J-99-509 8/24/99 RESOLUTION NOe►'J r 6 0 0 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR -FIFTHS (4/5T"S) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, AND APPROVING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH ICF, INC., IN THE AMOUNT OF $36,000, UTILIZING CITY OF NORTH MIAMI CONTRACT/RFP NO. 01-98-00, FOR THE DEPARTMENT OF FIRE -RESCUE, FOR THE PROVISION OF MITIGATION PLANNING SERVICES; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 001000.280601.6.270. WHEREAS, the Department of Fire -Rescue was eligible for grant funding in the amount of $40,000 from Miami -Dade County in connection with Miami -Dade County Local Mitigation Planning Initiative; and WHEREAS, to qualify for this grant award, identification of mitigation projects and a planning strategy submission was required to Miami -Dade County prior to July 30, 1999; and WHEREAS, to meet the submission deadline, it was necessary to execute an emergency agreement to provide the necessary professional services with IC.F, Inc., utilizing City of North ATTACHMENT (5)I CONTAINED SEP 2 1 1999 1'etAQ1UUaa (4p, Miami Contract/RFP No. 01-98-00; and WHEREAS, funding for this service is available from Account No. 001000-280601.6.270; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, and approving the execution of a Professional Services Agreement, in the substantially the attached form, with TCF, Inc., in the amount of $36,000, utilizing City of North Miami contract/RFP No. 01-98-00, for the Department of Fire -Rescue, for the provision of mitigation planning services, is hereby ratified, approved and confirmed with funds therefor - 2 hereby allocated from Account Code No. 001000.280601.6.270. AUDIT AND INSPECTION RIGHTS: 7.1 The City may, at reasonable times, and for a period of up to three (3) years following the date of final payment by the City to Consultant under this Agreement, audit , or cause to be audited, those books and records of Consultant which are related to . Consultant's performance under this Agreement. Participation in this proactive -state/FedefM program will become a prerequisite condition to a communities eligibility for disaster recovery funding in the near future. Due to insufficient personnel resources the City has not been able to comply with the requirements of the project in a timely fashion. As a result most of the planning work to date has been performed for us by Miami -Dade County. In order to address the interest of the City it is essential that we take charge of this responsibility. As previously mentioned the long term solution for this and other issues includes the expansion of our Emergency Management Section. The best short term solution is to use the available grant funding of $36,000.00 to contract with an engineering firm to perform the initial aspects of the project and satisfy the deliverable requirements while serving the specific interest of the City's mitigation needs. Many local municipalities have contracted with consulting firms to perform the aforementioned task. Attached you will find a proposal from said firm and supporting legislation and procurement documents from the City of North Miami. Ms. Judy Carter has reviewed the procurement documentation and states that it satisfies the conditions of our purchasing process.
