A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), APPROVING THE DESIGNATION
OF THE LITTLE HAITI HOUSING ASSOCIATION,
INC., A NOT -FOR -PROFIT CORPORATION, AS
DEVELOPER TO UNDERTAKE THE DEVELOPMENT OF
TWENTY-ONE (21) NEW SINGLE-FAMILY HOMES
AFFORDABLE TO FAMILIES AND INDIVIDUALS OF
VERY LOW, LOW AND MODERATE -INCOME ON
SEVENTEEN (17) CITY -OWNED VACANT PARCELS
LOCATED IN THE LITTLE HAITI NEIGHBORHOOD,
WHICH ARE MORE PARTICULARLY AND LEGALLY
DESCRIBED IN EXHIBIT "A" ATTACHED HERETO,
SUBJECT TO SAID CORPORATION, AGREEING TO PAY
THE COST OF ELIMINATING ANY AND ALL TITLE
DEFECTS WHICH MAY EXIST ON SAID CITY -OWNED
PARCELS; RESCINDING THE DEVELOPMENT RIGHTS
AWARDED TO HOUSING INITIATIVE GROUP, INC.,
AND PALMETTO HOMES OF MIAMI, INC., PURSUANT
TO SECTION 2 OF RESOLUTION NO. 96-576;
SUBJECT PARCELS TO BE CONVEYED TO THE
AFOREMENTIONED CORPORATION AT NO COST IN
ACCORDANCE WITH THE POLICY ESTABLISHED BY THE
CITY COMMISSION IN THE FIVE (5) YEAR
CONSOLIDATED PLAN (1999-2004); AUTHORIZING
THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENT(S) IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, CONVEYING SAID PARCELS SUBJECT TO
CERTAIN TERMS AND CONDITIONS.
WHEREAS, there exists in the City of Miami a severe
shortage of housing within the affordability range of families
and individuals of low and moderate -income; and
WHEREAS, the City Commission recognizes that the
participation of both the public and private sectors is

necessary to foster the development of housing affordable to low
and moderate -income families and individuals in the City; and
WHEREAS, at the July 22, 1999 City Commission meeting,
through Resolution No. 99-429, the City Commission approved the
City's proposed Five (5) Year Consolidated Plan (1999-2004) for
submission to the U.S. Department of Housing and Urban
Development; and
WHEREAS, one of the major components of the City's Five (5)
Year Consolidated Plan emphasizes a housing strategy which is
designed to facilitate the creation of 1,000 new homeownership
units for purchase by very low, low and moderate income families
annually; and
WHEREAS, special attention shall be provided to several
residential neighborhoods with an emphasis on the development of
new-infill housing on publicly -owned residential parcels for
purchase by area residents; and
WHEREAS, the initial development strategy of the Infill
Housing Initiative Program will focus on the development of city
and county -owned parcels in the seven (7) newly established
Homeownership Zones in the City; and
WHEREAS, there exist. ;,,
surplus City -owned vacant residential parcels located in the
Little Haiti neighborhood which are suitable for the development
of new affordable single-family homes, affordable to very low,
low and moderate -income families; and
WHEREAS, in an effort to promote the development of
affordable housing in the City, the City Administration
recommends the granting of development rights to the Little
Haiti Housing Association, Inc., for the development of twenty-
one (21) new single-family homes on City -owned parcels, subject
to certain terms and conditions; and
WHEREAS, Section 29-B of the City Charter allows for the
conveyance or disposition of City -owned property in connection
with the implementation of City -assisted housing programs or
projects, which are intended to benefit persons or households of
low and/or moderate -income without being subject to competitive
biding requirements and fair market value return to the City;
and
WHEREAS, it is recommended that the subject parcels are
made available to the Little Haiti Housing Association at no
cost;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby rescinds Section
2 of Resolution No. 96-576 which designated, in principle,
Housing Initiative Group, Inc. and Palmetto Homes of Miami,
Inc., as sponsors to undertake the development of ten (10) new
single-family homes on certain City -owned parcels located in the
Little Haiti and Model City neighborhoods.
Section 3. The Little Haiti Housing Association, Inc.,
a not -for -profit corporation, is hereby designated, as developer
to undertake the development of twenty-one (21) new single-
family homes affordable to very low, low and moderate -income
families and individuals on seventeen (17) vacant City -owned
parcels located in the Little Haiti neighborhood, more
particularly described in Exhibit "A", subject to said
corporation, agreeing to accept said parcels with certain title
defects which may exist. The corporation also agrees to assume
the responsibility of paying the cost of eliminating any and all
defects in order to insure that the newly constructed single
family homes can be conveyed to a very low, low and/or moderate
income families with clear title.
Section 4. The City Manager is hereby authorized!/ to
execute all necessary document(s), in forms acceptable to the
City Attorney, conveying to the corporation said parcels, more
particularly described in Exhibit "A" attached hereto. The City
Manager is hereby authorized to convey the subject city -owned

Construction on the subject parcels must be underway within
twelve (12) months from the date of conveyance by the City or
the said parcels will revert back to the City.
Section S. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

It is respectfully recommended that the City Commission adopt the attached resolution approving the
designation of the Little Haiti Housing Association, Inc., a not -for -profit housing corporation, to
develop twenty-one (21) new single family homes on seventeen (17) vacant city -owned residential
parcels located in the Little Haiti neighborhood. The attached resolution further rescinds certain
development rights previously awarded to Housing Initiatives Group, Inc. and Palmetto Homes of
Miami, Inc., pursuant to Section 2 of Resolution No. 96-576, adopted July 25, 1996.
Moreover, the attached resolution further authorizes the City Manager to convey the subject city -
owned parcels at no cost to the Little Haiti Housing Association, Inc., subject to certain terms and
conditions.
BACKGROUND
The Department of Community Development recommends approval of the attached resolution
designating the Little Haiti Housing Association; Inc. to undertake the construction of twenty-one (21)
new single family homes on seventeen (17) city -owned vacant residential parcels in the Little Haiti
neighborhood. CDBG Program funds were used by the City to acquire the subject parcels several
years ago to develop new single family homes for purchase by qualified low and moderate income
families under the City's Scattered Site Affordable Homeownership Development Program. The
Program is no longer being implemented by the City and the subject parcels are now considered
surplus property.
In December 1996, the local Fannie Mae South Florida Partnership Office established the
Neighborhood Infill and Stabilization Program (NISP) in an effort to respond to the problem of
promoting affordable housing in distressed neighborhoods and urban areas. It is anticipated that NISP
will serve to create a model that will enable the construction of new or the rehabilitation of existing
single family housing stock in areas where market values do not support the actual cost of construction
or rehabilitatiorr-and/or the purchase price of the housing unit. The Pilot PWgram has focused on the
construction of new single family homes on vacant parcels in the Little Haiti and Overtown

neighborhoods of the City of Miami as well as Homestead and Florida City, in South Miami -Dade
County. The developers selected to participate in the program are neighborhood based non-profit
organizations or community development corporations (CDCs), which include the Little Haiti Housing
Association, Inc., Greater Miami Neighborhoods, Inc., St. John Community Development Corporation,
BAME Development Corporation of South Florida, Inc., New Washington Heights CDC, Centro
Campesino, Covenant CDC, and the Nehemiah Project of Homestead. Funding in the amount of $3
Million from Fannie Mae and $1 Million in Documentary Surtax Program funding from Miami -Dade
County has been allocated to this program.
In July of 1996, through Resolution No. 96-576, the City Commission approved the designation of
Housing Initiative Group, Inc. and Palmetto Homes of Miami, Inc., to develop ten (10) new single
family homes on nine (9) city -owned parcels located in the Edison -Little River and Model City
neighborhoods. Due to the developer's lack of performance, it is recommended that the City
Commission rescind Section 2 of the aforementioned resolution and direct the City Manager to convey
the subject city -owned parcels to the Little Haiti Housing Association, Inc.
Several of the subject city -owned parcels have title problems and the Little Haiti Housing Association,
Inc. has agreed to accept all the parcels, including those with the title defects, and "rill assume the
responsibility of defraying the cost of securing good and marketable title for each property prior to the
commencement of construction.
The attached resolution authorizes and directs the City Manager to convey the subject parcels at no
cost to the aforementioned corporation. In addition, the organization is required to commence
construction on the subject city -owned parcels within twelve (12) months from the date of conveyance
by the City or said parcels wrill revert back to the City.
The City is in a position to assist the private sector in the development of new homeownership housing
affordable to very low, low and moderate -income families in the Little Haiti neighborhood by making
seventeen (17) parcels of vacant land currently under City -ownership available for such development.
In an effort to further promote the development of new single-family homes in the Little Haiti
neighborhood, City Commission adoption of the attached resolution is respectfully recommended.

Edison/Little River neighborhoods, more particularly described in Exhibit A, subject to said
corporation providing evidence acceptable to the City of firm commitments for project
construction and permanent financing.
Section 3. Wind & Rain, Inc., a for profit corporation, is hereby designated, in
principle, as sponsor to undertake the development of six (6) new single homes affordable
to low and moderate income families and individuals on five (5) vacant city -owned parcels
located in the Coconut Grove neighborhood, more particularly described in Exhibit "A",
subject to said corporation providing evidence acceptable to the City of firm commitments

for project construction and permanent financing, City Commission approval of said
sponsor is subject to the development of a housing unit comparable to those units being
proposed by Housing Initiative Group, Inc., & Palmetto Homes of Miami, Inc.'s proposal at
a selling price of $2,000 lass and final review and approval of the housing plans and
specifications by the City Commission at a later date.
Section 4. Housing Initiative Group, Inc., & Palmetto Homes of Miami, Inc., and
Wind and Rain, -Inc. are hereby directed to prepare and finalize housing plans and
specifications, construction and permanent financing, construction schedule for the
obtaining of building permits within six (6) months and construction to be completed within
twelve 0 2) months from the date of conveyance. Subject parcels to revert back to the
City if construction is not completed within twelve (12) months from the date of this
action.
Section 5. The City Commission hereby establishes a range of $3,250 to
$4,150 as the maximum reimbursement amount to be paid to the City ,of Miami for said
parcels for.it;L cost of site acquisition, based on five (5%) percent of the selling price for
the particular housing model to be developed by both Project Sponsors, subject to certain
terms and conditions.
Section f. The City Manager is hereby authorized' to execute the appropriate
documents, in forms acceptable to the City Attorney, conveying said parcels, more
