A RESOLUTION OF THE MIAMI CITY COMMISSION
RELATED TO THE MIAMI/BAHAMAS GOOMBAY FESTIVAL
TO BE CONDUCTED BY THE MIAMI/BAHAMAS GOOMBAY
FESTIVAL IN COCONUT GROVE, INC. (THE
"ORGANIZER") ON JUNE 5-6, 1999, IN THE AREA
DESIGNATED HEREIN; AUTHORIZING THE ISSUANCE OF
A PERMIT FOR A TWO-DAY PERIOD FOR THE SALE OF
ALCOHOLIC BEVERAGES, SUBJECT TO THE ISSUANCE OF
ALL PERMITS REQUIRED BY LAW, AND AUTHORIZING
THE USE OF PARK EQUIPMENT, AS IN -KIND SERVICES,
EXCLUDING THE WAIVER OF APPLICABLE FEES AND
PERMITS; CONDITIONING SAID AUTHORIZATIONS UPON
THE ORGANIZERS: (1) PAYING FOR ALL OTHER
NECESSARY COSTS OF CITY SERVICES AND APPLICABLE
FEES ASSOCIATED WITH SAID EVENT; (2) OBTAINING
INSURANCE WITH THE CITY AS AN ADDITIONAL
INSURED, INCLUDING BUT NOT LIMITED TO COVERAGE
FOR LIQUOR LIABILITY, TO PROTECT THE CITY IN AN
AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE; AND (3) INSTITUTING AN IDENTIFICATION
SYSTEM TO ASSURE THAT ONLY THOSE INDIVIDUALS
OVER THE AGE OF TWENTY-ONE MAY PURCHASE
ALCOHOLIC BEVERAGES.
WHEREAS, the Miami/Bahamas Goombay Festival in Coconut
Grove, Inc. will conduct the 1999 Miami/Bahamas Goombay Festival
on June 5-6, 1999; and
WHEREAS, the Miami/Bahamas Goombay Festival in Coconut
Grove, Inc. has requested permission to sell alcoholic beverages
during said event and for the authorization for use of City of
Miami ("City") park equipment as in -kind services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

OF MIAMI, FLORIDA:
Section 1. The issuance of a permit for a two-day period
for the sale of alcoholic beverages, subject the issuance of all
permits required by law, and the use of City of Miami ("City")
park equipment, as in -kind services, excluding the waiver of
applicable City fees and permits, is hereby authorized for the
Miami/Bahamas Goombay Festival in Coconut Grove, Inc. (the
"Organizers") in connection with the Miami/Bahamas Goombay
Festival to be conducted on Saturday and Sunday, June 5-6, 1999,
from 9:00 A.M. to 7:00 P.M., in the area of Grand Avenue from
McDonald Street to Douglas Road, Coconut Grove, Miami, Florida,
subject to the issuance of a temporary permit to sell alcoholic
beverages by the State of Florida Department of Business
Regulation, Division of Alcoholic Beverages and Tobacco, pursuant
to Section 54-13 of the Code of the City of Miami, Florida, as
amended.
Section 2. The herein authorizations are hereby
conditioned upon the Organizers: (1) paying for all other costs
of City services and fees associated with said event; (2)
obtaining insurance which includes the City as an additional
insured in order to protect the City from liabilities arising
from the event, including but not limited to coverage for liquor
liability, in an amount as prescribed by the City Manager or his
designee; and (3) instituting an identification system to assure
that only those individuals aged twenty-one and over may purchase

alcoholic beverages.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y
PASSED AND ADOPTED this 27th day of May , 1999.

effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

The administration recommends approval of the Miami/Bahamas Goombay Festival's
request to sell tropical drinks during the festival, subject to the following:
+ Paying for the cost of all City services and applicable permits fees required by law.
• Obtaining insurance, including liquor liability, to protect the City of Miami in the amount
stipulated by City requirements.
+ Instituting an identification program to assure that only those over the age of twenty-one will
buy alcoholic drinks.
As it relates to the waiver of fees, the administration recommends denial due to budgetary
constraints. Approval of this request may set a precedent for other festivals seeking financial
support from the City.
BACKGROUND:
Mr. Heruy Givens, Executive Director of the Miami/Bahamas Goombay Festival in Coconut
Grove, Inc., is requesting authorization to sell alcoholic beverages during the Miami/Bahamas
Goombay Festival to be held on June 5-6, 1999 in Coconut Grove. Additionally they are
requesting the waiver of all permit fees, administrative fees and rentals fees related to the
Festival.
The other two issues mentioned in their letter, authorization to close streets and the restriction of
retail peddlers, do not need City Commission approval since they can be authorized by the City
Manager under the City of Miami Code.

The administration met with the organizers of the Miami Bahamas Goombay Festival in Coconut
Grove, Inc. to discuss City services and permits. At that meeting the organizers of the festival
were advised that in order to sell tropical drinks they needed to obtain City Commission
approval, since the City Manager can only authorize the sale of beer and wine.
The City traditionally has granted authorization to sell tropical drinks to the Miami Bahamas
Goombay Festival as well as to other events such as the Coconut Grove Arts Festival, the Taste
of the Grove. the Coconut Grove Bed Race and the Banyan Festival.
