A RESOLUTION RELATED TO THE TASTE OF THE
GROVE FESTIVAL, CONDUCTED BY THE COCONUT
GROVE CHAMBER OF COMMERCE, TO BE HELD ON
JANUARY 22-23, 2000, AT PEACOCK AND MYERS
PARKS, IN COCONUT GROVE; AUTHORIZING THE CITY
MANAGER TO ISSUE A TWO-DAY PERMIT FOR THE
SALE OF ALCOHOLIC BEVERAGES DURING SAID
EVENT; AUTHORIZING THE CLOSURE OF STREETS IN
THE AREA OF McFARLANE ROAD FROM SOUTH
BAYSHORE DRIVE TO MAIN HIGHWAY AND SOUTH
BAYSHORE DRIVE FROM MCFARLANE ROAD TO MARY
STREET, INCLUDING ALL STREETS, AVENUES,
ALLEYS, WAYS AND THOROUGHFARES WHICH
INTERSECT SAID AREAS IN COCONUT GROVE, MIAMI,
FLORIDA, FOR SAID EVENT; SAID AUTHORIZATION
CONDITIONED UPON THE ORGANIZERS: (1)
OBTAINING ALL PERMITS REQUIRED BY LAW,
INCLUDING BUT NOT LIMITED TO A TEMPORARY
PERMIT TO SEI.,L ALCOHOLIC BEVERAGES BY THE
FLORIDA DEPARTMENT OF BUSINESS REGULATION,
DIVISION OF ALCOHOLIC BEVERAGES AND TOBACCO,
PURSUANT TO SECTION 54-13 OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED; (2)
PAYING FOR ALL NECESSARY COSTS OF CITY
SERVICES AND APPLICABLE FEES ASSOCIATED WITH
SAID EVENT; (3) OBTAINING INSURANCE,
INCLUDING LIQUOR LIABILITY, TO PROTECT THE
CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY
MANAGER' OR HIS DESIGNEE; (4) INSTITUTING AN
IDENTIFICATION PROGRAM TO ASSURE THAT ONLY
THOSE INDIVIDUALS OVER THE AGE OF TWENTY-ONE
MAY PURCHASE ALCOHOLIC BEVERAGES; (5)
ADVISING ALL ADJACENT BUSINESSES, PROPERTY
OWNERS, AND RESIDENTS OF STREET.' CLOSURES
ASSOCIATED WITH SAID EVENT; AND (6) COMPLYING
WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE
PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE.
WHEREAS, Sid Sussman, Chairperson of the Taste of the Grove

Festival and representative of the Coconut Grove Chamber of
Commerce, requested that the City Commission _grant permission for
the sale of spirit based alcoholic beverages and for the closure
of certain streets as they relate to the annual Taste of the
Grove Festival; and
WHEREAS, Mr. Sussman has advised the Commission that the
name of the festival may be changed this year, but that the
Coconut Grove Chamber of Commerce will remain as sponsor of said
festival; and
WHEREAS, notwithstanding the possible name change for the
festival, the City Commission wishes to grant Mr. Sussman's
requests, subject to certain conditions, as they relates to the
event;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
issue a two-day permit for the sale of alcoholic beverages during
the Taste of the Grove Festival, conducted by the Coconut Grove

Chamber of Commerce, to be held on January 22-23, 2000, at
Peacock and Myers Parks in Coconut Grove, Miami, Florida.
Section 3. Street closures for the festival are hereby
authorized for those streets in the area of McFarlane Road from
South Bayshore Drive to Main Highway and South Bayshore Drive
from McFarlane Road to Mary Street, including all streets,
avenues, alleys, ways and thoroughfares which intersect said
areas in Coconut Grove, Miami, Florida.
Section 2. The herein authorizations are hereby
conditioned upon the organizers (1) obtaining all permits
required by law, including but not limited to a temporary permit
to sell alcoholic beverages by the Florida Department of Business
Regulation, Division of Alcoholic Beverages and Tobacco, pursuant
to Section 54-13 of the Code of the City of Miami, Florida, as
amended; (2) paying for all necessary costs of City services and
applicable fees associated with said event; (3) obtaining
insurance to protect the City in the amount as prescribed by the
City Manager or his designee; (4) instituting an identification
program to assure that only those individuals over the age of
twenty-one may purchase alcoholic beverages; (5) advising all
adjacent businesses, property owners, and residents of street
closures associated with said event; and (6) complying with all
conditions and limitations as may be prescribed by the City

Manager or his designee.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

Please place the chamber on the agenda for the next Commission Meeting so we can request the
following items for the "Taste of the Grove" on January 22 and January 23, 2000.
A. Permission for the sale of spirit based alcoholic beverages.
B. Street closures on McFarlane Road and South Bayshore Dr.
Both of these items have been requested and approved by the Commissioners for the past 15 years. We
will work with all the appropriate departments in the city to make sure all rules and regulations are
followed.
Please let us know what mecting we are scheduled for.

RECOMMENDATION:
The administration recommends approval of the Coconut Grove Chamber of
Commerce's request to sell alcoholic beverages, subject to the following:
• Paying for the cost of all City services and applicable permits fees required by law.
• Obtaining insurance, including liquor liability, to protect the City of Miami in the
amount stipulated by City requirements.
• Instituting an identification program to assure that only those over the age of twenty-
one will buy alcoholic drinks.
• Notifying adjacent businesses, property owners and residents of the upcoming street
closures.
As it relates to the waiver of fees, the administration recommends denial due to
budgetary constraints. Approval of this request may set a precedent for other festivals
seeking financial support from the City.
BACKGROUND:
Ms. Martha Fernandez, Executive Director of the Coconut Grove Chamber of Commerce,
is appearing before the City Commission to request authorization to sell alcoholic
beverages during the Taste of the Grove scheduled for Saturday and Sunday, January 22,-
23; 2000.
The organizers of the event will meet with City staff, including the Police Department
and NET office, as well as with the Coconut Grove Festival Committee, to discuss the
festival. The Coconut Grove Festival Committee will approve the event subject to
compliance with all rules and regulations prescribed by the City of Miami. The
event will be require street closure on McFarlane Road and South Bayshore Drive.
