J-99-639 7./21/99 RESOLUTION NO. 99 — 568 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, APPROVING THE COMPLETE TRAFFIC CONTROL MANAGEMENT PLAN REVISED JUNE 1999, ENTITLED "AMERICAN AIRLINES ARENA TRANSPORTATION MANAGEMENT PLAN" FOR THE AMERICAN AIRLINES ARENA PROJECT, TO BE LOCATED AT APPROXIMATELY 601 BISCAYNE BOULEVARD, MIAMI, FLORIDA, IN ACCORDANCE WITH THE PROVISIONS SET FORTH IN RESOLUTION NO. 98-89, ADOPTED JANUARY 27, 1998, WHICH GRANTED THE DEVELOPMENT ORDER FOR SAID PROJECT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Resolution No. 98-89, on January 27, 1998, approving with conditions the Major Use Special Permit for the American Airlines Arena Project; and WHEREAS, Condition Number 18 required the applicant to provide a complete "Traffic Control Management Plan" to address all issues related to traffic control measures which will 'be utilized by the applicant during major arena events, for review and approval by the City Commission prior, to the issuance of a certificate of occupancy or temporary certificate of occupancy for the project; and WHEREAS, the applicant has submitted the "American Airlines ATTACHMENT ?Y 1 �I I ICITY COMOSSION MEETING O J U h 2 7 1999 Rewlufim No. 9n- 6� Arena Transportation Management Plan" revised June 1999, for City Commission review and approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Complete Traffic Control Management Plan Revised June 1999, entitled "American Airlines Arena Transportation Management Plan," attached hereto as Exhibit "A" and by this reference made a part hereof, is hereby approved in satisfaction of Condition Number 18, as set forth in Exhibit "B" of Resolution No. 98-89, adopted January 27, 1998. The AAA is designated as a Multi -Use Major Public Facility that the City of Miami has designated as a Waterfront Retail Specialty Center. The Arena is situated on approximately 14.6 acres of land located east of Biscayne Boulevard between Port Boulevard and NE 8 Street. New roadways, the extension of NE 8 Street (HEAT Boulevard), and the extension of Bayshore Drive have been constructed in conjunction with the development of AAA. Miami -Dade County owns this facility (Owner) and Basketball Properties, Ltd. operates the facility (Operator). The facility has been designed to accommodate the following fixed seating capacities: • Basketball Mode 19,600 • Hockey Mode 15,000 • Concert - In the Round 20,200 • Concert - End stage 16,500 • Concert - Small Venue 4,000 Event types fall into the following categories: Event Type NBA Basketball WNBA Concerts Small Venue Concerts/Theater Family Shows Other (i.e., Trade Shows, Conventions) Averaee Attendance Ranize # of Events 15,000 - 19,500 +/- 46 7,500 - 10,000 +/- 14 10,000 - 20,200 +/- 20 2,500 - 4,000 +/- 20 7,500 - 10,000 +/- 20 4,000 - 12,000 +/- 10 Total No. Of Events per Year +/- 130 AmericanAirlines Arena Transportation Management Plan Page 1 99- 560 1.1 Event Traffic Type The TNT recognizes that while traffic patterns and traffic control demands differ based upon event type and start time, the primary determining factor for traffic control demands is based upon attendance size. As such, the TUT categorizes events into the following four types: Event Type Attendance Size I up to 5,000 H 5,001 to 10,000 III 10,001 to 15,000 IV over 15,000 1.2 Event Start Times It is anticipated that the majority of start times will occur on weekday evenings or on weekends outside of the Downtown Miami traffic peak periods. HEAT games, for example, are typically scheduled by the NBA (as dictated by broadcast commitments) to commence at 7:30 pm on weekdays and mid -afternoon or evenings on weekends and holidays. Weekday matinee performances will typically generate smaller audiences and will be controlled by their Event Traffic Type. Special Daytime Events, which are limited to 10 annually, will be controlled based on their Event Traffic Type and any special provisions as agreed to with the City of Miami Police. These special provisions may include additional police control of intersections, additional barricades, etc. 1.3 Guest Familiarity The TMP acknowledges that guest familiarity to the AAA will differ based on the type of event. HEAT guests, with familiarity to the existing Miami Arena, should quickly adjust to the new but similar traffic patterns. Guests to other events such as concerts, civic events, seminars, trade shows, and family events will have less familiarity with the traffic and parking patterns. The TUT will be adjusted on an as needed basis to suit the individual event needs. The adjustments will be discussed and agreed to with the City of Miami Police. AmericanAirlines Arena Transportation Management Plan Page 2 9 9 - 5560 1.4 Parking Requirements In general, parking requirements for guests and operating staff will vary based on the size and nature of the event. Based on existing Miami Arena information, David Plummer & Associates completed a parking study for the AAA that determined approximately 7,700 parking spaces will be needed for guests and 300 parking spaces will be needed for staff. The AAA will accommodate approximately 1,100 parking spaces on -site. Additional parking for the media during NBA playoffs will be addressed on an as needed basis. Please refer to section 8.0 for more.information on parking. 1.5 TMP Modifications It is anticipated by Basketball Properties, Ltd. that the Transportation Management Plan will be continually updated once the facility is open to the public. Opportunities will arise to improve upon the plan, make additional temporary street modifications, modify the number of police officers and their locations, make adjustments to the plan for simultaneous events in the downtown area, and the like. AmericanAirlines Arena Transportation Management Plan Page 3 9 9 - 56S 2.0 Development Order Requirements \The following is a summary of the Development Order requirements for the AAA. 2.1 Special Daytime Events Special Daytime Events are events which are held Monday to Friday (excluding legal holidays) which have starting times between 5:00 pm and 7:00 pm or end between 4:00 pm and 6:00 pm. The recommendations in the TMP will also apply to the Special Daytime Events Plan. The Operator is restricted from having more than ten (10) Special Daytime Events annually, which may include five Special Daytime Events which utilize the full house (80% or more of the 19,600 seat capacity [Basketball Mode]), together with five Special Daytime Events which utilize a limited house (between 60% and 80% of the 19,600 seat capacity). 2.2 Weekday Events Weekday Events are defined as any event having more than 1,000 guests which is held Monday through Friday, excluding events that are held on legal holidays. In calculating the number of Weekday Events any event which includes more than 1,000 guests but less than 8',000 guests, will be considered as one-half of an event for the purpose of calculating the permitted number of Weekday Events per year. The Operator, under the terms of the DO, is restricted to a maximum of 130 Weekday Events annually. In the event that the Operator desires to use the Arena for more than 130 Weekday Events in any year and the Applicant (i.e., Downtown Development Authority [DDA]) files a further NOPC to permit such additional Weekday Events, the Operator will provide written notification to the Director of Miami -Dade County Public Works Department (MDCPWD). The MDCPWD will have input into the Notice of Proposed Change (NOPC) approval process and will review whether additional impact fees'under the Miami -Dade County Road Impact Fee Ordinance will be assessed in connection with the requested increase. 2.3 Parking Inventory The Operator is required to submit a parking inventory (PI) as part of the TNT. The PI will identify the location of not less than 7,500.parking spaces guaranteed to be available for events at the Arena AmericanAirlines Arena Transportation Management Plan Page 4 ("Guaranteed Space"). The Operator will be permitted to submit a modification to the PI on an annual basis, which must be approved by the City Commission. The modification, which must be submitted to the Planning Department of the City, will confirm that the minimum number of Guaranteed Spaces are being provided. The Operator will have the obligation to ensure that the Guaranteed Spaces will be available for the first ten years of operation of the Arena. The Guaranteed Spaces will be located within reasonable proximity of the Arena. The on -site parking will be considered as part of the required Guaranteed Spaces. Please refer to Section 8.0 of this report for more detail on parking. 2.4 DDA Events Coordination Committee The City of Miami recognizes that there are several activity centers and traffic generators within the downtown core. These include the Performing Arts Center, Miami Arena, Bayfront Park, Bayside, etc. The Downtown Development Authority (DDA), under mandate by the City Commission, is required to establish an Events Coordination Committee in conjunction with the operators of the various venues to coordinate multiple event traffic management concerns. This TUT will be modified to address multiple events in the downtown area once the Events Coordination Committee has worked through the issues. The Operator hereby names Mr. John Gordon, Assistant General Manager of AmericanAirlines Arena, as its nominated representative of the DDA Events Coordination Committee. AmericanAirlines Arena Transportation Management Plan Page 5 • • 3.0 Transportation Management Plan Objectives The purpose of the TMP is to effectively and safely manage vehicular and pedestrian traffic movements serving the AAA and adjacent neighborhoods. The operator understands that an effective TMP will contribute to the long term success of the AAA. Therefore, the TMP will be constantly reviewed and revised in consultation with various interested parties, and in particular the City of Miami Police. The objectives of the TMP are as follows: • Provide Arena guests with a safe, positive transportation experience. • Ensure adequate traffic operations, parking availability, transit service, and pedestrian facilities for guests traveling to the Arena. • Develop an effective TMP that can be improved upon when problems arise or opportunities occur. • Ensure that the TMP will be monitored with assistance from local transportation agencies. • Fully utilize the City of Miami Police to implement the TMP. • Involve local residents and business owners to understand their concerns and solicit their input on the TMP. • Ensure that a public information program is developed that informs Arena guests of access routes to the Arena and parking facilities available. The following organizations participated in developing the TMP: • Florida Department of Transportation, District Six • Miami -Dade County Public Works • City of Miami Planning and Public Works • City of Miami Police Department • City of Miami Fire Rescue • Downtown Development Authority • Miami -Dade Transit Agency • Basketball Properties, Ltd. • Miami HEAT • David Plummer & Associates, Inc. AmericanAirlines Arena Transportation Management Plan Page 6 99- 569 Florida East Coast (FEC) railroad has been involved throughout the planning and design of the AAA. The number of trains per month crossing Biscayne Boulevard adjacent to the AAA site is minimal and occur in the early morning hours. FEC will also have a copy of this TMP for their review. AmericanAirlines Arena Transportation Management Plan Page 7 9 9 - ;,)-,611 L • 4.0 Transportation Management Plan Components The Arena is located on the east side of Biscayne Boulevard immediately north of Port Boulevard. The Arena is located in the downtown core of the City of Miami and is able to take full advantage of the existing infrastructure. The advantage is that most events will occur in the evening when the parking and roadways in the area are well under utilized. The ingress/egress plans for accessing the Arena are shown in Appendix A. Primary and secondary access strategies are shown. As this exhibit displays, freeway access is a key element. I-95, I-395, SR 836, the 1-95 Distributor Ramps, and Brickell Avenue are key components of the access plan. Police control of intersections to.improve ingress and egress is discussed in a later section. The TNT embodies the concept that "IF YOU GET TO BISCAYNE BOULEVARD YOU HAVE GONE TOO FAR." This means that most traffic will be intercepted by police control before getting to Biscayne Boulevard. Most of the ingress patterns to the AAA will be from west to east. Since there is limited parking at the AAA (1,100 spaces), most guests will be required to park to the west and southwest of Biscayne Boulevard. The following measures will be implemented to manage pedestrian and vehicular movements to and from the AAA. 4.1 Roadway Improvements The Miami HEAT has provided for traffic mitigation to the existing roadway network as part of the development of the Arena site. Some of these improvements are either capital improvements or operational improvements and are briefly described below: • Intersection Improvements at the Biscayne Boulevard/NE 8 Street intersection - as part of the Arena project, a southbound left turn lane will be added to the intersection to improve access to the Arena site. Further, this intersection will become signalized to better ensure pedestrian safety and traffic operations. • Intersection Improvements at Port Boulevard East of Biscayne Boulevard - two eastbound left turn lanes and signalization improvements will be added at this location to facilitate access to the Arena from Port Boulevard. The eastbound to northbound turn lanes will only be open during an event. During non-event periods, flexible delineator posts will AmericanAirlines Arena Transportation Management Plan Page 8 0 be put in place to close the turn lanes. BPL will be responsible for purchasing, maintaining, installing, and removing the flexible delineator posts. • Westbound Port Boulevard "Prepare to Stop" Flasher - Signage with a flasher will be installed for westbound Port Boulevard at the bridge leading from the Port of Miami. One sign with flasher will be ground mounted on the bridge and a second sign with flasher will be mounted to the pedestrian bridge connecting Bayside and the Arena. • Crosswalk Improvements - to better ensure safe pedestrian crossing of Biscayne Boulevard, improved crosswalk pavement markings will be deployed at the following intersections with Biscayne Boulevard: NE 8 Street, NE 6 Street, and NE 5 Street. The new crosswalks will be "zebra striped" crosswalks 15-foot in width (as opposed to the standard 10-foot wide zebra striping). • Future Biscayne Boulevard Improvements - The operator is working closely with the FDOT and other government officials to develop and implement the Biscayne Boulevard improvements from NE 5 Street to NE 14 Street. It is anticipated that with local support this "gateway" arterial roadway to the City of Miami can be improved within the near future. 4.2 Temporary Intersection Control - Police Assistance Temporary control of key intersections by the City of Miami Police is an essential ingredient in the success of the TMP. Police assistance will be deployed at key intersections adjacent to expressways, on key arterial roadways, and close in to the AAA. The primary objectives of police presence are as follows: • direct vehicular traffic and control turning movements • control/override intersection signals • facilitate pedestrian movements across intersections • provide general safety and security • provide crowd management • control truck traffic on westbound Port Boulevard For ease of reference, key intersections that require police assistance for ingress or egress are shown in Appendix B. These exhibits show the location of police control by intersection and the number of police officers at each intersection. Additionally, a spreadsheet has been developed to show the police assistance by event type based on pre- and post -event needs. AmericanAirlines Arena Transportation Management Plan Page 9 99- 5611 Each police officer will have specific traffic control responsibilities assigned to them by intersection. This information, in addition to other temporary traffic control devices, is also shown on the spreadsheet. Further, the City of Miami Police will develop a duty log for each intersection. See Appendix B for a sample duty log. As guests become more familiar with access to the AAA, the number of police officers necessary for each event may change. BPL will work closely with the City of Miami Police regarding the number of police officers needed and their location in the downtown area. The City of Miami Police will have the option of hand controlling the traffic signal from the control cabinet. To do this, Miami -Dade County Traffic Control Center will need to drop the traffic signal offline. 4.3 Temporary Street Modifications In order to meet the TNT objectives regarding traffic operations, temporary street modifications will be undertaken for certain event types. The purpose of the temporary street modifications is: • to expedite vehicular movements pre- and post -event • to maximize the "transportation experience" by minimizing vehicular delay • to minimize the time needed for vehicles to exit the Arena site • to minimize the time needed for vehicles to exit the vicinity of the Arena The proposed temporary street modifications are shown in Appendix C and discussed below. The pre -event time period is from 45 minutes prior to the start of an event to 15 minutes after an event has started. 4.3.1 NE 8 St. between NE 2 Ave. and Biscayne Blvd.. (Pre -Event) In order to maximize vehicular storage for entrance onto HEAT Boulevard, NE 8 Street will become one-way eastbound from NE 2 Avenue to Biscayne Boulevard during the pre -event period. Temporary signage will be used to alert motorists to the circulation change. Further, the City of Miami Police will be controlling the two intersections during this time period. 4.3.2 Eastbound 1-395 at NE 2 Ave. (Pre -Event) NE 2 Avenue at the off -ramp from eastbound I-395 will be temporarily modified during the pre - event period to allow a southbound right turn onto NE 2 Avenue from the north most lane. This will AmericanAirlines Arena Transportation Management Plan Page 10 9 9 - r6IB provide greater intersection capacity for the eastbound right turning movements. Temporary signage will be used to alert motorists to this change. Further, the City of Miami Police will be controlling this intersection during the pre -event time period. 4.3.3 NE 8 St. between NE 1 Ave. and Biscayne Blvd. (Post -Event) In order to expedite vehicular movements from HEAT Boulevard, NE 8 Street will become one-way westbound from NE 1 Avenue to Biscayne Boulevard during the post -event. Temporary signage will be used to alert motorists to the circulation change. Further, the City of Miami Police will be controlling the three intersections during this time period. 4.3.4 Biscayne Blvd. at NE 12 St. (Post -Event) To provide a more direct route to westbound I-395, northbound -to -westbound left turns will be provided from Biscayne Boulevard to NE 12 Street. Temporary cones will be placed on Biscayne Boulevard to create a northbound to westbound left turn lane at NE 12 Street. Also, temporary signage will be used to alert motorists to this change. The City of Miami Police will be controlling this intersection during the post -event period. 4.3.5 Port Blvd. at Biscayne Blvd. (Post -Event) In order to facilitate vehicular movements from the on -site parking garage, temporary street modifications are proposed on Port Boulevard at Biscayne Boulevard. Port Boulevard will be narrowed to two westbound travel lanes from east of the Arena to Biscayne Boulevard using temporary cones and signs. City of Miami Police will be controlling the access points on Port Boulevard and the Port Boulevard/Biscayne Boulevard intersections. The police officers will also be able to assist motorists leaving the Bayside parking garage. They will also have a patrol car on the Port Boulevard bridge alerting westbound motorists during post -event operations. Temporary signage and cones will be installed, removed, and stored by BPL. The City of Miami Police will assist in the placement of the temporary signs and cones. For egress from the parking garage for the preferred parkers (western most access point on Port Boulevard), these motorists will only be allowed to travel westbound on NE 6 Street. The permit parkers (eastern most access point on Port Boulevard) will be allowed to travel westbound on NE 6 Street or southbound on Biscayne Boulevard. AmericanAirlines Arena Transportation Management Plan Page 11 99- 560 Because Biscayne Boulevard will be closed for a short period to accommodate pedestrians during the post -event, northbound Biscayne Boulevard traffic approaching NE 6 Street will be channelized to westbound NE 6 Street using temporary cones and signs. This closing of Biscayne Boulevard will occur for only a very short period of time and the affected intersections will be under police control. 4.4 Pedestrian Management Pedestrian access to the Arena site is a major issue for the TMP. As mentioned previously, the crosswalks on Biscayne Boulevard at NE 5 Street, NE 6 Street, and NE 8 Street have been upgraded. Further, a traffic signal will be installed at the Biscayne Boulevard/NE 8 Street intersection. The goal of the TMP is to have pedestrians cross Biscayne Boulevard at either NE 8 Street, NE 6 Street or NE 5 Street. All of these intersections are signalized and will be under police control. A key ingredient in effectual pedestrian control will be the deployment of temporary, interlocking, "french" type pedestrian barricades. The purpose of the barricades is to safely promote pedestrian crossings at designated intersections. Additionally, these barricades provide an effective physical separation between vehicular and pedestrian movements. The erection and dismantling of these barricades will be the responsibility of the AAA. Please refer to Appendix D for the pre -,and post - event locations of these barricades. Further, pedestrians will cross Port Boulevard at Biscayne Boulevard or via the pedestrian bridge from Bayside Marketplace. Pedestrian access strategies are discussed in more detail below and are shown on exhibits in Appendix D: The key components of the pedestrian access strategies are as follows: • Police control of key intersections on Biscayne Boulevard and Port Boulevard. • Improved crosswalk pavement markings on Biscayne Boulevard. • Enhanced lighting at the key intersections adjacent to the site, as well as the pedestrian corridor from the Overtown/Arena Metrorail station. • Interlocking pedestrian barricades on Biscayne Boulevard and Port Boulevard to channelize the pedestrians to cross at the key locations. BPL will be responsible for purchasing, maintaining, installing, and removing the temporary pedestrian barricades. • Pre -event pedestrian crossing will occur with police assistance at the adjacent, signalized intersections. AmericanAirlines Arena Transportation Management Plan Page 12 • Because of the concentrated departures from an event, post -event pedestrian crossings of Biscayne Boulevard will occur with the police closing Biscayne Boulevard from NE 6 Street to NE 8 Street for a short duration. This will allow pedestrians to cross Biscayne Boulevard in a safe and efficient manner. Approval of the temporary street modifications by the appropriate agency will be obtained. Once the majority of the pedestrians cross Biscayne Boulevard, the police will re -open Biscayne Boulevard. Pedestrians will then cross Biscayne Boulevard at the signalized intersections with police assistance. • Post -event pedestrian crossings of Port Boulevard will occur via the pedestrian bridge to Bayside Marketplace or the at -grade Biscayne Boulevard crossing (with police assistance). AmericanAirlines Arena Transportation Management Plan Page 13 99- r69 • 5.0 Public Transit Based on guest surveys conducted at the existing Miami Arena for regular season Miami HEAT games, it is estimated that approximately 13% to 19% of guests arrive by transit. Because of the increased travel distance from a Metrorail station to the AAA and capacity constraints of the Metromover platforms and vehicles, it is anticipated that approximately 10% of guests will arrive to AAA via transit. AAA will work closely with MDTA to promote and encourage transit ridership. The Miami -Dade Transit Agency (MDTA) has been consulted regarding public transit. Two plans for increasing transit service are currently being studied by MDTA. 5.1 Plan 1 - Government Center Station MDTA will be evaluating using the Government Center Station as the Metrorail station to serve Arena guests. In conjunction with this station, MDTA is proposing express, double -car Metromover service from the Government Center Station to the Freedom Tower Station. Transit headways for this Metromover connection would be approximately three minutes. The 'express Metromover service from the Government Center Station will be for pre- and post -game. 5.2 Plan 2 - Overtown/Arena Station MDTA is also considering using the Overtown/Arena Station as the Metrorail station to serve Arena guests. In conjunction with this station, MDTA will provide express shuttle service to the Arena. The proposed shuttle loop is shown in Appendix E. Guests will be dropped-off/picked-up at the intersection of NE 8 Street/NE 2 Avenue. Using this Metrorail station allows for more direct pedestrian access to the Arena via NW/NE 8 Street for those guests who do not desire to ride the shuttle. MDTA is committed to providing the best possible transit access to the Arena. Increased security at the Metrorail and Metromover stations are also part of this plan. Other issues being considered include: • Improve/add bus routes to serve the Arena • Update transit brochures, schedules, and maps to identify the Arena site • Publish transit information in the HEAT program guide AmericanAirlines Arena Transportation Management Plan Page 14 99- 566 • • Display transit information at the Arena information booth and ticket windows • Add transit information/links to the AAA and HEAT's web site • " Providing additional security at Metrorail and Metromover stations during events Shuttle service, provided by DDA, was considered for this TMP. However, DDA will not be able to employ their shuttle system until 2003. AmericanAirlines Arena Transportation Management Plan Page 15 6.0 Other Transportation Management Plan Components The TMP considers additional aspects of the TMP in the following sections. 6.1 Passenger Drop-off/Pick-up Passenger drop-off/pick-up has been studied extensively for this TMP. The goal was to choose a location where drop-off/pick-up can occur in approximately the same area. As shown in an exhibit in Appendix F, the passenger drop-off/pick-up areas are on the east side and west side of Biscayne Boulevard between NE 8 Street and NE 10 Street. Approval of the temporary street modifications by the appropriate agency will be obtained. The drop-off/pick-up areas will be used by the motoring public, limos, taxis, and shuttles. Temporary cones and signs will be used pre- and post -event to delineate these lanes for passenger drop-off/pick-up. These locations will be monitored for their effectiveness. BPL will be responsible for purchasing, maintaining, installing, and removing the temporary signs and cones. 6.2 Disabled Passenger Drop-off/Pick-up Disabled passengers will be able to use the east extension of NE 8 Street to load and unload on -site. There will be two disabled drop-off/pick-up locations on NE 8 Street. Further, for inclement weather, disabled passenger drop-off/pick-up will be in the on -site parking garage via HEAT Boulevard. See the exhibit in Appendix F. 6.3 Bus/Taxi/Limo Staging In order to accommodate the parking needs of charter buses, limos, and taxis, a staging area will be set up on NE 7 Street from Biscayne Boulevard to NE 1 Avenue (see the exhibit in Appendix G). It is anticipated that charter buses will also drop-off/pick-up their passengers in this location. This will minimize confusion for the passenger. Temporary signage and cones will be used to designate these locations. It is anticipated that the north side of NE 7 Street will be used to park these vehicles during an event. Access to parking areas on these two blocks of NE 7 Street will remain unimpeded. Police will help control and monitor the staging area. These vehicles will face westbound so that they will not use Biscayne Boulevard during the post -event period. AmericanAirlines Arena Transportation Management Plan Page 16 99- 56v 0 6.4 Fire -Rescue Access and Circulation City of Miami Fire -Rescue has been consulted on their needs for access and circulation through the site. The station on NE 5 Street will be the primary location from which Fire -Rescue will respond to emergencies at the Arena. As shown on the exhibit in Appendix H, the fire -rescue route will be eastbound on NE 5 Street to northbound on Biscayne Boulevard to eastbound on HEAT Boulevard. From there, Fire -Rescue will circulate around the site and exit the site on Port Boulevard. The Command Center will be located on the south side of the Arena in the loading dock area. This area will be staffed with AAA personnel and will have radio contact with the City of Miami Police during an event. 6.5 Bicycle Facilities The TUT promotes multi -modal access to the Arena. The Miami -Dade Bicycle Facilities Plan encourages adding bicycle racks at major trip generators. Therefore, the Arena will provide bicycle racks on site to accommodate these users. Access to the site for bicyclists will coincide with the existing Miami -Dade County bicycle network, as well as the linkages to transit. 6.6 Traffic Signal Timing Special traffic signal timing plans need to be developed for events at the AAA. BPLs traffic consultant will work with the Traffic Signal Operation Engineers at the Miami -Dade County Traffic Control Center to develop these plans. The purpose is to develop signal timing plans that maximize traffic flow into and out of the AAA during events. AmericanAirlines Arena Transportation Management Plan Page 17 7.0 Signage Static guide signs will be installed at essential locations to assist the motoring public. The guide signs have been classified into four types: • Expressway Directional Signs • Surface Street Directional Signs • Arena On -Site ParkingNalet Directional Signs • Off -Site Parking Directional Signs Approvals from the appropriate agencies will be needed prior to installation of the signs. All signs will conform to the Manual on Uniform Traffic Control Devices (MUTCD). 7.1 Expressway Directional Signs Discussions with the Florida Department of Transportation (FDOT) have been ongoing regarding directional signs on the expressway system. It is anticipated that a directional sign (i.e., AmericanAirlines Arena 2 Miles) approximately two miles from the appropriate exit ramps will be placed on the following expressways: • Northbound I-95 • Southbound I-95 • Eastbound SR 836 • Westbound I-395/MacArthur Causeway Directional signs at the appropriate off -ramps from the expressway system will also be needed at the following locations: • For motorists traveling northbound on I-95, an Arena directional sign at the NW 2 Street exit will be needed. • For motorists traveling southbound on I-95, an Arena directional sign at the NW 8 Street exit will be needed. • For motorists traveling eastbound on SR 836, an Arena directional sign at the NE 2 Avenue exit will be needed. • For motorists traveling westbound on I-395, an Arena directional sign at the Biscayne Boulevard exit will be needed. AmericanAirlines Arena Transportation Management Plan Page 18 9 9 - '� 7.2 Surface Street Directional Signs Surface street directional signs will be installed at key locations to guide the motorist to the Arena. Coordination with the appropriate agencies will be needed in regards to sign panel design, sign pole type, sign placement, etc. The location of the surface street signs are shown in Appendix I. The existing surface street signs will be available to direct motorists to the expressway system. 7.3 Arena On -Site Parking/Valet Directional Signs It is anticipated that a single sign panel will be designed that has two messages: "Arena Permit Parking Only" and "Arena Valet". These signs will be placed at the necessary locations to guide the motorist to either of the on -site parking entrances (at NE 8 Street or Port Boulevard) and the valet drop-off location on HEAT Boulevard (extended NE 8 Street). Coordination with the appropriate agencies will be needed in regards to sign panel design, sign pole type, sign placement, etc. The location of the surface street signs are shown in Appendix I. 7.4 Off -Site Parking Directional Signs Because a majority of the parking for events will occur off -site, a sign panel will be designed to guide motorists to the public/private parking locations within the vicinity of the Arena. Coordination with the appropriate agencies will be needed in regards to sign panel design, sign pole type, sign placement, etc. The location of the surface street signs are shown in Appendix I. AmericanAirlines Arena Transportation Management Plan Page 19 8.0 Parking Guests of the AAA will be able to park either on -site (permit only) or off -site. Provisions have been made on -site for valet parking and disabled parking. The parking issues are discussed in more detail below. 8.1 Parking Obligations The Operator is required to submit a parking inventory (PI) as part of the TMP. The PI will identify the location of not less than 7,500 parking spaces guaranteed to be available for events at the Arena ("Guaranteed Space"). The Operator will be permitted to submit a modification to the PI on an annual basis, which must be approved by the City Commission. The modification, which must be submitted to the Planning Department of the City, will confirm that the minimum number of Guaranteed Spaces are being provided. The Operator will have the obligation to ensure that the Guaranteed Spaces will be available for the first ten years of operation of the Arena. The Guaranteed Spaces will be located within reasonable proximity of the Arena. The on -site parking will be considered as part of the required Guaranteed Spaces. A guaranteed locator map will also be provided. 8.2 On -Site Parking The Parking Garage System is defined as all on -site parking at the AAA. Upon opening, this will include the Lower Level Garage with approximately 926 spaces, the Upper Level Garage with approximately 157 spaces, inclusive of all on -site valet parking. Within 12 months of opening, it is anticipated that the Lower Level Garage will be extended to include an additional 266 parking spaces in the Garage Annex to the east of the AAA. The Lower Level Garage and Garage Annex are located at elevation 4-feet, underneath the entire site with access from the south side of the AAA. The Upper Level Garage is located on the east end of the Arena, with separate access from HEAT Boulevard. Ingress and egress to the on -site parking will be via NE 8 Street or Port Boulevard. For all Arena events, the traffic pattern around the Arena will be modified to optimize access and traffic flows. Two eastbound left turn lanes on Port Boulevard just east of Biscayne Boulevard will be open during AmericanAirlines Arena Transportation Management Plan Page 20 0 event periods only. In addition, a dedicated southbound turn lane at Biscayne and NE 8 Street will be the main access point into the on -site garage area. Valet pick-up and drop-off for events will occur at the VIP entrance, on the north side of the Arena on NE 8 Street (see Appendix F). Vehicles will be parked either in the Upper Arena Garage, or across the street at a surface lot. The average number of cars expected to be valet parked for an event at the AAA is approximately 75. As a county -owned facility, the AAA meets all county requirements for disabled accessibility. Disabled drop-off will occur on NE 8 Street at Gate #3 located on the northwest corner of the AAA providing direct elevator access to all levels of the building. During periods of inclement weather, disabled drop-off will be relocated to the upper arena garage. Vehicles dropping off disabled guests will enter the upper arena garage, release the passengers, and circle back out the garage through a defined, high -mast accessible route through one lane of parking. Guests parking on -site will be provided with a windshield decal/parking pass. In order to access the site to park, the police officers will verify that the guest has a parking pass. 8.3 Off -Site Parking In a previous study conducted by David Plummer and Associates, Inc., it was estimated that the parking demand for a Miami HEAT game, after discounting for transit, shuttle/limo, and walking arrivals, is 7,700 guest spaces. There is also a demand for 300 additional spaces for event and retail employees. The Arena will house 1,100 of the total 7,700 HEAT game parkers. The other 6,600 vehicles will park off -site. The Arena inventoried public parking within 10 and 15 minute walking distances from their site that would be considered for the 6,600 game parkers. The inventory did not include the public owned spaces at Bayside Garage or any other hotel or retail parking in area because it is highly likely that these would be filled by other demands during the game hours. This parking garage is located on the west side of NE 2 Avenue between NE 5 Street and NE 6 Street. This parking garage would be made available to guests on game nights. This would increase the parking supply within a 10 minute walk of this site to 10,500 spaces. See Appendix J for the off -site parking space inventories. There is also a commitment for 2,000 parking spaces provided by Miami -Dade County to support the Arena. There will be a shuttle connecting that parking to the Arena. The location of these facilities has not yet been identified but it is expected to be either west, such as the Government Center or at the Port of Miami. The value of that parking to Arena guests, due to the distance and travel times, is questionable. It may be more useful for employees rather than basketball guests. 8.4 Parking Inventory As discussed in section 2.3 of the TMP AAA is required to identify a minimum of 7,500 "Guaranteed" parking spaces, the parking inventory (PI), in general the PI will be comprised of the following broad classifications; • On -site parking 1,100 spaces (approximate) • County provided spaces 2,000 spaces • Off-street spaces 4,600 spaces (Note: As part of the ongoing offsite parking commitments AAA has entered into a contractual arrangement with MDCC to provide daily parking for 200 employees and make available 1,100 spaces for event days. This contract commences in April 2000 upon completion of the MDCC parking garage.) AmericanAirlines Arena Transportation Management Plan Page 22 99- 56� 8.4.1 On -site Parking AAA has entered into a contract with Central Parking Systems of Florida Inc. to act as the AAA parking operator- who will be responsible for management of the AAA parking facilities including event, public, and valet parking. In addition to onsite responsibilities, the parking operator will also be responsible for managing off -site parking operations directly controlled by AAA or provided for as "Guaranteed" parking spaces. 8.4.2 County Provided Spaces As at the writing of the TMP, AAA has put the County on notice that they are required to identify their 2,000 parking space obligations, with required shuttle service as required by the Development Agreement. It is anticipated that these spaces will be located either at the Port of Miami or located in and around Government Center. The County is expected to respond to our notice and identify their parking spaces by July 15, 1999. 8.4.3 Off-street Spaces As part of the Parking Operator RFP process, AAA identified the following key off-street parking highlights and are in the process selecting the preferred options for satisfying the "Guaranteed" Parking requirement. The TNT will be updated in the future to reflect the finalization of the parking inventory. Key Highlights: • AAA identified approximately 21,665 parking spaces within the downtown core operated by seven parking operators. Each of these are being evaluated to determine whether these fall into a "reasonable" walking distance. • Each operator offered, as part of their submission to the Parking RFP, operating their respective parking lots based on demand and specific requirements of an event. • The selected AAA parking operator, Central Parking System (CPS) of Florida Inc. has under its control, and is committed to operate, a total 6,282 parking spaces. AAA and CPS are presently reviewing this inventory to determine the appropriateness of same relative to the "Guaranteed" parking obligation. • The balance of the parking operators have indicated a willingness to operate their inventories AmericanAirlines Arena Transportation Management Plan Page 23 • for AAA events. • AAA has under its direct control approximately 850 off -site spaces. • AAA has negotiated an amendment to the Development Agreement with the County which provides for the construction of the Garage Annex on Parcel B immediately east of the arena. .This will add approximately 266 spaces to the parking inventory, commencing at the start of the 2000 NBA season. AmericanAirlines Arena Transportation Management Plan Page 24 99- 569 0 9.0 Public Information Program The Public Information Program has been developed to accomplish the following objectives: • inform guests of the Arena's location ® familiarize Arena guests with access routes to the Arena • identify off -site parking locations for Arena guests • inform Arena guests of public transportation alternatives • notify the general public of upcoming Arena events • solicit input for improving the TNT from residents and business owners • maintain an ongoing dialogue with the residents and business owners An outstanding public information program will enhance the guests transportation experience. This section describes the type of information to be disseminated to the public, the sources to be used, and the framework for community involvement. 9.1 Data The following types of information will be conveyed to the general public: • Upcoming Arena events • Ingress/Egress routes to the Arena • Parking locations and fees • Metrorail/Metromover service • MDTA bus rotes and service • Entertainment/Office shuttles • Valet location • Handicap parking • Passenger drop-off/pick-up locations • Pedestrian access 9.2 Information Sources A comprehensive program is being developed to provide the information - described in the previous section - to the general public. The Public Information Program will be continuously improved as needed. 9.3 Community Involvement Miami -Dade County and Basketball Properties, Ltd. are committed to providing excellent vehicular access and parking to the Arena. With the Downtown Development Authority (DDA) as the lead agency, a comprehensive community involvement program is being developed. The Community Involvement Program will include individual members of the public, Downtown residents, and Downtown business owners. It is anticipated that the Community Involvement Program will allow for public participation in regards to the development of the TNT. Community meetings will be held to brief interested community members of the Arena project, and specifically the TNT. It is also anticipated that the Community Involvement Program will continue on a periodic basis after the Arena is open to foster a forum for addressing future community concerns. DDA is in the process of contacting and setting up community involvement meetings to present information about the Arena and the TUT. BACKGROUND City Commission Resolution 98-89, adopted January 27, 1998, granted a Development Order for the American Airlines Arena, subject to certain conditions which were enumerated in the Order. One of the conditions, No. 18, requires preparation of a Traffic Control Management Plan, and reads as follows: 18. Pursuant to the traffic study which was submitted by the applicant as part of this approval, a complete "Traffic Control Management Plan" shall be produced and submitted to the City of Miami for review and approval by the City Commission prior to the issuance of a Certificate of Occupancy (CO) or a Temporary Certificate of Occupancy (TCO) for this project; said plan shall address all issues related to traffic control measures which will be utilized by the applicant during all major arena events. The "American Airlines Arena Transportation Management Plan" meets all requirements of the above condition. It was prepared by a working group consisting of the City of Miami Departments of Police, Fire Rescue, Public Works, and Planning; the Miami -Dade County Department of Public Works, the County's Transit Agency; the Florida Department of Transportation; the Downtown Development Authority; and the Miami Heat and Basketball Properties, Ltd., and it has been reviewed and endorsed by all of these agencies. The working group, together with its Consultants, David Plummer & Associates, Inc., has produced a plan that is comprehensive and detailed, and is therefore recommended for City Commission approval. DHW:DB:AGS:CPT:ct 99- 568 SUMMARY OF SIGNIFICANT CONCLUSIONS AMERICAN AIRLINES ARENA TRANSPORTATION MANAGEMENT PLAN City Commission City of Miami July 27,1999 The American Airlines Arena Transportation Management Plan (TMP) as submitted July 6, 1999, with a parking addendum which followed on July 13, 1999, fulfills the requirements of Condition No. 18 of the Development Order for the Arena approved by the City Commission by Resolution 98-99, adopted January 27, 1999. The TMP was prepared by a working group consisting of the City of Miami Departments of Police, Fire Rescue, Public Works, and Planning; the Miami -Dade County Department of Public Works, the County's Transit Agency; the Florida Department of Transportation; the Downtown Development Authority; and the Miami Heat and Basketball Properties, Ltd.; together with David Plummer & Associates, Inc., consultants for the plan. The TMP consists of the following major components: Roadway Improvements: These include designation of turn lanes and improved pedestrian crosswalk identification and traffic control devices at various intersections serving Arena traffic. Some of these improvements will operate only during Arena events; others will be permanent. • Temporary Intersection Control: City of Miami Police will be deployed during Arena events to direct traffic, control turning movements, control/override intersection signals, facilitate pedestrian movements, provide safety, security, and crowd management, and control truck traffic on the Port Boulevard. The level of police deployment will be keyed to the size of Arena crowd. • Temporary Street Modifications: Various modifications of one-way directionality, permitted turn movements, and channelization will be scaled to the size of Arena crowds and implemented on a temporary basis to expedite traffic during the pre -and post event time. Pedestrian Management: Most Arena patrons will cross Biscayne Boulevard going to and departing from events; they will be directed to crosswalks at NE 8, NE 6, and NE 5 Streets, which will be improved and controlled to provide safe and convenient pedestrian movements. Police control, enhanced lighting, and interlocking barricades are among the devices and techniques that will be utilized. • Public Transit: The Miami -Dade County Transit Agency (MDTA) is evaluating plans to provide express shuttle bus service connecting Metrorail and the Arena, 99- NCR together with express, double -car Metromover trains to serve Arena patrons. In addition, MDTA is considering improvement/s additions to bus routes serving the Arena, updating and expansion of public information, and additional security at Metrorail and Metromover stations. Other Transportation Management Measures: A variety of additional measures will be implemented to facilitate traffic and pedestrian access to and from the Arena, including the designation of sites for passenger drop-off/pickup, special provisions for disabled passengers; bus/taxi/limo staging areas and parking; provisions for fire - rescue access and circulation; and bicycle facilities. Special traffic signal timing plans will be developed for implementation by the Miami -Dade County Traffic Control Center to optimize traffic flow before and after Arena events. Signage: Improved signage will be provided to assist motorists. This will include expressway directional signs, surface street signs, Arena on -site parking/valet signs, and signs directing motorists to off -site parking facilities. Parking: The TMP identifies a total of 8,682 parking spaces within a 15-minute walk of the Arena, in facilities committed in writing by their operators to be available for Arena events. (This satisfies the Development Order requirement of a minimum of 7,500 spaces.) In addition, some 3,001 additional inventory will be available between December, 1999 and January, 2001, as follows: 1,635 existing surface parking spaces in Park West within 10 minutes walking time, that are available but not "guaranteed"; 1,100 spaces at the MDCC parking garage, available in April, 2000 and under lease for Arena events; and 266 spaces in the Arena Garage Annex, which is expected to be completed by January, 2001. Finally, Miami -Dade County is contractually obligated under the Development Agreement to provide 2,000 spaces, but has not yet designated them. We believe that the attached document satisfies Condition 34 of the Development Order (DO) requiring that the Operator [BPL] identify the location of not less than 7,500 parking spaces guaranteed to be available for parking of events at the Arena, i.e. "Guaranteed Spaces". We would respectfully request the City's review of this information and if acceptable forward same to the City Commission for inclusion into the TMP being considered on the Commission agenda on July 27, 1999 Key Points We would bring your attention to the following important points; As you will see in the attached documents AAA has received signed commitments that a total of 8,682 parking spaces will be provided within a reasonable proximity of the Arena, [i.e. less than a 15-minute walk]. The parking spaces fall into three categories; Onsite or within 1 block 1,439 spaces Within a 10 minute walk 4,087 spaces Between a 10 — 15 minute walk 3,522 spaces TOTAL 8,682 spaces [See Spaces Excluded below] As part of the process to select a manager for the Arena parking garage, we asked eight parking operators to identify the inventory they control in the vicinity of the Arena and to commit to open these facilities for parking for Arena events. Each operator signed the following commitment letter (please see attached letters): In recognition of BPL's requirement to the City of Miami to identify 7,500 parking spaces in the vicinity of the AmericanAirlines Arena that are guaranteed to be available for events, we will ® cooperate with BPL to deliver on its pledge to provide these parking spaces. Of these 21,820 spaces, AAA has identified and received confirmation for 8,682 spaces within a 15-minute walk that qualify for Arena event parking and form part of the PI. * * Parking Company of America and QuikPark have not re -confirmed their initial pledge as of this date. Spaces Excluded The above stated number does not include the following additional spaces that are or will be available as follows; 1,635 identified surface parking spaces located in Park West that represent available but not "Guaranteed" within a 10 minute walk of the arena. We fully expect the operators of these lots to be open for business during events at the arena. Based on our conversations with parking operators in the area, we understand that the completion of the Arena and the development of the Performing Arts Center has sparked a flurry of activity in the parking market to develop new or recondition existing surface parking lots in the neighborhood. We estimate that 500-700 spaces will be added to the Park West inventory above what we have currently identified, based on conservative assumptions and our knowledge of the development in the area. • 1,100 parking spaces @ MDCC parking garage. The Miami Dade Community College parking garage is scheduled to be completed in April 2000. BPL and MDCC have executed a lease agreement to utilize 200 parking spaces in the garage on a permanent basis [full-time staff parking] and 1,100 spaces for Arena events. We will be pleased to provide the City with the pertinent sections of this lease agreement at the time that we wish to include these spaces in the PI. • 266 spaces in the Arena Garage Annex. It is expected that the Garage Annex parking will be completed by December 2000 and we will provide the City with appropriate documentation at that time thereby adding this inventory to the PI . • 1,450 spaces available at Bayside Marketplace, comprised of 1,200 space garage and 250 space valet parking. • 2,000 spaces to be provided by the County. As set out in section 2.6.9 of the Development Agreement the County is contractually obligated to provide "not less than 2,000 parking spaces at either the Port in well -lit and patrolled parking lots or in other parking garages, lots or structures owned or controlled by the county and located within one mile of the Arena, as the county may designate, all of which are to be provided on an "as -needed" basis and frequent, on an "as -needed" basis, shuttle service for patrons of the 2,000 spaces to and from the Arena..." The County has not yet designated the location of these spaces and as such BPL has not included them in the PI. We will provide you with the required documentation at such time as the County so locates these spaces and BPL wishes to include them in the PI. 99- 568 Parking Inventory Maintenance Anmial In accordance with Condition 34 of the DO, BPL as Operator of the Arena hereby agrees to ensure that the Guaranteed Spaces PI will be available each and every year during the first ten (10) years of the operation of the Arena. The PI will be reviewed and modified annually as required, subject to the approval of the City Commission. Event by Event The number of parking spaces required for an Arena event will obviously depend on the event type and the actual attendance. For example, capacity in the AmericanAirlines Arena for a basketball game is nearly 20,000 but projected average attendance is approximately 15,000. By way of comparison, average attendance at HEAT games last year was approximately 13,500 (with a capacity of 15,200 at the Miami Arena). Furthermore, HEAT games represent less than one-third of the total number of projected events at the Arena. Events will range from sold -out theater crowds of 4,500 to half -house center stage concerts with 10,000 patrons to sold -out HEAT games. As a result, it is not feasible to require the parking operators to open their facilities for every single Arena event [i.e. farthest reaching lots]. Free market dynamics will establish efficiency in the market so that parking supply will match parking demand, depending on the fluctuation of that demand. AAA and Central Parking, our onsite parking operator, will deliver monthly reports to the parking operators to inform them of upcoming events, number of tickets sold, and projected number of cars. With this information, the parking operators will be able to determine the demand for parking at their specific facilities. In closing BPL has, we believe, complied with the specific condition as set out in the DO and hereby requests the City's review and approval of this document in conjunction with the TMP already in your possession and forwarding same to the City Commission for approval . Section 5. The findings of fact set forth below are hereby made with respect to the subject PROJECT: a. The PROJECT is in conformity with the adopted Miami Comprehensive Neighborhood Plan 1989-2000, as amended. b. The PROJECT is in accord with the PR Zoning classifications of Zoning Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. 99- 568 - 3 - C. Pursuant to Section 1305 of the Zoning Ordinance of the City of Miami, Florida, the specific site plan aspects of the PROJECT, i.e., ingress and egress, parking, signs and lighting, utilities, drainage, preservation of natural features and control of potentially adverse effects generally, have been considered and will be further considered administratively during the process of issuing a building permit and a certificate of occupancy. d. The PROJECT is expected to cost approximately $176 million, and to employ approximately 2,500 workers (900 of which would come from the City of Miami) during construction (FTE), and approximately 1,200 recurring jobs within the City of Miami. The PROJECT will generate approximately $87 million annually in direct spending related to the Miami Heat (this includes tickets, concessions, hotels, restaurants and other establishments; 1997 dollars). e. The City Commission further finds that: (1) the PROJECT will have a favorable impact on the economy of the City; (2) the PROJECT will efficiently use public transportation facilities; (3) any potentially adverse effects of the PROJECT will be mitigated through compliance with the conditions of this Major Use Special Permit; 99- 568 - 4 - (4) the PROJECT will efficiently use necessary public facilities; (5) the PROJECT will not negatively impact the environment and natural resources of. the City; (6) the PROJECT will not adversely. affect living conditions in the neighborhood; (7) the PROJECT will not adversely affect public safety; (8) based on the record presented and evidence presented, the public welfare will be served by the PROJECT; and (9) any potentially adverse effects of the PROJECT arising from safety and security, fire protection and life safety, solid waste, heritage conservation, trees, shoreline development, minority participation and employment, and minority contractor/ subcontractor participation will be mitigated through compliance with the conditions of this Major .Use Special Permit. Section 6. The Major Use Special Permit, as approved and amended, shall be binding upon the applicants and any successors in interest. Section 7. The application for Major Use Special Permit, which was submitted on November 5, 1997, and on file with the Department of Planning and Development of the City Of Miami, - 5 - 99- 568 Florida, shall be relied upon generally for administrative interpretations and is made a part hereof by reference. The PROJECT is located on approximately 21.39 gross acres and 15.13 net acres of land (more specifically described in "Exhibit All, incorporated herein by reference). The reruainder of the PROJECT's VITAL DATA is attached hereto as "EXHIBIT C", and incorporated herein by reference. The proposed PROJECT will consist of 24,000 attraction seats, 37,500 square feet of office space, 40,000 square feet of accessory commercial space and 1,147 parking spaces. The PROJECT will consist of a 1,415,921 gross square foot multi -use center which has been designed as a Waterfront Specialty Center. The Arena is to be a state-of-the-art, multi- use major public facility designed and constructed in conformity with current National Basketball Association ('INBAII) standards and the current standards of the International Hockey League ("IHL") and the American Hockey League ("AHL") and shall include, without limitation, marshaling/loading areas, planned, designed and constructed to support the occupancy of professional basketball and professional hockey franchises and to host other events such as family shows, concerts, live theater, etc.. The Arena component shall be a building containing a minimum of 99- 568 B-2 680,000 square feet of space with at least three concourses, as well as mechanical and service levels and shall include appropriate amenities, such as clubs, restaurants and shops. The ownership, operation and maintenance of common areas and facilities will be by the property owner or a mandatory property owner association in perpetuity pursuant to a recorded Declaration of Covenants and Restrictions. The Major Use Special Permit Application for the American Airlines Arena Project also includes a request to modify the provisions of City Charter Section 3(mm)(ii) in order .to modify the aggregate yard area providing open views to the bay from twenty five percent (25%)(158.38 ft.) required to thirteen and eight tenths percent (13.8%) (87.72 ft.) provided. The Major Use Special Permit Application for the American Airlines Arena Project has a companion application for Special Exceptions to allow the following: Special Exception with City Commission approval, per Article 4, Section 401, to allow restaurant/retail uses in the PR Zoning District; Special Exception, with City Commission approval, per Article 9, Section 918, to allow up to twenty five percent (25%) of required parking to be located offsite; applicant proposes to locate seventeen percent (17%) offsite). The Major Use Special Permit Application for the American Airlines Arena Project also encompasses the following lower ranking Special Permits: B_3 99- 568 • • CLASS I SPECIAL PERMIT per Article 4, Section 401, for signage in a PR Zoning District; CLASS I SPECIAL PERMIT per Article 9, Section 917.1.2, for Valet Service; CLASS II SPECIAL PERMIT as per Article 15, Section 1511, for new construction Biscayne Boulevard and Biscayne Bay;. CLASS II SPECIAL PERMIT to waive the requirements of the Dade County Landscape Ordinance; Pursuant to Articles 13 and 17 of Zoning Ordinance No. 11000, approval of the requested Major Use Special Permit shall be considered sufficient for the subordinate permits and referenced above. . The Project shall be constructed substantially in accordance with plans and design schematics on file prepared by Arquitectonica, dated November 1997; the landscape plan shall be implemented substantially in accordance with plans and design schematics on file prepared by Curtis & Rogers Design Studios, Inc., dated November 1997; said design and landscape plans may be permitted to be modified only to the extent necessary to comply with the conditions for approval imposed herein; all modifications shall be subject to the review and approval of the Director of the Department of Planning and Development prior to the issuance of any building permits. The PROJECT conforms to the requirements of the PR Zoning Districts, as contained in Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. B-4 99- 568 The existing comprehensive plan future land use designation -' allows the proposed mix and intensity of attraction and commercial uses. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE APPLICANT, ITS SUCCESSORS, AND/OR ASSIGNS, JOINTLY OR SEVERALLY, SHALL DO THE FOLLOWING: 1. Meet all applicable building codes, land development regulations, ordinances and other laws. 2. Provide a list of agencies from which approvals and/or permits must be obtained prior to initiation of development and the permit or approval required of each. 3. Allow the Miami Police Department to conduct a security survey, at the option of the Department, and to make recommendations concerning security measures and systems; further submit a report to the Planning Department, prior to commencement of construction, demonstrating how the Police Department recommendations, if any, have been incorporated into the PROJECT security and construction plans, or demonstrate to the Planning Director why such recommendations are impractical. 4. Provide a letter -from the Department of Fire -Rescue indicating APPLICANT'S coordination with members of the Fire Plan Review Section at the Department of Fire -Rescue for the review of the scope of the PROJECT, owner responsibility, building development process and review procedures, as well as specific requirements for fire protection and life safety systems, egress, vehicular access and water supply. 5. Provide a letter of assurance from the Solid Waste Department that the. PROJECT has addressed all concerns of the said Department. Record a certified copy of the development order with the Clerk of the Dade County Circuit Court specifying that the Development Order runs with the land and is binding on the Applicant, its successors, and assigns, jointly or severally. Provide the City with an executed, recordable unity of title or covenant in -lieu of unity of title agreement for the subject property; said agreement shall be subject to the review and approval of the City Attorney's Office. �YY1 Provide. the Public Works Department of the City of Miami with plans for proposed sidewalk and swale area improvements for their review and approval prior to the issuance of a,'or�%, building permit. Address the concerns of the Urban Development Review Board regarding the plaza area along Biscayne Boulevard, the perimeter areas and linkage issues; any plan modifications shall be subject to review and approval by the Director of the Department of Planning and Development prior to the issuance of a building permit. 14. With the exception of the signs specifically included in they application for development approval (Section 8 of the Application book on file with the Department of Planning and Development), all other sign proposals shall be subject to a separate review and approval by the Director of the Department of Planning and Development (note: said review and approval does not require a separate Class LI Special Permit) . 15. Pursuant to the comments received by the Zoning Division, the applicant shall submit a survey and site plan for offsite parking spaces showing location and design of the �i parking lot(s); said lot(s) shall meet distance requirements as specified in Zoning Ordinance No. 11000. 16. Pursuant to the comments received by the Zoning Division, all driving lanes to be located on parcel "B" shall have a Voe V minimum width of ten feet (10'-0") and must comply with FDOT turn radius standards. 17 The proposed project shall be subject to the review and approval (with conditions, if applicable) of the Miami -Dade County Shoreline Development Review Committee. 18. Pursuant to the traffic study which was submitted by the applicant as part of this approval, a complete "Traffic Control Management Plan" shall be produced and submitted to the City of Miami for review and approval by the City Commission prior to the issuance of a Certificate of Occupancy (CO) or a Temporary Certificate of Occupancy (TCO) for this project; said plan shall address all issues related to traffic control measures which will be utilized by the applicant during major arena events. 99- 568 B-7 19. Pursuant _to concerns raised by the Downtown Development Authority regarding linkage issues to and from the proposed arena to the remainder of Downtown Miami (across Biscayne Boulevard), the applicant shall address the following issues throughout the permitting and construction period: a. Identification of approximately 4600 off -site parking spaces within a 10 minute walking radius of the project. b. Identification of approximately 2000 off -site parking spaces within a 5 to 10 minute shuttle bus connection to the project c. Identification of the principal transit station connections within a 10 minute walking radius to the project. d. Identification of on-site/site perimeter Metrobus, charter bus and shuttle bus loading locations and circulation patterns serving the project. e. Identification of downtown area primary pedestrian pathways interconnecting parking,. transit and core area employee/resident concentrations with the project. f. Identification of primary routes for shuttle and bus connections between remote parking, transit and area employee/neighborhood centers. g. Identification of environmental design and enhancement measures that address improvements to pedestrian pathways including lighting, security, aesthetic enhancements, crosswalks (with particular emphasis on Biscayne Boulevard), pedestrian signalization and signage. h. Identification of financial and operational responsibility, for shuttle bus operations linking the project to public transit and parking facilities. B-8 99- 568 i. Design and operational impact issues of a pedestrian bridge connection from the arena project to Bayside and Bayfront Park. j. Design and operational impact issues of surface road improvements to south side of Port Boulevard adjacent to Bayside project. k. Design and linkage issues of connecting a public baywalk along the bulkhead line of the FEC tract to existing and proposed baywalks to the public park lands to the south and north of the project. 1. Identification of "pathfinder" signage design and locations for pedestrian and vehicular traffic accessing the project through adjacent. downtown areas including the Flagler. Street core, Biscayne Boulevard, S.E. Overtown/Park West and Omni/Cultural Center districts. m. Identification of amount and location of employee parking accommodations. 20 Execute a "First Source Hiring Agreement" with the City that ensures that first preference for employment shall be given to neighborhood residents, and second preference to City residents; the agreement shall include a provision for construction activity jobs as well as permanent employment positions. 21. The American Airlines Arena Project, proposed by the applicant, Basketball Properties, Ltd., ("Applicant"), complies with the Miami Comprehensive Neighborhood Plan 1989-2000, is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations, and further, pursuant to Section 1703 of Zoning Ordinance No. 11000: (1) the PROJECT will have a favorable impact on the economy of the City; and (2) the PROJECT will efficiently use public transportation facilities; and B-10 99- 568 (3) the PROJECT will favorably affect the need for people to find adequate housing reasonably accessible to their places of employment; and (4) the PROJECT will efficiently use necessary public facilities; and (5) the PROJECT will not negatively impact the environment and natural resources of the City; and (6) the PROJECT will not adversely affect public safety; and (7) the public welfare will be served by the PROJECT; and (8) any potentially adverse effects of the PROJECT will be mitigated through conditions of this Major Use Special Permit. The proposed development does not unreasonably interfere with the achievement of the objectives of the adopted State Land Development Plan applicable to the City of Miami.
