HomeMy WebLinkAboutR-99-0778K i J-99-889 10/12/99 RESOLUTION NO.k) /IS A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO ESTABLISH A POLICY, EFFECTIVE IMMEDIATELY, RELATING TO ANY NOT -FOR -PROFIT ORGANIZATION WHOSE RECORDS ARE NOT SUBJECT TO THE FLORIDA SUNSHINE LAW OR FLORIDA PUBLIC RECORDS LAW ("ORGANIZATION") BY: (1) RESTRICTING ANY CITY OF' MIAMI EMPLOYEE (ON OR OFF -DUTY) FROM PROVIDING PAID OR PRO BONO SERVICES TO OR FOR ANY SUCH ORGANIZATION, UNLESS SAID ORGANIZATION IS PROVIDING FUNDING FOR THE COSTS OF SERVICES OF OFF -DUTY EMPLOYEES FROM THE DEPARTMENTS OF POLICE, FIRE -RESCUE, SANITATION, AND ANY OTHER CITY DEPARTMENT; (2) RESTRICTING THE USE OF ANY CITY PROPERTY OR EQUIPMENT, UNLESS SAID ORGANIZATION IS PROVIDING FUNDING FOR ALL COSTS ASSOCIATED WITH SAID TISE; AND (3) PROHIBITING THE GRANT OF A -NY FEE WAIVERS OR FUNDING AS THEY RELATE TO SAID ORGANIZATIONS. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby directed to establish a policy, effective immediately, relating to any not - for -profit organization whose records are not subject to the Florida Sunshine Law or Florida Public Records Law ("Organization") by: (1) restricting any City of Miami employee (on or off - duty) from providing paid or pro bono services to or for any such Organization, unless said CITY COMMSSION MEETING OF Q C T 1 ? 1999 Husoluti"n No. fx. d 6 Organization is providing funding for the costs of services of off -duty employees from the Departments of Police, Fire -Rescue, Sanitation, and any other City department; (2) restricting the use of any City property or equipment, unless said Organization is providing funding for all costs associated with said use; and (3) prohibiting the grant of any fee waiver(s) or funding as they relate to said Organization. Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor Y PASSED AND ADOPTED this 12th day of October , 1999. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. - 2 -
