A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING CITY OF MIAMI EMPLOYEES WHO ARE
MEMBERS OF THE UNITED STATES MILITARY RESERVE
OR FLORIDA NATIONAL GUARD, ORDERED TO REPORT
FOR ACTIVE DUTY IN AREAS OF CONFLICT, A
SUPPLEMENT TO MILITARY PAY RECEIVED IN AN
AMOUNT NECESSARY TO BRING TOTAL SALARY,
INCLUSIVE OF BASE MILITARY PAY, TO THE LEVEL
EARNED AT THE TIME OF THE ORDER TO ACTIVE
MILITARY DUTY; APPROVING CERTAIN OTHER
SPECIFIED BENEFITS, WITH THE MONIES FOR SUCH
EXPENDITURE BEING ALLOCATED FROM PREVIOUSLY
APPROPRIATED SALARY AND SALARY SURPLUS FUNDS;
AND DIRECTING THE CITY MANAGER TO EXECUTE ALL
THE NECESSARY DOCUMENTS FOR SAID PURPOSE.
WHEREAS, from time to time, City of Miami employees, who are
reservists in the United States Armed Forces, are ordered to
active military duty in areas of conflict; and
WHEREAS, such order of the United States Armed Forces to
active duty may pose financial hardship upon families of those
employees; and
WHEREAS, Florida Statute §115.14 provides that
municipalities or political subdivisions of the state may, in the
discretion of the employing authority, supplement the military
pay of its officials and employees who are reservists called to
active military service;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

Section 1. The City Commission hereby adopts Florida
Statute §1.15.14 which provides that City employees who are
members of the United States Military Reserve or Florida National
Guard, ordered to report for active duty in areas of conflict,
shall receive a supplement to military pay received in an amount
necessary to bring total salary, inclusive of base military pay,
to the level earned at the time of the order to active military
duty, with the monies for such expenditure being allocated from
previously appropriated salary and salary surplus funds.
Section 2. City employees who receive a supplement to
their military pay in accordance with Section 1 shall be eligible
to receive such supplement not to exceed one hundred eighty (180)
calendar days.
Section 3. City employees who receive a supplement to
their military pay in accordance with Section 1 shall continue to
be provided with health insurance coverage, not to exceed one
hundred eighty (180) calendar days, provided the military service
does not provide health insurance coverage for the employee or
the employee's family.
Section 4. City employees who receive a supplement to
their military pay in accordance with Section 1 shall not be

eligible to accrue sick or earned personal leave benefits.
Section 5. The City Manager is hereby directed!' to
execute all necessary documents for the implementation of said
supplement.
Section 6. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor��.

�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

It is recommended that the City Commission approve a Resolution authorizing, for
those employees who are members of the United States Military Reserve or Florida
National Guard and who are ordered to report for active military service in areas
of conflict, the payment of a supplemental salary in an amount necessary to bring
the employee's total salary, inclusive of their military pay, to the employee's base
salary. It is also recommended that certain other benefits (i.e. length of military pay
supplement, health insurance, seniority and leave benefits) be applied as specified.
BACKGROUND
Current Florida Statutes (Section 115.09 and Section 115.14) provide that an
employee reservist called to active military service receive full pay for the first 30
days, and thereafter, the employing authority may supplement the employee's pay
in an amount necessary to bring their total salary, inclusive of their base military
pay, to the level earned at the time they were called to active military service
during war between the United States and a foreign government. The employing
authority may also, in its discretion, continue to provide any health insurance and
other existing benefits to such officials and employees.
Additionally, the Veteran's Reemployment Act (Chapter 43 of the United States
Code) provides that "such employee shall be permitted to return to such employee's
position with such seniority, status, pay, and vacation as such employee would have
had if such employee had not been absent for such purposes."
The City currently has a reservist employee who was called to active military
service in an area of conflict (Bosnia). As a result of a request to pay the employee
supplemental military pay, the City administration has determined that a written
policy should be established specifying the benefits to be received when a City
reservist employee is called to active military service in area of conflict.

In developing this policy the City has surveyed various military forces and public
employers to ascertain the various benefits provided by these entities to employees
called to active military service (a copy of the survey is attached).
The City administration recommends, in addition to a pay supplement to bring the
reservist employee's salary to his or her base salary, the application of the following
benefits following the first 30 days:
1) Receipt of the military pay supplement not to exceed 180
calendar days.
2) Continuation of the reservist employee's health coverage not to
exceed 180 calendar days, provided the military services does
not provide health insurance coverage for the employee and/or
the employee's family.
3) Non -accrual of sick or earned personal leave benefits while on
active duty.
The City administration recommends that the Resolution be approved in order to
apply the specified benefits to reservist employees who are called to active military
service in areas of conflict.
