A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR FIFTHS (1/5'"1 AFFIRMATIVE VOTE, AFTER
A DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF., AN EMERGENCY, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS, AND
APPROVING THE CONSTRUCTION FOR THE
REPLACEMENT OF SIDEWALKS AND CURBS IN THE
DOWNTOWN CENTRAL BUSINESS DISTRICT, MIAMI,
FLORIDA, IN AN AMOUNT NOT TO EXCEED
$1,074,000.00; FURTHER AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT(S), IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
SAID PURPOSE; ALLOCATING FUNDS THEREFOR FROM
CAPITAL IMPROVEMENT PROJECT NO. 341135, AS
APPROPRIATED BY THE ANNUAL APPROPRIATIONS AND
CAPITAL IMPROVEMENTS ORDINANCE.
WHEREAS, the Department of Public Works conducted a survey
of sidewalks and curbs in the Downtown Central Business District
identifying 13,000 square feet of sidewalk and 5,140 linear feet
of curb in need of immediate replacement; and
WHEREAS, impact fees are collected as part of the
development process for new construction in the Downtown Business
District; and
WHEREAS, it is essential that the construction for the
replacement of the sidewalks and curbs commence in order to be
completed by October 1, 2000, the deadline for the utilization of
these funds; and
WHEREAS, the City Manager has determined that the need to

replace the sidewalks and curbs constituted an emergency; and
WHEREAS, the City Manager and the Director of Public Works
recommend that the requirements for competitive sealed bids be
waived and the solicitation of informal bids be made for the
implementation of said project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By four -fifths (4/51he) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of an emergency, and
waiving the requirements for competitive sealed bids are hereby
ratified, approved and confirmed, and the construction for the
replacement of sidewalks and curbs in the Downtown Central
Business District, Miami, Florida, in an amount not to exceed
$1,074,000.00, is hereby approved, with funds therefor hereby
allocated from Capital Improvement Project No. 341135, as

appropriated by the Annual Appropriations and Capital
Improvements Ordinance.
Section 3. The City Manager is hereby authorized!' to
enter into an agreement(s), in a form acceptable to the City
Attorney, with the lowest responsive and responsible bidder(s)
for said project:.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.?'

it is respectfully recommended that the City Commission adopt the attached
Resolution ratifying the City Manager's written finding that a valid emergency
exists concerning the condition of sidewalks and curbs in the Downtown Central
i Business District and waiving formal competitive bidding procedures and
! authorizing the City Manager to accept the lowest responsible and responsive bid
! in an amount not to exceed $1,074,000.00.
BACKGROUND
The Public Works Department has conducted a block by block survey of the
condition of sidewalks and curbs in the downtown central business district and has
identified 13,000 square feet of sidewalk and 5,140 linear feet of curb as being in
poor condition and in need of replacement. In addition, the majority of the
poorest condition sidewalk is located south of Flagler Street and along the avenues
north of Flagler Street. Due to their age and condition, they do not present a
good appearance and should be replaced, preferably with tinted concrete to
blend with the proposed Flagler Marketplace concept. The total cost estimate,
including construction, design, project management, inspection and incidentals is
S1,074,000.00 This project is scheduled to be funded from the Impact Fees
designated for the Downtown District.
The reason for the emergency finding is as follows: in accordance with the City
Code, the City collects Impact Fees as part of the development process for new
construction in the Downtown District. As prescribed by Code, these funds must
be utilized within six (6) years of collection. Prior finance control delayed the
allocation of these funds to a specific Capital Improvement Project and the time
frame now requires that these funds be utilized within the next fiscal year. It is
essential that this project begin immediately in order to be completed in advance
of the October 1, 2000 deadline.
Funds for the execution of this project are available from monies appropriated in
the City's Appropriations Ordinance No. 11705, as amended, under CIP Project No.
341135.

Based on my investigation of the condition of the sidewalks and curbs in the Downtown
area, i have found that an EMERGENCY exists in the central business district which justifies
the selection of a contractor by informal bids.
The Public Works Department has conducted a block by block survey of the condition of
sidewalks and curbs in the downtown central business district and has identified 13,000
square feet of sidewalk and 5,140 linear feet of curb as being in poor condition and in
need of replacement. in addition, the majority of the poorest condition sidewalk is
located south of Flagier Street and along the avenues north of Flagler Street. Due to their
age and condition, they do not present a good appearance and should be replaced,

Such conditions indicate the need for extraordinary measures to protect the health,
safety and welfare of the community and the tenants and customers of the local
businesses in this high vehicular and pedestrian volume traffic area. In order to initiate
the construction of the sidewalk and curbs as soon as possible, formal competitive sealed
bid procedures shall be waived for the procurement of contracting services required for
said emergency pursuant to sections 18-83 and 18-84 of the City Code. Informal bids shall
be obtained and a contract shall be awarded by the City Manager to the lowest
responsive and qualified bidder. All costs of this project will be funded from the
Downtown Street Improvements -Phase Ill/Impact Fee, CIP No. 341135. This action shall be
ratified at the next available City,,-ommission meeting.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of Miami, Florida, on
October 12, 1999, at W.UO in the City Commission Chambers at City Hall, 3500 Pan
American Drive, Miami, Florida, for the purpose of hearing objections from any
interested parties affected by the ratifying of the City Manager's written finding
that a valid emergency exists concerning the condition of sidewalks and curbs in
the Downtown Central Business District and waiving formal competitive bidding
procedures and authorizing the City Manager to accept the lowest responsive and
responsible bid in an amount not to exceed $1,074,000.00 to replace said sidewalks
and curbs.
All interested persons are invited to appear and may be heard concerning the
sidewalk and curb replacement. Should any person desire to appeal any decision
of the City Commission with respect to any matter considered at this hearing, that
person shall ensure that a verbatim record of the proceedings is made, including
all testimony and evidence upon which any appeal may be based.
