HomeMy WebLinkAboutR-99-0567J-99-626 7/27/99 RESOLUTION NO. b b - A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING THE RECOMMENDATION OF THE DIRECTOR OF THE PLANNING DEPARTMENT FOR ISSUANCE OF CLASS II SPECIAL PERMIT APPLICATION NO. 99-0074, WITH THE CONDITION THAT NO WRITING IS PERMITTED WITH THE MURAL AND OTHER CONDITIONS RECOMMENDED BY THE DEPARTMENT, FOR THE PROPERTY LOCATED AT APPROXIMATELY 219 EAST FLAGLER STREET, MIAMI, FLORIDA, PURSUANT TO SECTION 401 OF ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED. WHEREAS, the Director of the Department of Planning is recommending approval of Class II Special Permit Application No. 99-0074, with conditions, for the property located at approximately 219 East Flagler Street, Miami, Florida; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Class II Special Permit as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, finds the application for Class II Special Permit does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its JUL 2 7 1999 Resolution No. 99- 56``1 inhabitants to approve the recommendation of the Director of the Department of Planning upholding the issuance of the Class II Special Permit, with the condition that no writing is permitted with the mural and other conditions recommended by the Department; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The recommendation of the Director of the Department of ` Planning to issue Class II Special Permit Application No. 99-0074, with the condition that no writing is permitted with the mural and other conditions recommended by the Department, for the property located at approximately 219 East Flagler Street, Miami, Florida, is hereby approved, and the City Commission finds that the issuance of Class II Special Permit Application No. 99-0074, with conditions, does meet the applicable requirements of Zoning Ordinance No. 11000, as amended. BACKGROUND The attached request is for a Class II Special Permit for a mural to be located at 219 East Flagler Street. Per Zoning Ordinance 11000, as amended, this application requires City Commission approval. The Urban Development Review Board, at its meeting held on June 9, 1999 recommended approval of the attached mural including a commercial message. The Planning Department has reviewed the proposal and recommends approval with the following conditions: 1. The portions of text specifically described above as inappropriate shall be removed. 2. The remainder of the commercial message (graphics) and the background mural design shall be blended into one entire mural display/composition. Final Decision: ❑ Approval CQ Approval with conditions ❑ Denial FINDINGS AND CONDITIONS The subject proposal has been reviewed for Class II Special Permit pursuant to Section 401, CBD of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida. This Section states explicitly that a Class II Special Permit shall be required prior to approval. of any permit affecting the location, relocation or alteration of any structure, sign, awning, landscaping, parking, area or vehicular way visible from a public street or waterfront walkway. Pursuant to Section 1301.2. of the above cited Zoning Ordinance, the Planning Department has made referrals to the following Departments and Boards. • Zoning Division, Department of Building and Zoning. • Downtown NET Office, Neighborhood Enhancement Team. • Urban Development Review Board. Their comments and recommendations have been duly considered and are reflected in this final decision. In reviewing this application, pursuant to Section 1305 of the Zoning Ordinance, the following findings have been made: FINDINGS • It is found that the mural design (final version) proposed will add visual interest to an otherwise blank and unarticulated building facade. • It is found that the color palette of the proposed mural consists of different shades of gray, blue, yellow and white which conform a pleasant visual effect. • It is found that the proposed texts "ANTI -HARM CLOTHING' & "THE SHOPS AT SUNSET PLACE - U.S. 1 AND RED ROAD." Are inconsistent with the intent of Section 926.12 of the City of Miami Zoning Ordinance and are therefore inappropriate. • It is found that the subject proposal was scheduled before the Urban Development Review Board (UDRB) on April 14, 1999 (deferred), May 12, 1999 (deferred) and heard on June 9, 1999 at which time the subject proposal was recommended for approval. Based on the above findings and the considered advice of the officers and agencies consulted on this matter and pursuant to Section 1306 of the Zoning Ordinance, the subject application is hereby approved with conditions subject to the materials submitted by the applicant and on file with the Planning Department, as well as the following conditions. 1. The portions of text specifically described above as inappropriate shall be removed. 2.
