FOR THE EXCAVATION, REMOVAL AND DISPOSAL OF CONTAMINATED SOIL LOCATED AT WATSON ISLAND A/K/A THE FORMER DADE HELICOPTER SITE, MIAMI, FLORIDA, AT A COST NOT TO EXCEED $29,711; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 311016.819301.6.270. WHEREAS, the Office of Asset Management requires the f procurement of environmental services to perform remedial work for the excavation, removal and disposal of contaminated soil at Watson Island also known as the former Dade Helicopter Site; and WHEREAS, during the removal of an above ground fuel tank at the site, leakage occurred resulting in soil and groundwater contamination, the extent of which is unknown; and WHEREAS, this leakage constitutes a valid public emergency requiring the immediate procurement of environmental services to perform remedial work and thereby protect the health, safety and CITY COMUSSION 1KEETING Off'' SEP 2 4 1999 K�rvluLoA No. welfare of the citizens and employees of the City of Miami.; and WHEREAS, in order to meet the July, 1999 deadline set by the Department of Environmental Resources Management (DERM) and to prevent any contamination of the groundwater, the City Manager made a written finding that an emergency existed and authorized the excavation, removal and disposal of the contaminated soil; "TI O] WHEREAS, funding is available in Account Code No. 311016.819301.6.270; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5t") affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bids, and approving the informal bid of Alpha Engineers Corp. for the excavation, removal and disposal of contaminated soil located at Watson Island a/k/a the former Dade Helicopter site, Miami, Florida at a cost not to exceed $29,711, is hereby ratified, - 2 - ,a lot-3 approved and confirmed, with funds therefor hereby allocated from Account Code No. 311016.819301.6.270. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. 3 - CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and Members of the Ci Commission FROM: ffDoA169=- City Manager RECOMMENDATION: 17 DATE FILE Resolution Authorizing SUBJECT: the Remediation of Soil Contamination at Former Dade Helicopter site REFERENCES: City Commission Meeting September 14, 1999 ENCLOSURES: Resolution It is respectfully recommended that the City Commission adopt the attached Resolution ratifying, approving and confirming the City Manager's finding that a valid public emergency exists waiving the requirements for competitive sealed bids for the excavation, removal and disposal of the contaminated soil at Watson Island a/k/a the former Dade Helicopter Site. This resolution further accepts the informal bid of Alpha Engineers Corp., a Hispanic, non -local vendor, at a cost not to exceed $29, 711, which funds are available in Account No. 311016.819301.6.270. BACKGROUND: The Office of Asset Management has prepared the attached resolution for consideration by the City Commission. Subsequent to Dade Helicopter vacating the premises located at approximately 950 MacArthur Causeway, the City procured bids for the removal of the above ground fuel tank. During the tank removal, soil contamination was found in an unknown amount. DERM has subsequently issued the City a notice of violation for this contamination. Based upon the latest information available, the contamination has not yet reached the groundwater level. Any delay in cleaning the site, however, could result in the groundwater being contaminated thus increasing the cost to remediate the site. Therefore, the City Manager determined a valid public emergency to exist requiring immediate procurement of environmental services to perform remedial work and thereby protect the health, safety and welfare of the citizens and employees of the City. The Office of Asset Management in cooperation with the Department of Public Works sought informal bids for this work. The companies solicited and their respective quotes are as follows: COMPANY NAME AMOUNT NOT TO EXCEED Alpha Engineers, Corp., (Hispanic/non-local) $29,711.00 Branching Out, Inc., (non-minority/non-local) $31,585.70 MCO Environmental, Inc., (Hispanic, local) $53,040.00 Based on the foregoing, the informal bid from Alpha Engineers Corp. in an amount not to exceed $29,711 was selected as being the lowest bidder. The finding is based upon the following: 1. Leakage has occurred from the former aboveground fuel storage tank resulting in soil and groundwater contamination, of unknown extent. 2. This leakage constitutes a valid public emergency requiring the immediate procurement of environmental services to perform remedial work and thereby protect the health, safety and welfare of the citizens and employees of the Citv. 3. The normally required procedures and scheduling requirements for normal advertising, receipt of bids, award of contract and processing of contracts will preclude the City from meeting the July 1999 DERM deadline. The Office of Asset Management, with the assistance of Public Works, obtained three informal bids for this project. Inc. $53,040.00 The funds for this project are allocated in the CIP Project entitled "Citywide Facilities Renovations and Restorations," Project No. 311016. The contract shall be awarded by the City Manager to the lowest responsive and responsible bidder, Alpha Engineers Corp. V� %J— 6e) The conditions above -mentioned indicate the need for quick measures to protect the health, safety and welfare of the community and the convenience of the City.
