A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO SUBMIT AN
APPLICATION TO THE FLORIDA INLAND NAVIGATION
DISTRICT ("FIND") UNDER SAID AGENCY'S
WATERWAYS ASSISTANCE PROGRAM FOR GRANT
FUNDING IN THE ESTIMATED AMOUNT OF $300,000
FOR THE MARGARET PACE PARK PUBLIC WATERFRONT
ENHANCEMENT PROJECT; FURTHER AUTHORIZING THE
CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY.
WHEREAS, the City of Miami is committed to the preservation
and improvement of neighborhood parks for the enjoyment of the
public; and
WHEREAS, Margaret Pace park is included in the Capital
Improvement Program (Capital Improvement Project No. 333104,
"Pace Park Improvements"); and
WHEREAS, the Florida Legislature has made funding available
to municipalities for such projects under the Florida Inland
Navigation District's ("FIND") Waterways Assistance Program on a
fifty-fifty cost share basis; and
WHEREAS, the proposed shoreline enhancements at Margaret
Pace Park meets the criteria for grant funding pursuant to the

program; and
WHEREAS, the City's matching share of the project cost, in
the estimated amount of $300,000 is available from the newly
adopted 1996 Safe Neighborhood Park Bond Referendum;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
submit an application, to Florida Inland Navigation District for
grant funding under its Waterways Assistance Program, in the
estimated amount of $300,000 for the Margaret Pace Park Public
Waterfront Enhancement Project.
Section 3. The City Manager is hereby authorized!' to
executed of the necessary documents, in a form acceptable to the
City Attorney, for application of said grant subject to the
following provisions:
a. The City will accept the terms and conditions set for
in FIND Rule 66B-2 F.A.C. and which will be a part of
the grant agreement for any assistance under the

attached proposal.
b. The City is in accord with the attached grant proposal
and will carry out the project in the manner described
in said proposal, and any plans and specifications
attached hereto, unless prior approval for any change
has been received from FIND.
C. The City has the ability and intention to finance its
share of the cost of said project from available Safe
Neighborhood Park Bond funds and the project site will
be operated and maintained at the expense of the City
for public use.
d. The City will not discriminate against any person on
the basis of race, color, creed, national origin, sex
or handicap in the use of any property or facility
acquired or developed pursuant to the grant proposal
and will comply with the terms and intent of Title VI
of the Civil Rights Act of 1964, and will design and
construct accessibility by handicapped persons as well
as other federal state and local laws, rule and
requirements.
e. The City will maintain adequate financial records on
said project to substantiate claims for reimbursement.
f. The City will make available to FIND, if requested, a
post -audit of expenses incurred on said project prior
to or in conjunction with its request for the final

ten percent (101s) of the grant funding provided by
Florida Inland Navigation District.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayoral
PASSED AND ADOPTED this 27th day of April 1999.

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission
adopt the attached Resolution authorizing the City Manager
to submit an application to the Florida Inland Navigation
District ("FIND") under said agency's Waterways Assistance
Program for grant funding in the estimated amount of
$300,000 for the Margaret Pace Park Public Waterfront
Enhancement Project. The Resolution further authorizes the
City Manager to execute the necessary documents, in a form
acceptable to the City Attorney for this purpose.
BACKGROUND:
The City of Miami Department of Parks and Recreation working
with residents, community associations, the NET Office and
the City's Omni Community Redevelopment Agency (CRA) have
developed throughout the years a commitment to the needs of
the area including the preservation and improvement of
Margaret Pace Park as an important focal point for passive
recreation and community events.
The City's Department of Parks and Recreation working with
the Omni Community Revitalization Agency (CRA) developed a
master plan for improvements to Margaret Pace Park. The CRA
engaged the firm of Bermello, Ajamil and Partners for this
effort. Plans for the park include the stabilization of the
shoreline, lighted baywalk, viewing pier, tennis and
basketball courts, children's play area.
The Florida Legislature has made funding available to
municipalities for such projects under the FIND Waterways
Assistance Program on a 50-50 cost share basis. The
proposed public waterfront enhancement project at Margaret
Pace Park (shoreline stabilization and viewing pier
components) satisfies the criteria for grant funding under
the FIND program, and the City's required matching share is
available from the recently approved 1996 Safe Neighborhood
Park Bond Referendum.

The Parks and Recreation Department has verified that funds
are available with the Department of Management & Budget in
the amount of $300,000 as matching funds for an application
to the Florida Inland Navigation District ("FIND")for the
Margaret Pace Park Public Waterfront Enhancement Project.
Funding is available from the newly adopted 1996 Safe
Neighborhood Park Bond Referendum under Capital Improvement
Project No. 333104.
