P A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR FIFTHS (4/5T11s) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS, AND APPROVING THE REPAIR OF THE KEY BISCAYNE PUMPER TRUCK'S PUMP AND TRANSMISSION BY TEN-8 FIRE EQUIPMENT, IN AN AMOUNT NOT TO EXCEED $10,077; ALLOCATING FUNDS THEREFOR FROM ACCOUNT NO. 280701-670. WHEREAS, pursuant to an Agreement, the City of Miami, Department of Fire -Rescue performs certain Fire -Rescue services for the Village of Key Biscayne; and WHEREAS, the Key Biscayne front line pumper truck required immediate repair of its pump and pump transmission; and WHEREAS, the Fire Chief and the City Manager determined that the repair of the Key Biscayne front line pumper truck constituted an emergency and a purchase order was issued for said repairs; and WHEREAS, funding for the emergency repair is available from cm CONIIKt3SION MEETMG OF JU L 13 1999 Aesolurion No 99- 486 Account Code No. 280701.670; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5"75) affirmative vote of the members of the City Commission the City Manager's finding of an emergency, waiving the requirements for competitive sealed bids, and approving the repair of the Key Biscayne pumper truck's pump and pump transmission by Ten-8 Fire Equipment, in an amount not to exceed $10,077, is hereby ratified, approved and confirmed with funds therefor hereby allocated from Account Code No. 280701.670. Section 3. This Resolution shall become effective - 2 - 99- 48G immediately upon its adoption and signature of the Mayorl/. PASSED AND ADOPTED this 13th _ day of July 1999. Funds for this purchase are available from Account Code No. 280701.670. BACKGROUND The City of Miami has an agreement with the Village of Key Biscayne for Fire -Rescue Automatic Aid and Ancillary Services at the Village of Key Biscayne (the "Agreement'), whereby certain fire, rescue, fire inspection and other services will be performed by the City of Miami, Department of Fire -Rescue. The Key Biscayne front line pumper truck recently required immediate repair of the pump and pump transmission. According to the terms and conditions of the Agreement, the repair of the truck is the responsibility of the City of Miami. The emergency repair of the pumper was necessary so it could be returned to service and the City Manager agreed with this finding and authorized the issuance of an emergency purchase order for said repair work.
