A RESOLUTION, WITH ATTACHMENT (S), OF THE
MIAMI CITY COMMISSION, TRANSFERRING A
PORTION OF THE RIGHT-OF-WAY OF
NORTHWEST 9T11 STREET, MIAMI, FLORIDA, TO
THE JURISDICTION OF THE STATE OF FLORIDA
HIGHWAY SYSTEM IN CONFORMANCE WITH FLORIDA
STATUTES, SECTION 337.29; FURTHER
AUTHORIZING THE FLORIDA DEPARTMENT OF
TRANSPORTATION TO RECORD A RIGHT-OF-WAY MAP
OF THE SUBJECT ROAD IN THE PUBLIC RECORDS
OF MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, Northwest 9th Street, is a dedicated public right-
of-way within the City of Miami, Florida; and
WHEREAS, the Miami -Dade Expressway Authority is finalizing
plans to improve the toll collection facility on the East-West
Expressway (State Road 836) and its exit ramp between Northwest
22°dAvenue and Northwest 17th Avenue, Miami, Florida; and
WHEREAS, a component of the Miami -Dade Expressway
Authority's plan includes widening of the approach lanes to the
toll facility, reconstructing the collection structure,
installation of landscaping along Northwest 9th Street, Miami,
Florida, and widening of the eastbound exit ramp at Northwest
17th Avenue, Miami, Florida; and
WHEREAS, the Miami -Dade Expressway Authority and the Florida
Department of Transportation desire to include a portion of the
right-of-way of Northwest 9th Street, Miami, Florida, in the

State Highway System to accommodate the proposed improvement of
the expressway toll collection facility and the exit ramp; and
WHEREAS, as a condition of the said right-of-way
addition/transfer to the State Highway System, the Miami -Dade
Expressway Authority shall be responsible for the maintenance of
the landscaping improvements hereinafter described; and
WHEREAS, in conformance with Florida Statutes,
Section 337.29, a right-of-way map of the subject road, more
accurately described on the attached legal description, has been
prepared and will be duly recorded in the Public Records of
Miami -Dade County, Florida, by the F1 nr; ria
Transportation;
WHEREAS, in order to mitigate the negative effects of the
toll collection and exit ramp facilities intrusion into the
adjacent neighborhood to the south, the Miami -Dade Expressway
Authority has, at the request of the affected residents and
homeowners, agreed to provide expansive landscaping improvements
adjacent to and within Northwest 9`h Street, Miami, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. A portion of Northwest 9th Street, within the
City of Miami, Florida, together with all public right-of-way
adjacent thereto, as described on the legal description attached
as Exhibit "A" is hereby added to the State Highway System and
transferred to State of Florida jurisdictional responsibility in
accordance with Florida Statutes, Section 337.29.
Section 3. The Florida Department of Transportation is
hereby authorized to properly record a right-of-way map of the
subject road in the Public Records of Miami -Dade County, Florida.
Section 4. The Miami -Dade Expressway Authority agrees to
provide the landscaping improvements as shown on Exhibit "B"
attached hereto and to maintain said improvements. For those
landscaping improvements located outside of the right-of-way as
described in Exhibit "A", the City of Miami will enter into an
interlocal agreement with the Miami -Dade Expressway Authority to
access the City's right-of-way at this location to maintain said

Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

ENCLOSURES:
The Miami -Dade Expressway Authority (MD)0 is currently preparing plans for
expanding and improving the East-West Expressway toll facility at approximately
NW 20 Avenue. A critical component to this plan includes widening the approach
lanes to the toil facility, reconstructing the collection structure and the widening
and improvement of the eastbound exit ramp at NW 17 Avenue.
In order for the MDX to complete its expressway improvement plans, it is
necessary that a portion of public right-of-way (33,380 square feet) on the north
side of NW 9 Street be transferred to the jurisdiction of the State Highway System
so that the MDX may assume reconstruction and maintenance responsibility of the
improved expressway and exit ramp. The MDX has been working with the Citys
West Little Havana NET Service Center and with the property owners abutting NW 9
Street to ensure that proper access and traffic flow is maintained to all properties
adjacent to the remainder of NW 9 Street.
In addition, this project will also accomplish a desire by neighborhood property
owners to control undesirable traffic intrusion into their neighborhood by
converting NW 9 Street into a one-way roadway, thereby discouraging commuter
"short cutting" through the neighborhood from NW 7 Street. The MDX has
conducted a series of meetings with residents and the homeowner association of
the adjacent neighborhood and, at the request of homeowners, MDX has also
included in this project extensive landscaping between the expressway and NW 9
Street and new landscaped areas at NW 21 Avenue and NW 17 Avenue adjacent to
the expressway. A "linear park" with paved path, benches and landscaping will be
constructed on the north side of NW 9 Street between NW 21 Avenue and NW 21
Court. The open areas under the expressway will be fully lighted, in accordance
With FDOT standards, to the maximum extent possible. All of these additional
improvements will be routinely maintained by the MDX
The MDX has prepared the necessary right-of-way map of the subject area to be
transferred and will be responsible for all costs to construct the expressway
improvements. This Resolution permits the proper recording of the required
right-of-way map to effect the transfer of jurisdiction. It is respectfully
recommended that as a condition of the transfer of this right-of-way, that the
Expressway Authority assume maintenance responsibility for all landscaping
installed in this project.
