A RESOLUTION OF THE MIAMI CITY COMMISSION
AFFIRMING THE DECISION OF THE DIRECTOR OF
PLANNING DEPARTMENT FOR ISSUANCE OF CLASS II
SPECIAL PERMIT APPLICATION NO. 98-0088, ON
JUNE 9, 1998, WITH CONDITIONS, FOR THE
PROPERTY LOCATED AT APPROXIMATELY 2850
SOUTHWEST 27TH AVENUE, MIAMI, FLORIDA, MORE
PARTICULARLY LEGALLY DESCRIBED HEREIN,
PURSUANT TO SECTION 613 OF ORDINANCE
NO. 11000, AS AMENDED, THE ZONING ORDINANCE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED.
WHEREAS, the Director of Planning Department issued Class II
Special Permit Application No. 98-0088 on June 9, 1998, with
conditions, for the property located at approximately
2850 Southwest 27th Avenue, Miami, Florida; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, requires City Commission
approval of the Class II Special Permit as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of

Department of Planning upholding the issuance of the Class II
Special Permit with conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Director of the
Department of Planning to issue Class II Special Permit
Application No. 98-0088, on June 9,1998, with conditions, for the
property located at approximately 2850 Southwest 27th Avenue,
Miami, Florida, more particularly legally described as Lots 1, 2,
3, 4 and 5 of Block 5, Pine Terrace, according to the plat
thereof, as recorded in Plat Book 3 at Page 51 of the Public
Records of Miami -Dade County, Florida, is hereby affirmed, and
the City Commission finds that the issuance of Class II Special
Permit Application No. 98-0088, with conditions, does meet the
applicable requirements of Zoning Ordinance No. 11000, as

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor. -A'

RECOMMENDATION
It is respectfully recommended that the City Commission approve the attached request for
a Class II Special Permit for the proposed Landscape Plan at 2850 SW 27" Avenue with
the conditions specified below.
BACKGROUND
The attached request is for a Class II Special Permit for the Coconut Grove United
Methodist Church located at 2850 SW 27`h Avenue. The property consists of an SD-13
Zoning Overlay which requires the City Commission to approve the proposed Landscape
Plan.
The Planning Department has reviewed the proposed work to the parking area, including
the required landscape plan. A referral of the proposal was also submitted to the
Northeast Coconut Grove NET Office for comments. The following findings have been
made:
• It is found that the proposed landscape plan is sufficient and will enhance the subject
property and the 27 h Avenue corridor leading into Coconut Grove.
• It is found that per comments received by the NET Office, there are existing problems
on the subject property with the trash dumpster and an illegal sign; these should be
corrected.

Based on these findings, the administration is recommending approval with the following
conditions:
1. The existing trash receptacle/dumpster shall be screened from view per City of Miami ■
Code (Sec. 22.2); and
2. The illegal sign currently located in the public right-of-way shall be removed. -

Coconut Grove United Methodist Church
Dear Ms. Fernandez:
The Coconut Grove United Methodist Church is seeking placement on the
agenda for the May 25,1999 City Commission Meeting.
As per a condition in a Class II Special Permit for the above referenced
project, the Church is required to submit a landscape plan subject to
review and approval by the City Commission (see attached Class R Final
Decision).
We have already submitted a Class II Special Permit for this landscape
Plan and are submitting to you 12 sets of signed and sealed plans as well as
the necessary documents required for placement on the agenda.

PLEASE TAKE NOTICE THAT A FINAL DECISION HAS BEEN REACHED ON THE FOLLOWING MATTER:
Title: Exterior Remodeling on SD-13 and SD-3 districts.

FINDINGS AND CONDITIONS:
The subject proposal has been reviewed for Class II Special Permit pursuant to Sections 603.3.1
and 613.3.1 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami,
Florida. Section 603.3.1 requires explicitly that a Class II Special Permit shall be required prior to
approval for any building permit affecting the bulk and/or exterior configuration of any building
within the district. Section 613.3.1 requires explicitly that a Class 11 Special Permit shall be
required prior to approval for the location, relocation or substantial exterior alteration of any
structure, sign, awning, ... visible from the public street or waterfront walkway.
Pursuant to Section 1301.2. of the above cited Zoning Ordinance, the Department of Planning
and Development has made referrals to the following Departments and Boards.
• Zoning Division, Building and Zoning Department.
• NE Coconut Grove NET Office, Neighborhood Enhancement Team.
Their comments and recommendations have been duly considered and are reflected in this final
decision. In reviewing this application , pursuant to Section 1305 of the Zoning Ordinance, the
following findings have been made:

FINDINGS
• It is found that the design for this proposed project as presented will enhance the existing
structure, as well as improve the services rendered to the public at this particular location.
• It is found that the massing and articulation of the proposed addition are appropriate and in
harmony with the existing context.
• It is found that the materials and colors selected are appropriate in that they are compatible
with those found in the existing building and therefore help visually integrate the new and the
old.
Based on the above findings and the considered advice of the officers and agencies consulted on
this matter and pursuant to Section 1306 of the Zoning Ordinance, the subject application is
hereby approved conditionally subject to the plans and supplementary materials submitted by
the applicant and on file with the Department of Planning and Development and further subject to
the following condition:
CONDITION
1. That the landscaping component of this proposal be revised and enhanced and that a
landscaping proposal be submitted to be reviewed subject to a separate permit. Such a
permit would need to obtain the approval of the City Commission as specified in Ordinance
11000, as amended, the Zoning Ordinance of the City of Miami, Section 613.3.1.
NOTICE
The final decision of the Director may be appealed to the Zoning Board by any aggrieved
party, within fifteen (15) days of the date of issuance by filing a written appeal and
appropriate fee with the Office of Hearing Boards, located at 444 SW 2nd Avenue, r floor,
