A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR FIFTHS (4/5T15) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS,
AND AUTHORIZING THE CITY MANAGER TO SOLICIT
INFORMAL BIDS FOR THREE (3) SAFE NEIGHBORHOOD
PARK BOND PROGRAM (SNPBP) PROJECTS: MOORE
PARK IN AN AMOUNT NOT TO EXCEED $1,070,000,
VIRRICK PARK IN AN AMOUNT NOT TO EXCEED
$1,500,000, AND SHENANDOAH PARK IN AN AMOUNT
NOT TO EXCEED $900,000, AND FURTHER
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT(S), IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, WITH THE LOWEST RESPONSIBLE
AND RESPONSIVE BIDDER(S) FOR SAID SNPBP
PROJECTS AS DESCRIBED IN ATTACHMENT "A";
ALLOCATING FUNDS THEREFOR FROM CAPITAL
IMPROVEMENT PROJECT NOS. 331380, 331316 AND
331360, AS APPROPRIATED BY THE ANNUAL
APPROPRIATIONS ORDINANCE.
WHEREAS, pursuant to Resolution No. 98-1109, the City of
Miami submitted grant applications for the Safe. Neighborhood Park
Bond 'Program (SNPBP), second year funding cycle for special
projects in the amount of $3,365,900, and for challenge grants in
the amount of $1,793,900 to fund a variety of projects which
include new buildings, building renovations, lighting, other site
improvements, pool renovations, and land acquisition projects;
and
WHEREAS, the City Manager and the Director of the'Department
of Parks and Recreation recommend the construction related to the

improvement of Moore Park, Virrick Park and Shenandoah Park as
urgent priorities to ensure that funds are administered by

WHEREAS, the City Manager and the Director of Public Works
recommend that the requirements for competitive sealed bids be
waived and the solicitation of informal bids be made for the
implementation of these projects; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2.. By four -fifths (4/5t") affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bids are hereby
ratified, approved and confirmed, and the solicitation of
informal bids for three Safe Neighborhood Park Bond Program
(SNPBP) Moore Park in an amount not to exceed $1,070,000,
Virrick Park in an amount not to exceed $1,500,000, and
Shenandoah Park in an amount not to exceed $900,000, are hereby
approved, with funds therefor hereby allocated from Capital
Improvement Project Nos. 331380, 331316 and 331360, as

appropriated by the Annual Appropriations Ordinance.
Section 3. The City Manager is hereby authorizedl� to
enter into an agreement (s), in a form acceptable to the City
Attorney, with the lowest responsive and responsible bidders)
for said projects.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor s/.

the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

accordance with all provisions of the Miami City Code. Informal
bids will be solicited for the construction of each of the above
listed projects and contracts are to be executed for same.
Three (3) large scale projects, Moore Park, Virrick Park and
Shenandoah Park have been identified as projects urgently needed
in order to improve the quality of life and protect the welfare
of the public who utilize them. Additionally, the City must
undertake all possible measures to expedite the completion of
these projects to ensure that the City does not risk losing these
funds from the Safe Neighborhood Parks Bond Program administered
by Miami -Dade County. In order to have these projects completed
by December of 2000, informal bids will need to be solicited and
contracts executed in amounts not to exceed those currently
appropriated by ordinance.

As you are aware, the City of Miami has been the recipient of approximately $23 million
(includes Challenge Grants) as part of the countywide Safe Neighborhood Parks Bond Program
(SNPBP). I have made the improvement of our parks system a high priority for my
Administration and therefore I am especially sensitive to the timely completion of these projects.
We must undertake all possible measures to expedite the completion of these projects to ensure .
that the City does not risk losing these funds and that citizens enjoy these park improvements as
soon as possible. This is particularly important because of the previously reported late start the Y
City experienced in initiating these projects as a result of the administrative changes that occurred _ .t
during late 1997 and in early 1998.
Accordingly, I am hereby advising you that as soon as construction plans and bid documents are
finalized, we intend to seek City Commission authorization to proceed on an emergency
(informal bidding) basis to select qualified firms to construct several large scale projects that
principally funded by SNPBP funds. Proceeding under a normal bidding process on thes6
projects is not practicable nor advantageous to a timely completion. We are particularly
interested in undertaking this measure for those large scale projects (typically over $1 million)
funded in the fast year of this bond program which must be completed by December of 2000.
Also, we may decide to undertake such action for other projects that we feel need to be expedited
in order to complete them on time. The large scale projects are typically the more complex ones
requiring significant community input, planning and design. Although architects have been
selected and much progress has been made in the design work for these projects, we want to
make sure that sufficient time is provided to complete construction.
The expenditure of SNPBP funds by the required deadline, constitutes a valid emergency with
respect to these projects. By proceeding on an emergency basis we would insure that the funding
of these park improvements, which would improve the quality of life and protect the welfare of
the public who utilize these facilities, would not be lost. We will schedule each of these projects
for your approval prior to commencing on the emergency bidding process. It is our intent to set
up a selection committee that would recommend the firm to be awarded the contract. The
members of the selection committee would typically be made up from representatives of the
City's Public Works and Parks Departments, citizens from the community in which the park
improvements will be made,and a member of the SNPBP Citizens' Oversight Committee.
Attached is a listing some of the projects that we currently anticipate to handle on this basis.

A Public Hearin wilt held by the Commission of the City of Miami, Florida, on July
27, 1999, at %0:0 A.M., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of hearing objections from any
interested parties affected by THE CITY MANAGER'S FINDING OF AN EMERGENCY FOR
NEEDED SAFE NEIGHBORHOOD PARK BOND IMPROVEMENTS AT MOORE PARK, VIRRICK PARK
AND SHENANDOAH PARK, THE WAIVING OF THE REQUIREMENTS FOR FORMAL BIDDING
PROCEDURES FOR SAID PARK IMPROVEMENTS, THE APPROVAL FOR THE SOLICITATION OF
INFORMAL BIDS AND EXECUTION OF CONTRACTS FOR SAID IMPROVEMENTS BY THE CITY
MANAGER.
All interested persons are invited to appear and may be heard concerning the City
Manager's Emergency finding and recommendation for the waiving of formal
bidding procedures for needed improvements at Moore Park, Virrick Park and
Shenandoah Park. Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this hearing, that person shall
ensure that a verbatim record of the proceedings is made, including all testimony
and evidence upon which any appeal may be based.

NOTICE OF PUBLIC HEARING
A Public HearinQ will be held by the Commission of the City of Miami, Florida, on July
27, 1999, at J0:O A.M., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of hearing objections from any
interested parties affected by THE CITY MANAGER'S FINDING OF AN EMERGENCY FOR
NEEDED SAFE NEIGHBORHOOD PARK BOND IMPROVEMENTS AT MOORE PARK, VIRRICK PARK
AND SHENANDOAH PARK, THE WAIVING OF THE REQUIREMENTS FOR FORMAL BIDDING
PROCEDURES FOR SAID PARK IMPROVEMENTS, THE APPROVAL FOR THE SOLICITATION OF
INFORMAL BIDS AND EXECUTION OF CONTRACTS FOR SAID IMPROVEMENTS BY THE CITY
MANAGER.
All interested persons are invited to appear and may be heard concerning the City
Manager's Emergency finding and recommendation for the waiving of formal
bidding procedures for needed improvements at Moore Park, Virrick Park and
Shenandoah Park. Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this hearing, that person shall
ensure that a verbatim record of the proceedings is made, including all testimony
and evidence upon which any appeal may be based.
