A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR FIFTHS (4/5T"s) AFFIRMATIVE VOTE,
RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS
AND APPROVING THE PROCUREMENT OF LIGHT BARS
AND SIRENS, FROM FEDERAL SIGNAL CORPORATION,
FOR THE DEPARTMENT OF GENERAL SERVICES
ADMINISTRATION, IN AN AMOUNT NOT TO EXCEED
$149,115; ALLOCATING FUNDS THEREFOR FROM
CAPITAL IMPROVEMENT PROGRAM, "REPLACEMENT OF
CITYWIDE FLEET", CIP PROJECT NO. 311850.
WHEREAS, the Police Department required the emergency
purchase of light bars and sirens to equip 100 of its new pursuit
vehicles; and
WHEREAS, the Department of General Services Administration
received an extension of Miami -Dade County contract No. 5038/99-2
for the procurement of light bars and sirens from Metro U.S.A.,
the approved vendor, who abruptly went out of business; and
WHEREAS, Federal Signal Corporation, the manufacturer, has
agreed to extend all Miami -Dade County 1995 contract pricing to
the City of Miami on a factory direct basis; and
WHEREAS, allocating funds from Capital Improvement Program,

WHEREAS, the City Manager, made a finding that an emergency
existed and approved the purchase of light bars and sirens from
Federal Signal Corporation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4J5t"') affirmative vote of
the members of the City Commission, the City Manager's finding of
an emergency, waiving the requirements for competitive sealed
bids, and approving the purchase of light bars and sirens, from
Federal Signal Corporation, for the Department of General
Services Administration, in an amount not to exceed $149,115, is
hereby approved, with funds therefor hereby allocated from

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission approve, ratify and confirm by
a four/fifth (4/5 h) affirmative vote, the City Manager's finding that an emergency need
existed in approving the emergency purchase of light bars and sirens from Federal Signal
Corporation, a Non-Minority/Non-Local vendor, located at 2645 Federal Signal Drive,
University Park, Illinois 60466-3195, for a total award amount not to exceed $149,115.
Funds are available in the FY 99 General Fund contribution to the Capital Improvement
Program, "Replacement of Citywide Fleet", CIP Project No. 311850, in the amount of
$149,115.
Background
In accordance with the Police Department's labor agreement and in consistency with the
fleet replacement program, one -hundred and thirty-five (135) new vehicles have been
purchased. The emergency purchase of these light bars and sirens are necessary to
properly equip one -hundred (100) police pursuit vehicles with the proper equipment
necessary to preserve public safety and welfare.
The Department of General Services Administration had recently recommended an
extension of a Miami Dade County Contract No. 5038-3/99-2 for the purchase of said
commodities but Metro U.S.A., the approved vendor, went out of business. Federal
Signal Corporation, the manufacturer, has agreed to extend all Miami Dade County 1995
contract pricing to the City of Miami, on a factory direct basis, which results in savings
of appro) i�tely $47,400 over current prices.

This is to state as of this date Metro U.S.A., Inc., distributor of Federal Signal Corporation products, is no longer in
business and no longer an authorized distributor of our products.
Miami -Dade County has exercised the renewal clause of the Metro -Dade County Lightbar and Accessory Contract
for 1999 and will expire October 31,1999 to Metro U.S.A, Inc. Since Metre U.S.A. is out of business and Federal
Signal Corporation does not have a local distributor in the Miami area at the pmesent time, Federal Signal will
extend all Metro -Dade Contract pricing to the city of Miami on a factory direct basis.

Request for Emergency

It is respectfully requested that authorization be granted for the emergency purchase of light
bars and sirens from the Federal Signal Corporation, a non -local vendor located at 2645
Federal Signal Drive, University Park, Illinois 60466-3195 in an amount not to exceed
$149,115. This emergency purchase is necessary to properly equip and outfit one hundred
thirty-five (135) police pursuit vehicles with the proper equipment necessary to preserve
public safety and welfare. Funds are available in the FY 99 General Fund contribution to the
Capital Improvement Program; "Replacement of City -Wide Fleet", CIP Project No. 311850.
The Department of General Services Administration had recently recommended an extension
of contract utilizing Miami Dade County Contract No. 5038-3/99-2 which was scheduled for
the May 11, 1999 Commission meeting. Unfortunately, Metro -USA (the approved vendor)
went out of business with no advanced notice. Due to these circumstances, Federal Signal
Corporation (the manufacturer) has agreed to sell directly to the City of Miami honoring the
1995 contract prices, which results in savings of approximately $47,700 over current prices.

ITEM: Light Bars and Sirens
DEPARTMENT: General Services Administration
TYPE: Emergency Purchase
REASON: In accordance with the Police Department's labor
agreement and in consistency with the fleet
