A RESOLUTION OF THE MIAMI CITY COMMISSION
ALLOCATING $163,000 OF TWENTY-FIFTH (25Tx)
YEAR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
FU14DS FOR THE COST OF RELOCATION EXPENSES FOR
THE 109 FAMILIES IMPACTED BY THE CITY'S
TERMINATION OF THE SECTION 8 HOUSING
ASSISTANCE PAYMENT ("HAP") CONTRACT WITH
MIAMI LIMITED II.
WHEREAS, Resolution No. 99-726, adopted on
September 28, 1999, authorized and directed the City Manager to
take all action necessary to initiate and assist in the immediate
relocation of the residents of the properties located at 1501
Northwest 59th Street, 1270 Northwest 60th Street, and 1320, 1321,
and 1370 Northwest 61st Street, Miami, Florida, said
authorization and direction contingent upon the findings of the
City Attorney and the City Manager that Miami Ltd. II is in
default of its contract; and
WHEREAS, Miami Limited II failed to address substandard
housing conditions and quality of life issues impacting persons
residing in the Section 8 apartment buildings at the above -
mentioned locations and, as a result, the City Manager and City
Attorney determined that Miami Limited II was in default of its
Housing Assistance Payment ("HAP") contract and the City

exercised its right to terminate the HAP contract; and
WHEREAS,•Resolution 99-726 further directed the City Manager
to initiate appropriate action to ensure the timely relocation of
the effected Section 8 tenants; and
WHEREAS, the Department of Community Development has
identified $163,000 of 25th Year Community Development Block
Grant funds for the cost of relocation expenses for effected
Section 8 tenants; and
WHEREAS, said use of Community Development Block Grant funds
complies with all applicable rules, regulations or laws Yegarding
same as approved by the Director of Community Development;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. $163,000 of 25t' Year Community Development
Block Grant Funds is hereby allocated for the cost of relocation
expenses for the 109 families impacted by the City's termination

Section 3. This resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

TO AMEND THE FY 1999-2000 ACTION PLAN BY ALLOCATING $6,052,446 OF
25"H YEAR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO
CONTINUE ECONOMIC DEVELOPMENT ACTIVITIES, CONTINUE FAIR
HOUSING SERVICES, FUND MUNICIPAL COMMITMENTS, AND
REPROGRAMMING $1,162,351 OF PREVIOUSLY ALLOCATED CDBG FUNDS;
PROVIDING SERVICES IN THE RELOCATION OF SECTION 8 TENANTS
LOCATED IN THE MIAMI LIMITED II PROJECT; AND ALLOCATING $253,665 OF
EMERGENCY SHETER GRANT FUNDS.
Pursuant to the Department of Housing and Urban Development 24 CFR Part 91, The Miami City Commission will
conduct a Public Hearing on November 16`h, 1999 to address the recommendations to allocate $6,052,446 of 25`h
Year CDBG funds and $253,665 of Emergency Shelter Grant Funds; and further reprogramming previously
allocated CDBG funds.

It is respectfully recommended that the City Commission allocate $163,000 of Twenty -Fifth Year
Community Development Block Grant Funds (CDBG) fo cover expenses relating to the relocation
of the 109 families currently residing in five (5) Section 8 multi -family apartment buildings
formerly under contract with Miami Limited II.
BACKGROUND:
At the September 28, 1999 City Commission meeting, the City Commission adopted Resolution No.
99-712 that authorized and directed the City Manager to take the necessary action to initiate and
assist in the immediate relocation of the residents residing in the five (5) Miami Limited II Section 8
apartment buildings located at 1501 Northwest 59`h Street, 1270 Northwest 60`h Street and 1320,
1321 and 1370 Northwest 615` Street.
In accordance with this legislation, this authorization was predicated on the determination by the
City Attorney and City Manager that Miami Limited H was in default of its Section 8 Housing
Assistance Payments (HAP) Contract. Based on the continued failure of Miami Limited II to
address the substandard housing conditions and the quality of life issues impacting families
currently residing in the aforementioned properties, the City Attorney and City Manager determined
that Miami Limited II is in default of its contract. As a result of this default, the City has exercised
its right to terminate the HAP Contract.
It is the City's responsibility to coordinate the expeditious relocation of its Section 8 residents
impacted by the termination of the HAP contract. In response to the City Commission's direction,
the City Manager has initiated appropriate action to ensure the timely relocation of the effected
Section 8 tenants residing in the aforementioned apartment buildings. The Department of
Community Development has been working with representatives from the Miami -Dade Housing
Agency and HOPE, Inc. to develop the City's Strategic Relocation Plan to relocate the residents to
decent, safe and sanitary housing units in the private housing marketplace.

Similar endeavors across ' the country indicate that relocation expenses range from as low as
approximately $1,100 per household to as high as $2,500, depending on such factors as family size,
relocation distances, varying security deposits and other unique conditions. The Department of
Community Development has identified $163,000 of 25`h Year Community Development Block
Grant (CDBG) funds from the social service category to defray costs associated with the relocation,
including moving expenses, landlord deposits, utility deposits, etc. This allocation was determined
by projecting that the average cost to realistically relocate a family would fall somewhere between
the $1,000 to $2,500 limits recognized as the national range. The staff based its $163,000 allocation
on an average, arbitrary relocation cost of $1,500 per household.
The relocation of the Section 8 residents to decent, safe and sanitary housing meets the criteria
established by Congress in approving the waiver to increase the City's public service cap, since it
provides services directly to persons impacted by welfare reform. It must also be noted that this
allocation will reduce the amount of funding available in the public service category by $163,000
from the recently completed Request for Proposal process.
The proposed resolution allocates $163,000 of 25`h Year CDBG funds to provide relocation
expenses to assist in the move to the private marketplace of the existing residents impacted by the
termination of the Section 8 HAP contract with Miami Limited II.
