesday, March 14, 2000, from 7:00 A.M. until 7:00 P.M., for the purpose of nominating candidates for. the Office of Mayor of the City of Miami to be voted upon at the general municipal election which is to be held, as provided in said Section 7 of the City Charter, unless in the primary election a candidate for Mayor receives a 'Z !J U r cJ t, , I . . 0 a majority vote in which case he or she shall be elected to said office. Section 2. A general municipal election is hereby directed to be held in the City of Miami, Florida, at the polling places designated in said Exhibit No. 1, from 7:00 A.M. until 7:00 P.M., on Tuesday, March 28, 2000, for the purpose of electing the Mayor of the City of Miami unless a candidate shall have received a majority vote at the nonpartisan primary election held on March 14, 2000. Section 3. The candidate who shall receive the highest number of votes shall serve as Mayor of the City of Miami from 12:00 o'clock noon of the day five days after the canvass of the vote and the declaration of the results of the election, for the latter of either the primary or general elections, and shall serve until the general election to be held in the year 2001. Section 4. The Election Clerks and Inspectors to serve at said polling places on said date shall be designated by the Supervisor of Elections of Miami -Dade County, Florida, for such purposes. Section 5. For the purpose of enabling persons to register who are qualified to vote in said elections and who have not registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, Florida, - 3 - - �62 as amended, or who have transferred their legal residence from one voting precinct to, another voting precinct in the City, they may register at such permanent branch offices as may be approved by the Supervisor of Elections of Miami -Dade County and at said Supervisor's office which will be open during the following dates and time: MTAMT -nADE COL7jjjTY F,T. , _TTONS nRPARTMENT 111 Northwest 1st Street, Miami, Florida Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M. In addition to the above, said qualified persons may register at branch offices and may also use any mobile registration van for the purpose of registration in order to vote in the herein described elections during such times and on such dates as may be designated by the Supervisor of Elections of Miami -Dade County. Section 6. The elections shall be held at the voting places in the precincts designated on said Exhibit No. 1, or as may be designated by the Supervisor of Elections of Miami -Dade County, in conformity with the provisions of the general laws of. the State. A description of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is adopting and desires to use for holding such elections is as follows: All registration cards, books, records and certificates pertaining to electors of the City and established and maintained as official by the Supervisor r 4 - c)0_ �C�� of Elections of Miami -Dade County, in conformity with the provisions of the general laws of the State, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of the City. Section i. The ballot to be used in said elections shall be so prepared that the names of the qualified candidates will appear on said ballot in alphabetical order according to surname; provided, however, that the ballot and its preparation shall comply with the laws of. the State of Florida with respect to absentee ballots, and to the use of mechanical voting machines or the Computer Election System ("CES"). Section 8. (a) In compliance with Florida Statutes, the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein Resolution and of the provisions hereof, at least twice, once in the fifth week and once in the third week prior to the week in which the aforesaid election is to be held, in newspaper(s) of general circulation in the City of V �� Miami, Florida, which notice shall be substantially as set forth in the following form: NOTICE OF NONPARTISAN PRIMARY ELECTION IN THE CITY OF MIAMI, FLORIDA FOR NOMINATING CANDIDATES FOR THE OFFICE OF MAYOR TO BE HELD ON TUESDAY, MARCH 14, 2000, PURSUANT TO RESOLUTION NO. 99- A nonpartisan primary election will be held on Tuesday, March 14, 2000, from 7:00 A.M. until 7:00 P.M., in the City of Miami, Florida, at the Polling places in the several election precincts designated by the Board of County Commissioners of Miami -Dade County, Florida, at which election the qualified electors participating therein will vote for the nomination of candidates for the Office of Mayor of the City of Miami, Florida, to be voted on at the general municipal election which is to be held on Tuesday, March 28, 2000, unless in the primary election a candidate receives a majority vote for the prospective office for which he or she is a candidate. (b) The Election Clerks and Inspectors to serve at said polling places on said dates shall be those designated by the Supervisor of Elections of Miami -Dade County for such purpose. The registration books and records for the registration of persons qualified to vote in said elections shall be those maintained by the Supervisor of Elections of Miami -Dade County. FOR MAYOR Vote for one (1) only: (Names of Candidates) (d) In the event a general municipal election is required to be held on Tuesday, March 28, 2000, the official ballot to be used at such general municipal election shall be in substantially the same form as above, except that the heading of the ballot shall be in substantially the following form, to wit: OFFICIAL BALLOT GENERAL MUNICIPAL ELECTION FOR ELECTING THE MAYOR OF THE CITY OF MIAMI, FLORIDA MARCH 28, 2000 PRECINCT NO. (e) A general municipal, election will be held on Tuesday, - 7 - March 28, 2000, from 7:00 A.M. until 7:00 P.M., in the City of Miami, Florida, at the polling places set forth herein, at which election the qualified electors of the City of Miami participating therein will vote for the election of the Mayor of the City of Miami, Florida, unless a candidate shall have received a majority vote at the nonpartisan primary election held March 14, 2000. The Election Clerks and Inspectors at said general election shall be those designated by the Supervisor of Elections of Miami -Dade County for such purpose. The registration books and records for the registration of persons qualified to vote in said general municipal election shall be those maintained by the Supervisor of Elections of Miami -Dade County. Section 9. WALTER J. FOEMAN, the City Clerk of the City of Miami, Florida, or his duly appointed successor, is hereby designated and appointed as the official representative of the Commission of the City of Miami, Florida, in all transactions with the Supervisor of Elections of Miami -Dade County in relation to matters pertaining to the use of the registration books for the holding of the herein nonpartisan primary election and the herein general election. Section 10. The City Clerk shall cause to be prepared absentee ballots for the use of absentee electors entitled to cast such ballots in said elections. Section 11. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution to be delivered forthwith to the Supervisor of Elections of Miami -Dade County. Section 12. This resolution also calls for the holding of a General Municipal (Runoff) Election, should one be necessary, on March 28, 2000. It is in order for the City Commission to consider, review and adopt said resolution. If no candidate receives a majority vote, a general election will be held on March 28, 2000, using applicable procedures of Sections 7, 8, 9 and 10 of the Charter. Request is hereby made to prepare a resolution making provisions to hold a Nonpartisan Primary Election on March 14, 2000 for the nomination of candidates for the office of Mayor; and for holding a later general municipal (runoff) election, if need be, on March 28, 2000, unless said office is filled in the Nonpartisan Primary Election.
