A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO SUBMIT AN
APPLICATION, TO THE, FLORIDA INLAND NAVIGATION
DISTRICT ("FIND") PURSUANT TO ITS WATERWAYS
ASSISTANCE PROGRAM FOR GRANT FUNDING IN THE
ESTIMATED AMOUNT OF $180,000, FOR THE KENNETH
MYERS PARK "SEMINOLE" PUBLIC BOAT RAMP AND
LAUNCHING FACILITY; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY.
WHEREAS, the City of Miami is committed to the preservation
and improvement of neighborhood parks for the enjoyment of the
public; and
WHEREAS, Kenneth Myers Park is included in the Capital
Improvement Program (Capital Improvement Project No. 331359,
"Peacock/Myers Park Improvements");and
WHEREAS, the Florida Legislature has made funding available
to municipalities for such projects under the Florida Inland
Navigation District's ("FIND") Waterways Assistance Program on a
fifty-fifty cost share basis; and
WHEREAS, the proposed shoreline enhancements at Myers Park
meets the criteria for grant funding pursuant to the FIND

program; and
WHEREAS, the City's matching share of the project cost, in
the estimated amount of $180,000 is available from the newly
adopted 1996 Safe Neighborhood Park Bond Referendum;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
submit an application to Florida Inland Navigation District for
grant funding under its Waterways Assistance Program, in the
estimated amount of $180,000 for the Kenneth Myers Park
"Seminole'' Public Boat Ramp and Launching Facility.
Section 3. The City Manager is hereby authorized' to
executed of the necessary documents, in a form acceptable to the
City Attorney, for application of said grant subject to the
following provisions:
a. The City will accept the terms and conditions set for
in FIND Rule 66B-2 F.A.C. and which will be a part of
the grant agreement for any assistance under the

b. The City is in complete accord with the attached grant
proposal and will carry out the project in the manner
described in said proposal, and any plans and
specifications attached hereto, unless prior approval
for any change has been received from FIND.
C. The City has the ability and intention to finance its
share of the cost of said project from available Safe
Neighborhood Park Bond funds and the project site will
be operated and maintained at the expense of the City
for public use.
d. The City will not discriminate against any person on
the basis of race, color, creed, national origin, sex
or handicap in the use of any property or facility
acquired or developed pursuant to the grant proposal
and will comply with the terms and intent of Title VI
of the Civil Rights Act of 1964, P.L. 88-352 (1964) and
will design and construct accessibility by handicapped
persons as well as other federal state and local laws,
rule and requirements.
e. The City will maintain adequate financial records on
said project to substantiate claims for reimbursement.
f. The City will make available to FIND, if requested, a
post -audit of expenses incurred on said project prior
to or in conjunction with its request for the final

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission
adopt the attached Resolution authorizing the City Manager
to submit an application to the Florida Inland Navigation
District ("FIND") under said agency's Waterways Assistance
Program for grant funding in the estimated amount of
$180,000 for the Kenneth Myers Park "Seminole" Public Boat
Ramp and Launching Facility. The Resolution further
authorizes the City Manager to execute the necessary
documents, in a form acceptable to the City Attorney for
this purpose.
BACKGROUND:
The City of Miami -Department of Parks and Recreation working
with residents, community associations, the NET Office and
the City's Waterfront Advisory Board have developed
throughout the years a commitment to the needs of the area
including the preservation and improvement of Myers Park as
an important focal point for passive recreation and the
enjoyment of the waterways through facilities such as the
"Seminole" public boat ramp.
The City's Department of Parks and Recreation in association
with the Department of Public Works are working to improve
the "Seminole" boat ramp area located at Kenneth Myers Park
in the corner of SW 27`h Avenue and South Bayshore Drive.
These improvements will create additional parking for cars
with boat trailers, an attendant booth and renovations to
the existing pier.
The Florida Legislature has made funding available to
municipalities for such projects under the FIND Waterways
Assistance Program on a 50-50 cost share basis. The
proposed "Seminole" public boat ramp and launching facility
at Kenneth Myers Park satisfies the criteria for grant
funding under the FIND program, and the City's required
matching share is available from the recently approved 1996
Safe eighborhood Park Bond Referendum.

are available with the Department of Management & Budget in
the amount of $180,000 as matching funds for an application
to the Florida Inland Navigation District ("FIND") for the

Facility. Funding is available from the newly adopted 1996
Safe Neighborhood Park Bond Referendum under Capital
