A RESOLUTION OF THE MIAMI CITY COMMISSION
ACCEPTING THE RECOMMENDATION OF THE CITY
MANAGER TO APPROVE THE FINDINGS OF THE
EVALUATION COMMITTEE THAT THE MOST QUALIFIED
FIRMS, IN RANK ORDER, ARE: 1) SHL LANDY
JACOBS, INC. (SHL-LJ), 2) CENTER FOR ECONOMIC
DEVELOPMENT (CED), AND 3) SHELDON ZEDECK,
INC. (SZI), TO PROVIDE AND ADMINISTER THE
PROMOTIONAL, EXAMINATION PROCESSES (PRIMARY
AND PARALLEL) FOR THE CLASSIFICATION OF FIRE
LIEUTENANT FOR THE DEPARTMENT OF HUMAN
RESOURCES; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE TOP
RANKED FIRM OF SHL-LJ FOR AN INITIAL TERM OF
SIX (6) MONTHS, WITH THE OPTION TO EXTEND FOR
THREE (3) ADDITIONAL SIX (6) MONTH PERIODS,
AT AN ESTIMATED TOTAL COST NOT TO EXCEED
$150,000 DURING THE INITIAL AND EXTENDED TERM
OF THE AGREEMENT; FURTHER AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE AN
AGREEMENT WITH THE SECOND OR THIRD RANKED
FIRMS SHOULD NEGOTIATIONS FAIL WITH SHL-LJ;
ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT

FURTHER, AUTHORIZING THE CITY MANAGER TO
INSTRUCT THE CHIEF PROCUREMENT OFFICER TO
ISSUE A PURCHASE ORDER FOR THESE SERVICES.
WHEREAS, Requests for Proposals were mailed to thirty-five
(35) firms seeking a broad range of responses from test
development providers to furnish promotional examinations
(primary and parallel) and evaluation processes for the
classification of Fire Lieutenant for the Department of Human

WHEREAS, the Evaluation Committee evaluated five (5)
proposals received on March 8, 1999, in response to the City's
Request for Proposals (RFP), of which one (1) was deemed non-
responsive in accordance with the fee requirements of the RFP,
and recommended, in rank order, the top three firms of 1) SHL
Landy Jacobs, Inc. (SHL-LJ); 2) Center for Economic Development
(CED), and 3) Sheldon Zedeck, Inc. (SZI) as the most qualified to
provide the required professional services; and
WHEREAS, funding is available for the payment of
compensation in an amount not to exceed $150,000 from the general
operating budget of the Department of Fire -Rescue, Account Code
No. 001000.280601.6.270;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby accepts the
findings of the Evaluation Committee, as to the most qualified
firms, in rank order,
1) SHL Landy Jacobs, Inc. (SHL-LJ)
2) Center for Economic Development (CED)
3) Sheldon Zedeck, Inc.(SZI),
to provide and administer the promotional examination
process (primary and parallel) for the classification of Fire

Lieutenant as stipulated in the Request for Proposal (RFP), for
the Department of Human Resources.
Section 3. The City Manager is hereby authorized-' to
negotiate and execute an agreement, in a form acceptable to the
City Attorney, with SHL-LJ for an initial term of six (6) months
with the options to extend for three (3) additional six (6) month
periods, at an estimated total cost not to exceed $150,000 during
the initial and extended term of the agreement, with funds
therefor hereby allocated from the Department of Fire -Rescue
General Operating Budget, Account Code No. 001000.280601.6.270.
Section 4. In the event that the City Manager cannot
negotiate an agreement which, in the opinion of the City Manager,
is fair, competitive and reasonable with the first ranked
proposed, the City Manager is hereby authorized to terminate such
negotiation and to proceed to negotiate with the second most
qualified proposer(s). In the event that City Manager fails to
negotiate a satisfactory agreement with the second proposer(s),
then City Manager is authorized to undertake negotiations with
the third most qualified proposer(s).
Section 5. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order

Section 6. This Resolution shall become effective

It is respectfully recommended that the City Commission adopt the attached Resolution
approving the findings of the Selection Committee as to the most qualified firms, in rank
order, to provide promotional examination processes (Primary and parallel) for the
classification of Fire Lieutenant; authorizing the City Manager to undertake negotiations with
the most qualified firm, to execute a contract, in a form acceptable to the City Attorney not to
exceed $150,000, and to instruct the Chief Procurement Officer to issue a purchase order for
these services.
BACKGROUND
As a result of the need for a new promotional process within the Department of Fire -Rescue
for the classification of Fire Lieutenant, it is necessary to secure a test developer to conduct
both a primary and parallel examination (2 examinations in total.)
Proposals received, pursuant to Request For Proposal (RFP) No. 98-99-053, have been
analyzed by a Selection Committee to identify a firm with. the ability to develop,
administer/implement, score, and prepare final reports for both a primary and parallel
promotional examination for the classification of Fire Lieutenant. Thirty-five (35) RFPs
were mailed with five (5) responses received. Three firms, SHL Landy Jacobs, Inc., Center
for Business and Economic Development, and Sheldon Zedeck, Inc., ranked one, two and
three, respectively.
The Department of Human Resources recommends that the City Commission accept the
findings of the Selection Committee and authorize the City Manager to enter into
negotiations with SHL Landy Jacobs, Inc., to execute a contract, in a form acceptable to the
City Attorney, not to exceed $150,000, and to instruct the Chief Procurement Officer to issue
a purchase order for these services. In the event negotiations with SHL Landy Jacobs, Inc.,
are not successful, the City Manager would be authorized to enter into negotiations with the
next highest rated firm.
Funding is available to cover the cost of these services in the general operating budget of the
Department of Fire -Rescue, Account Code No. 001000.280601.6.270.

I submit this memorandum as chairperson of the evaluation committee that reviewed the five proposals
that were received in response to RFP # 98-99-053. The committee was comprised of the following
members: Asst. Chief James A. Fisher, Department of Fire -Rescue; Thomas Gabriel, President IAFF
Local 587; Janie Valdes, M. S., Florida International University; James Connolly, M. S., Florida
International University; and Gregory Anderson, Senior Personnel Officer from the Department of
Human Resources. The committee met on two occasions in March and April of 1999 and both meetings
were observed and recorded by Pamela Burns of the City of Miami Purchasing Department, as well as
Mary Leckband of the City of Miami Department of Human Resources.
The committee recommends awarding the contract to SHL Landy-Jacobs, Inc. of State College,
Pennsylvania, as the top ranked firm for the said purpose of development, implementation,
administration, scoring, preparation of final reports, and providing test consultation for the primary and
parallel customized examinations for the classification of Fire Lieutenant.
The evaluation committee concluded that only two other firms should be considered if negotiations with
SHL Landy Jacobs, Inc. fail. The other two eligible ranked firms are: Center for Economic Development
of Auburn University in Montgomery, Alabama (second ranked firm) and then Sheldon Zedeck
Incorporated of Kensington, California (third ranked firm). The proposal by Barrett and Associates, Inc.
of Akron, Ohio, was deemed non -responsive in the fee evaluation process, as the fees submitted were not
in accordance with the terms outlined in the RFP.
The proposal by SHL Landy Jacobs, Inc. was found to be the most responsive proposal, and therefore we
recommend that it be forwarded to the City Commission for consideration. Should you have any

REASON: The Department of Fire -Rescue has a need for a new
promotional process for the classification of a Fire
Lieutenant. It is necessary to secure a test developer to
conduct both a primary and parallel examination (2
examinations total). Three firms, SHL Landy Jacobs,
Inc., Center for Business and Economic Development,
and Sheldon Zedeck, Inc., ranked in order respectively
by the selection committee, to administer/implement,
score, and prepare final reports for both a primary and
parallel promotional examination. Funds will be
