J A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5T"5) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY FOR THE PROVISION OF CUSTODIAL SERVICES AT THE MIAMI RIVERSIDE CENTER CITY OFFICE BUILDING FOR AN INITIAL PERIOD FROM JUNE 28, 1999, THROUGH SEPTEMBER 30, 1999, UPON RESCISSION OF THE CONTRACT WITH CHI-ADA CORPORATION AND ACCEPTING THE BID OF VISTA BUILDING MAINTENANCE SERVICES, THE SECOND LOWEST RESPONSIVE AND RESPONSIBLE BIDDER UNDER BID NO. 98-99-044, IN A TOTAL AMOUNT NOT TO EXCEED $49,269.00; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO, 504000.421901.6.340. WHEREAS, Resolution No. 99-188, adopted March 23, 1999, accepted the bid of Chi -Ada Corporation, for the provision of custodial services at the Miami Riverside Center City office building, on a contract basis until September 30, 1999; and WHEREAS, due to its unsatisfactory performance, Chi -Ada Corporation, was deemed non -responsible and terminated as of June 26, 1999; and WHEREAS, the second lowest responsive and responsible MEETING Or,, S E P 2 1 1999 Reralutim Dia bidder, Vista Building Maintenance Services was accepted; and WHEREAS, funding is available from Account Code No. 504000.421901.6.340; and WHEREAS, the City Manager, made a written finding that an emergency existed and authorized the provision of custodial services by Vista Building Maintenance Services, the next lowest responsive and responsible bidder. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, authorizing the provision of custodial services at the Miami Riverside Center City office building for an initial period from June 28, 1999 through September 30, 1999, upon rescission of the contract with Chi -Ada Corporation, and accepting the bid of Vista Building Maintenance Services, the second lowest responsive and responsible bidder under Bid No. 98- 99-044, in a total amount not to exceed $49,269.00, is hereby ratified approved and confirmed; with funds therefor hereby allocated from Account Code No. 504000.421901.6.340. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor!'. PASSED AND ADOPTED this 21st day of September 1999. BACKGROUND: Resolution 99-188 approved the bid of Chi -Ada Corporation to provide custodial services for the City, of Miami Riverside Center. The contract for these services was terminated on June 26. 1999 for poor performance and the next lowest and responsible bidder, Vista Building Maintenance, was emplaced on an emergency basis to complete the initial period of the contract from the date of implementation, June 28, 1999, through September 30, 1999. Shaw MRC facility Manager SUsJ=_C 7 : Request For The Emergency Provision Of MRC Janitorial Services REFERENCES: ENCLOSURES: As a result of terminating the MRC Janitorial Contract with Chi -Ada Corporation 26 June 1999, it is necessary to emplace the next lowest acceptable bidder into service on an emergency basis from 28 June through 30 September 1999. 30 September is not only the end of the fiscal year for the City but the end of the initial period of the MRC janitorial contract as approved by the Commission. At that time it will be decided whether or not to extend the contract or take over the services on an in-house basis. It is understood that the new vendor must meet the specifications of the contract to preclude same from being terminated prior to the end of the fiscal period. The next lowest acceptable bidder, Vista Building Maintenance Service, is prepared to take over the contract in question and begin 28 June.
