A RESOLUTION OF THE MIAMI CITY COMMISSION
URGING GOVERNOR JEB BUSH, THE FLORIDA STATE
LEGISLATURE, AND THE FLORIDA BUILDING
COMMISSION TO INCORPORATE THE STANDARDS SET
FORTH IN THE SOUTH FLORIDA BUILDING CODE AS
THE FLORIDA BUILDING CODE, PARTICULARLY AS
THE STANDARDS RELATE TO THE CITY OF MIAMI AND
ALL OF SOUTH FLORIDA, WHICH AREAS ARE MOST
GEOGRAPHICALLY EXPOSED TO THE PATHS OF
TROPICAL STORMS AND HURRICANES; DIRECTING THE
CITY MANAGER TO INFORM THE FLORIDA BUILDING
COMMISSION IMMEDIATELY REGARDING THE BUILDING
AND CONSTRUCTION STANDARDS NECESSARY TO
MAINTAIN THE PRESENT LEVEL OF PROTECTION FOR
THE LIFE AND PROPERTY OF CITY OF MIAMI AND
SOUTH FLORIDA RESIDENTS; FURTHER DIRECTING
THE CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE HEREIN DESIGNATED
OFFICIALS.
WHEREAS, the Florida Building Commission is presently
reviewing, revising and drafting the Florida Building Code to be
submitted to the Florida State Legislature before the Year 2000
regular session; and
WHEREAS, the City of Miami, the most populated City in
Miami -Dade County, is geographically located in the direct path
of most tropical storms and hurricanes; and
WHEREAS, the Florida Building Code, as proposed by the
Florida Building Commission, will not ensure adequate protection
of a].1 structural components of buildings, or provide

administrative safeguards, satisfactory permit plans review, and
capable construction inspection;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Miami City Commission hereby urges
Governor Jeb Bush, the Florida State Legislature and the Florida
Building Commission to incorporate the standards set forth in the
South Florida Building Code as the Florida Building Code,
particularly as they relate to the City of Miami and all of South
Florida, which areas are most geographically exposed to the paths
of tropical storms and hurricanes.
Section 3. The City Manager is hereby directed to
immediately inform the Florida Building Commission as to those
building and construction standards necessary to maintain the
present level of protection for the life and property of City of
Miami and South Florida residents.
Section 4. The City Clerk is hereby directed to transmit
a copy of this Resolution to Governor Jeb Bush, the Florida State
Legislature, the Florida Building Commission and the Federal
Emergency Management Agency.

Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

�i If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

Resolution Number 99-461, adopted by the City of Miami, has been forwarded to this
office, and on behalf of Governor Jeb Bush we thank you for your concern and interest in the
Florida Building Code.
I am happy to report that the Florida Building Commission has responded favorably to the
concerns of South Florida communities and residents by including the hurricane protection
provisions of the South Florida Building Code in the proposed statewide code that will be
considered by the Legislature during the 2000 session.
The Commission is nearing completion of the code development process and we trust that
all the protections enumerated in the City of Miami's resolution have been addressed
satisfactorily so that you can now support implementation of the state building code. If you have
