RESOLUTION NO." c, d y A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI, B.A.M.E. DEVELOPMENT CORPORATION OF SOUTH FLORIDA, INC., AND MIAMI-DADE COUNTY FOR THE EXTENSION OF WATER AND SANITARY SEWER FACILITIES FOR THE NEW HOPE OVERTOWN SUBDIVISION LOCATED BETWEEN NORTHWEST 6``' AND 8'1 STREETS FROM NORTHWEST S1' TO 6'" AVENUES, MIAMI, FLORIDA. WHEREAS, the B.A.M.E. Development Corporation of South Florida, Inc. ("BAME"), in cooperation with the City of Miami, is constructing a new development in the New Hope Overtown Subdivision located between Northwest 6th and 8th Streets from Northwest 51h to 6th Avenues, Miami, Florida, which requires the provision of adequate water and sanitary.sewer services;, and WHEREAS, said services must be extended within and adjacent to the New Hope Overtown Subdivision; and WHEREAS, Miami -Dade County ("County") owns the water distribution and sanitary sewer systems within the City of Miami and it is necessary to enter into an agreement with the County to Cm CONMSSION MEETING OF S E P I 9 12S9 Resolution No. set forth the terms and conditions for providing .the necessary water and sanitary sewer services to the new development; and WHEREAS, all costs for the installation of these facilities, including, but not limited to, permits, fees, engineering and construction activities, shall be paid by the BAME; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City, Manager is hereby authorized!' to i' execute an agreement, in a form acceptable to the City Attorney, between the City of Miami, B.A.M.E.
