A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE ALLOCATION OF FUNDS, IN THE AMOUNT OF $425,000, TO BAME DEVELOPMENT CORPORATION OF SOUTH FLORIDA, INC., PROJECT SPONSOR FOR THE ACQUISITION AND REHABILITATION OF A TWELVE (12) UNIT HOUSING PROJECT KNOWN AS BETHEL ARMS APARTMENTS, LOCATED IN THE OVERTOWN TARGET AREA AT 269 NORTHWEST 8TH STREET, MIAMI, FLORIDA, TO PROVIDE PERMANENT AFFORDABLE HOUSING OPPORTUNITIES FOR LOW INCOME PERSONS LIVING WITH HIV/AIDS; ALLOCATING FUNDS THEREFOR FROM THE FY 1998-99 HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) PROGRAM GRANT ACCOUNT NUMBER 194006.590606.6860.94654, FOR THE PROVISION OF SAID SERVICES; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO EFFECT SAID ALLOCATION AND IMPLEMENT THE PROJECT. WHEREAS, the Housing Opportunities for Persons With AIDS ("HOPWA") Program was created pursuant to the AIDS Housing Opportunity Act, and revised pursuant to the Housing and Community Development Act of 1992; and WHEREAS, Section 606(d)(2) of the Housing and Community Development Act of 1992 stipulates that the City of Miami, being the most populous unit of general local government in an Eligible Metropolitan Statistical Area ("EMSA"), not including county government, must be the applicant for the HOPWA Grant and be CITY cOIinagSIon MEETING OF APR 2 7 1999 Resolution No. 3 %.- F` ek- allocated the related funding; and WHEREAS, the City of Miami has been awarded funding from the U.S. Department of Housing and Urban Development (HUD) for the implementation of the 1998-99 HOPWA Program Grant; and WHEREAS, on March 14, 1998, the City Commission adopted - Ordinance No. 11643, which established a special revenue fund entitled "Housing Opportunities for Persons With AIDS Grant'' and appropriated $7,732,000 in funding from HUD for the implementation and administration of the 1998-99 HOPWA Program; _ and WHEREAS, on April 14, 1998, the City Commission adopted Resolution No. 98-402.1 which authorized the City Manager to submit the City of Miami's FY 1998-99 Consolidated Plan and the proposed uses of said HOPWA funds; and WHEREAS, the HOPWA Advisory Board, at the August 17, 1998 and September 22, 1998 HOPWA Advisory Board meetings, recommended the allocation of funds in the amount of $425,000 to BAME Development Corporation of South Florida, Inc., project sponsor for the acquisition and rehabilitation of a twelve (12) unit apartment building known as Bethel Arms Apartments located in the Overtown Target Area at 269 Northwest 8rh Street, Miami, Florida, for the provision of permanent housing units for low income persons living with HIV/AIDS; and WHEREAS, HOPWA Program funding is available from the City's 1998-99 HOPWA Program Grant, Account No. 194006.590606.6860.94654, to fund the aforementioned Bethel 2 - 99- 265 "I - Arms Apartments project for the provision of permanent housing units for low income persons living with HIV/AIDS; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The allocation of funds in the amount of $425,000 to BAME Development Corporation of South Florida, Inc., project sponsor for the acquisition and rehabilitation of an eighteen (18) unit apartment building known as Bethel Arms Apartments, located at 269 Northwest 81h Street, Miami, Florida, is hereby authorized to provide permanent housing units for low income persons living with HIV/AIDS, with funds therefor hereby allocated from the FY 1998-99 Housing Opportunities for Persons With AIDS (HOPWA) Program Grant, Account No. 194006.590606.6860.94654. Section 3. The City Manager is hereby authorizedl/ to execute all necessary documents, in a form acceptable to the city attorney, to effect said allocation and implement the Project. Section 4. REFERENCES: City Commission Agenda Item ENCLOSURES: Meeting of April 13, 1999 It is respectfully recommended that the City Commission adopt the attached resolution, authorizing the City Manager to allocate $425,000 in FY 1998-99 Housing Opportunities for Persons With AIDS (HOPWA) Program funds to BAME Development Corporation of South Florida, Inc., project sponsor for the acquisition and rehabilitation of a twelve (12) unit housing project in the Overtown Target Area. The housing project, known as Bethel Arms Apartments (the "Project"), is located at 269 NW 8a` Street, and will provide permanent affordable housing opportunities for low income persons living with HIV/AIDS. Funding for the Project is being provided from the U.S. Department of Housing and Urban Development from the FY 1998-99 HOPWA Program. BACKGROUND: At the April 14, 1998 City Commission meeting, through Resolution No. 98-402.1, the City Commission approved and authorized the City Manager to submit the City of Miami's FY 1998- 99 Consolidated Plan for the planned use of funding from the Community Development Block Grant Program, HOME Investment Partnership Program, Housing Opportunities for Persons With AIDS Program and the Emergency Shelter Grant Program. Approximately $7,732,000 in funding was awarded to the City of Miami from the U.S. Department of Housing and Urban Development in connection with the implementation of the City's 1998-99 HOPWA Program. At the August 17, 1998 and September 22, 1998 HQPWA Advisory Board meetings, the HOPWA Advisory Board recommended allocating $425,000 in FY 1998-99 HOPWA Program funding to BAME Development Corporation of South Florida, Inc., project sponsor for the acquisition and rehabilitation of a twelve (12) unit housing project. This Public Hearing will be held anytime after 10:00 AM during the regularly scheduled City Commission meeting located at 3500 Pan Amedc pn, Drive, Miami, Florida. Federal regulations governing the City of Miami Housing Opportunities for Persons With Aids Program (HOPWA) the Community Development Block Grant (CDBG) Program, and its Consolidated Plan require that a participating jurisdiction provide citizens with reasonable notice of and the opportunity to comment on any substantial amendment to the City of Miami's 1998-1999 Action Plan. The herein total appropriation of S28,608,000 shall be used to carry out those - publicly supported physical development activities and those related social, housing or economic development activities within a reasonable . period of time in accordance with the rules and regulations governing the Community Development Block Grant, HOME Investment Partnership Grant, Emergency .Shelter Grant, and the Housing Opportunities for Persons with Aids Grant as approved by the U.S. Department of Housing and Urban Development. Section 4• All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of the Ordinance are hereby repealed. Section 5.
