A RESOLUTION OF THE MIAMI CITY COMMISSION
ACCEPTING THE PREVIOUSLY APPROVED PROJECTS
INCLUDED IN THE CONSOLIDATED PLAN AND 1999-
2000 ANNUAL ACTION PLAN SUBMITTED TO THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
FOR THE USE OF COMMUNITY DEVELOPMENT BLOCK
GRANT (CDBG), HOME INVESTMENT PARTNERSHIP
PROGRAM (HOME), HOUSING OPPORTUNITIES FOR
PERSONS WITH AIDS (HOPWA), AND EMERGENCY
SHELTER GRANT (ESG) FUNDS.
WHEREAS, the City Commission held a public hearing on this
date, to provide a final opportunity for the public to comment on
the Consolidated Plan and the 1999-2000 Annual Action Plan for
the use of Community Development Block Grant (CDBG), Home
Investment Partnership Program (HOME), Housing Opportunities for
Persons with Aids (HOPWA), and Emergency Shelter Grant (ESG)
funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The previously approved projects included in
the Consolidated Plan and 1999-2000 Annual Action Plan submitted

ENCLOSURES:
In a letter dated September 30, 1999, the U.S. Department of Housing and Urban
Development (HUD) advised the City that it had disapproved the City's Consolidated
Plan due to concerns relating to citizen participation requirements for the 1999-2000
Annual Action Plan. Following this notification, staff from the Department of
Community Development met with representatives from HUD to develop a strategy to
resolve HUD's concerns and ensure compliance with federal regulations pertaining to
citizen participation.
As a result of the meeting with HUD, it was agreed that the City of Miami would conduct
a Public Hearing at the City Commission meeting of November 9, 1999 to provide a final
opportunity for the public to comment on the 1999-2000 Action Plan. The Public Notice
relating to this item would provide a comprehensive listing of all the projects included in
the Action Plan submitted to HUD as part of the Consolidated Plan approved by the City
Commission. Following the Public Hearing, the City will then resubmit its Annual
Action Plan along with any comments and changes made to the Plan as a result of the
Public Hearing. The HUD disapproval letter dictated that the Consolidated Plan must be
resubmitted to HUD "within forty-five days from September 30, 1999." By resubmitting
the Annual Action Plan with a summary of comments received by the public during the
Public Hearing and any changes the City plans to make as a result of public input to HUD
by 5:00 P.M., Friday, November 12, 1999, the City will be in compliance with the forty-
five (45) day deadline.
This strategy was designed to ensure compliance with federal regulations pertaining to
citizen participation. HUD has indicated that it will then review the Plan and make a
determination of its acceptability within thirty days.
Immediately following the decision to reschedule the City Commission meeting from
November 9 to November 16, staff contacted HUD to request a one week extension. At
the time of the City Commission meeting, the Administration did not believe that the one
week extension would be a major issue with HUD, therefore a concern was not raised on
the floor at that time. However, as a result of correspondence received at all HUD levels
expressing concerns regarding the City's citizen participation process, HUD indicated that
the previously established forty-five day deadline was not negotiable and that failure to
meet this deadline could jeopardize the City's HUD grant funds.

Therefore, the special meeting has been scheduled to conduct a Public Hearing providing
a final opportunity for the public to comment on the Annual Action Plan. As instructed
by HUD, this action will satisfy HUD's concems relating to the citizen participation
process regarding the Annual Action Plan. Following the Public Hearing the Department
of Community Development will prepare the appropriate information to resubmit the
Plan to HUD with the forty-five day deadline.

Dear Commissioner Regalado:
This letter is to request your assistance and consideration in extending the time limit for the RFP (Request
For Proposal) which was due on Friday, October 29, 1999 at 3:00 p.m.
Edgewater is a small Community Development Agency. Since its inception in 1992, our organization have
demonstrated the ability to help retain, expand and bring new business to the area. Edgewater speaks for
itself.
We are about to commence building two Single Family Low moderate income houses. Lots have been
acquired, plans and specifications have been approved by the City of Miami -Building and Zoning
Department. Losing the RFP (Request For Proposal) for Housing Administration and Project Cost will be
detrimental to our agency and staff.
Please be informed that the RFP (Request For Proposal) was provided to us on Thursday, October 14,
1999, leaving the agency less than 10 working days to prepare the request. (Hurricane Irene on 10-15-99).
Our package was delivered on November 1, 1999 at 12:49 p.m., only six working hours difference from
deadline time. The reason we are asking the extension is because we were presented at the same time with
numerous requests by the City of Miami with a very short period to comply.

Consolidated Plan and Action Plan:
• Public Hearing scheduled as instructed by U.S. HUD to
address concerns
• U.S. HUD provided the guidelines needed for it to
approve the Consolidated Plan and the Annual Action
Plan
• The Administration has responded accordingly to
HUD's instruction and direction
*Specific Inquiry:
1. Funding of projects in the Action Plan equals funding
availability under CDBG, HOME and HOPWA 1 E- S' c�,
29-- 84J.

2. Program Administration is included as a project in the
Action Plan and on Page 170 of Consolidated Plan.
Action Plan is consistent with the action taken by the
City Commission and projects approved through the
adoption of the Consolidated Plan. This includes
Municipal projects included on Page 170 and social
service, housing and economic development projects
approved by the City Commission. It also includes
project pools to be allocated through the Request for
Proposal process
3. Program Income of $3.5 million is identified on Page
170 of the Consolidated Plan and uses for program
income are identified in Appendix III (previous funding
commitments authorized by City Commission). The

approved appropriations ordinance also includes the
projected $3.5 million of program income (Appendix
11)
4. All funds are programmed as the result of prior
Commission approval, the formal RFP process or
municipal programs identified in the approved
Consolidated Plan.
5. The projects included in the Action Plan have received
previous City Commission approval through a Public
Hearing process.
6. The explicit purpose of the Public Hearing soliciting
formal comment on the Action Plan is intended to
satisfy federal requirements so that the Plan can be
submitted to HUB by the November 15 deadline. As

instructed by HUD, the process initiated by the
Administration conforms to the direction of the local
HUD Office.
7. The purpose of this meeting, in accordance with HUD's
instructions, is to conduct a Public Hearing to provide a
final opportunity for public comment relating to the
Action Plan previously submitted to HUD. A Public
Hearing has been scheduled for November 16 to
continue the Economic Development Agencies and
commercial facade program as well as formalize the
allocation of municipal projects and commitments. The
remaining funds will be allocated on the basis of the
recently completed RFP evaluation process.
Following this Public Hearing:
• City will resubmit its Annual Action Plan along with
any comments and changes made to the Plan as a result
of the Public Hearing.
• This information will be submitted to HUD by 5:00
P.M., Friday, November 12, 1999 in accordance with
the forty-five (45) day deadline referenced in the HUD
disapproval letter reaffirmed this commitment in your
response to that letter.
