RESOLUTION NO. 9 9- 266
A RESOLUTION OF THE MIAMI CITY COMMISSION
REALLOCATING $100,000 FROM PREVIOUSLY
APPROVED 24T" YEAR COMMUNITY DEVELOPMENT
BLOCK GRANT (CDBG) PROJECTS IN THE PUBLIC
FACILITIES CATEGORY TO THE CENTER FOR HAITIAN
STUDIES, INC. (CHS) TO COMPLETE ROOF REPAIRS
AT THE AGENCY'S FACILITY LOCATED AT 8260
NORTHEAST 2ND AVENUE, MIAMI, FLORIDA; SAID
REALLOCATION SPECIFICALLY IDENTIFIED AS EQUAL
INCREMENTS OF $50,000 FROM THE 24- YEAR
ALLAPATTAH AND EDISON LITTLE RIVER SIDEWALK
IMPROVEMENT PROJECTS; ALSO AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT WITH CHS
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
AND SUBJECT TO APPLICABLE CITY CODE
PROVISIONS; AND FURTHER STIPULATING THAT CDBG
FUNDS TAKEN FROM THE ALLAPATTAH AND EDISON
LITTLE RIVER SIDEWALK IMPROVEMENTS BE
REPLACED BY MONIES RECEIVED FROM THE GAS TAX
SETTLEMENT CHECK ISSUED BY THE STATE OF
FLORIDA.
WHEREAS, the Center for Haitian Studies, Inc. (CHS)
requested funding from the City to complete roof repairs at the
Agency's facility located at 8260 Northeast 2nd Avenue, Miami,
Florida; and
WHEREAS, the Department of Public Works estimated that the
cost of the roof repairs for the CHS facility would be
approximately $97,000; and
WHEREAS, the City Commission adopted Motion 99-149 at its
meeting of February 23, 1999 expressing its intent to reallocate

$100,000 from previously approved 24`h Year Community Development
Block Grant (CDBG) projects in the Public Facilities category for
this purpose; and
WHEREAS, Motion 99-149 specifically identified equal $50,000
increments of 24`h Year CDBG funds to be reallocated from the
Allapattah and Edison Little River sidewalk improvement projects
to complete the CHS roof repairs; and
WHEREAS, Motion 99-149 further stipulated that CDBG funds
taken from the Allapattah and Edison Little River sidewalk
improvement projects be replaced by monies received from the Gas
Tax settlement check issued by the State of Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. $50,000 of 24`h Year Community Development
Block Grant funds previously allocated for a sidewalk improvement
project in the Allapattah target area and $50,000 of 24`h Year
Community Development Block Grant funds previously allocated for
a sidewalk improvement project in the Edison Little River target
area are hereby reallocated to the Center for Haitian Studies,
Inc. to complete roof repairs at the Agency's facility located at

8260 Northeast 2 Avenue, Miami, Florida.
Section 3. The aforementioned $50,000 allocation of 24`h
Year Community Development Block Grant funds for a sidewalk
improvement project in the Allapattah target area and the $50,000
allocation of 24`h Year Community Development Block Grant funds
for a sidewalk improvement project in the Edison Little River
target area that are reallocated in Section 2 above to complete
roof repairs at the Center for Haitian Studies are hereby
replaced by monies received from the Gas Tax settlement check
issued by the State of Florida.
Section 4. The City Manager is hereby authorized!' to execute
an agreement with the Center for Haitian studies in a form
acceptable to the City Attorney, and subject to applicable City
Code provisions.
Section 5. This Resolution shall become effective

prescribed by applicable City Charter and Code provisions.

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached resolution to
reallocate $100,000 from previously approved 24a' Year Community Development Block
Grant (CDBG) projects in the Public Facilities category to the Center for Haitian Studies,
Inc. (CHS) to complete roof repairs at the Agency's facility located at 8260 N.E. 2
Avenue; said reallocation specifically identified from equal $50,000 increments of
Allapattah and Edison Little River sidewalk improvement projects; authorizing the City
Manager to execute an agreement with CHS in a form acceptable to the City Attorney,
and subject to applicable City Code provisions; and further stipulating that funds taken
from Allapattah and Edison Little River sidewalk improvements be replaced by monies
received from the Gas Tax settlement check issued by the State of Florida.
BACKGROUND:
At its meeting of February 23, 1999, the City Commission adopted Motion 99-149
expressing its intent to reallocate $100,000 of previously approved 2e Year CDBG funds
in the Public Facilities category to complete roof repairs at the CHS facility located at
8260 N.E. 2 Avenue. The City Commission also identified equal $50,000 increments to
be taken from sidewalk improvement projects in Allapattah and Edison Little River for this
purpose with the condition that these funds would be replaced by monies received from
the Gas Tax settlement check issued by the State of Florida.
In accordance with federal regulations governing the reprogramming of CDBG funds, the
Department of Community Development placed the appropriate advertisement publicizing
the Public Hearing and providing an opportunity for public comment regarding the
reprogramming.
The proposed resolution effectuates the intent of Motion 99-149 by reallocating $100,000
of CDBG funds from approved 24 h Year Public Facilities projects to repair the CHS
facility and further authorizes the City Manager to execute an agreement with CHS in a
form acceptable to the City Attorney. The proposed resolution also replaces CDBG fiends
taken from Allapattah and Edison Little River sidewalk improvements with monies
received kom/lthe Gas Tax settlement check issued by the State of Florida.

FOR THE PROPOSED AMENDMENT TO THE
FISCAL YEAR 1998 CONSOLIDATED PLAN
The Puhlic Hearing originally scheduled for April 13,1999 has been reschedulgd
for April 27,1999. This Public Hearing will be held anytime after 10:00 AM during
the regularly scheduled City Commission meeting located at 3500 Pan Americpn,
Drive, Miami, Florida.
Federal regulations governing the City of Miami Housing Opportunities for
Persons With Aids Program (HOPWA) the Community Development Block Grant
(CDBG) Program, and its Consolidated Plan require that a participating jurisdiction
provide citizens with reasonable notice of and the opportunity to comment on any
substantial amendment to the City of Miami's 1998-1999 Action Plan.
The City of Miami is proposing to reprogram $3,274,764 in available HOPWA
funding from the Long Term Rental Assistance category to the Utilities Assistance
and Permanent Housing Assistance categories.
