A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
REALLOCATE $3,274,764 IN FY 1998-99 HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA)
PROGRAM FUNDS AS STIPULATED IN RESOLUTION
_ NO. 98-402.1 WHICH APPROVED IN PART THE CITY
OF MIAMI'S FY 1998-99 ACTION PLAN AND THE
PROJECTED USES OF SAID FUNDS FOR THE HOPWA
PROGRAM; FURTHER AUTHORIZING AND DIRECTING
THE CITY MANAGER TO SUBMIT AN AMENDMENT TO
THE CITY'S ANNUAL ACTION PLAN FOR APPROVAL BY
THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT FOR THE REALLOCATION OF THE SAID
HOPWA FUNDS, AND TO EXECUTE ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY.
WHEREAS, the Housing Opportunities for Persons With Aids
(HOPWA) Program was created pursuant to the AIDS Housing
Opportunity Act, and revised pursuant to the Housing and
Community Development Act of 1992; and
WHEREAS, Section 606(d)(2) of the Housing and Community
Development Act of 1992 stipulated that the City of Miami, being
the most populous unit of general local government in an Eligible
Metropolitan Statistical Area ("EMSA"), not including county
government, must be the applicant for the HOPWA Grant and be
allocated the related funding; and
WHEREAS, the City of Miami has been awarded funding from the
U.S. Department of Housing and Urban Development (HUD) for

the implementation of the 1998-99 Program Grant; and
WHEREAS, at the April 14, 1998 City Commission meeting, the
City Commission adopted Ordinance No. 11643, which established a
special revenue fund entitled "Housing Opportunities for Persons
With AIDS Grant" and appropriated $7,732,000 in funding from
U.S. HUD for the implementation and administration of the 1998-99
Program; and
WHEREAS, on April 14, 1998, the City Commission adopted
Resolution No. 98-402.1 which authorized the City Manager to
submit for approval the City of Miami's FY 1998-99 Consolidated
Plan and the projected uses of said HOPWA funds to the U.S.
Department of Housing and Urban Development; and
WHEREAS, Resolution No. 98-402.1 authorized the allocation
of the $7,732,000 HOPWA funding to the following programs; and

WHEREAS, at the December 8, 1998 City Commission meeting,
pursuant to Resolution No. 98-1192, the City Commission awarded

funding in the amount of $2,400,000 from the FY 1998-99 Program
Grant, to Miami -Dade County's Office of Community Services for
the provision of utilities assistance to very low income persons
living with HIV/AIDS; and
WHEREAS, at the December 8, 1998 City Commission meeting,
pursuant to Resolution No. 98-1211, the City Commission awarded
funding in the amount of $320,000 from the FY 1998-99 Program
Grant to the sponsor of the proposed forty-two (42) unit
Everglades Center Apartment Project planned in the Downtown
Target Area, for the provision of eight (8) permanent housing
units for low income persons living with HIV/AIDS; and
WHEREAS, at the February 23, 1999 City Commission meeting,
pursuant to Resolution No. 99-141, the City Commission awarded
funding in the amount of $198,839 from the FY 1998-99 Program
Grant, to the Economic Opportunity Family Health Center to
complete the twenty-four (24) unit Sugar Hill permanent housing
project in the Model City Target Area for low income persons
living with HIV/AIDS; and
WHEREAS, the HOPWA Advisory Board, at the July 15, 1998
HOPWA Advisory Board meeting, recommended funding in the amount
of $500,000, from the FY 1998-99 Program Grant, to the Miami
Beach Community Development Corporation, in connection with the
acquisition and rehabilitation of an eighteen (18) unit housing
project known as the Fernwood Apartments Project, located in

Miami Beach, Florida, for the provision of permanent housing
units for low income persons living with HIV/AIDS; and
WHEREAS, the HOPWA Advisory Board, at the August 17, 1998
and September 22, 1998 HOPWA Advisory Board meetings, recommended
funding in the amount of $425,000, from the FY 1998-99 Program
Grant, to the BAME Development Corporation of South Florida,
Inc., in connection with the acquisition and rehabilitation of a
twelve (12) unit apartment building known as Bethel Arms
Apartments, located in the Overtown Target Area at 269 Northwest
8`h Street, Miami, Florida, for the provision of permanent
housing units for low income persons living with HIV/AIDS; and
WHEREAS, in order to make the aforementioned funding
available, it is necessary that the City Commission approve the
reallocation of funding to certain HOPWA program categories which
were approved for FY 1998-99; and
WHEREAS, funds for the reallocation are available in the
amount of $3,274,764 from the Long Term Rental Housing Assistance
Program which currently has an approved FY 1998-99 allocation in
the amount of $4,673,653; and
WHEREAS, it is also necessary that the City Commission
authorize and direct the City Manager to submit an amendment to
the City of Miami's Annual Action Plan to the U.S. Department of

funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized and
directed to reallocate $3,274,764 in FY 1998-99 Housing
Opportunities for Persons With AIDS (HOPWA) Program funds from
the Long Term Rental Housing Assistance Program as follows:

Section 3. The City Manager is hereby authorizedll and
directed to submit to the U.S. Department of Housing and Urban
Development an amendment to the City of Miami's Annual Action

limited to those prescribed by applicable City Charter and Code
provisions.

Plan, for the reallocation of the aforementioned funds as set
forth herein and to execute all necessary documents, in a form
acceptable to the city attorney, to implement the reallocation.
Section 4. This Resolution shall become effective upon
its adoption and signature of the Mayor2/.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached resolution
authorizing and directing the City Manager to reallocate $3,274,764 in FY 1998-99 Housing
Opportunities for Persons With AIDS (HOPWA) Program funds as stipulated in Resolution No.
98-402.1 which, approved in part, the City of Miami's FY 1998-99 Action Plan and the projected
uses of said funds for the HOPWA Program. Further directing the City Manager to submit an
amendment to the City's Annual Action Plan for approval by the U.S. Department of Housing and
Urban Development for the reallocation of the said HOPWA Funds.
BACKGROUND:
At the April 14, 1998 City Commission meeting, the City Commission adopted Ordinance 11643,
which established a special revenue fund entitled "Housing Opportunities for Persons With AIDS
Grant" and appropriated $7,732,000 in funding from the U.S. Department of Housing and Urban
Development for the implementation and administration of the 1998 HOPWA Program.
Additionally, at the April 14, 1998 City Commission meeting, through Resolution No. 98402.1,
the City Commission approved and authorized the City Manager to submit the City of Miami's
FY 1998-99 Consolidated Plan for the planned use of the $7,732,000 in funding under the
Housing Opportunities for Persons With AIDS Program.
Resolution No. 98-1192, adopted December 8, 1998, awarded funding in the amount of
$2,400,000 from the FY 1998-99 HOPWA Program Grant to Miami -Dade County's Office of
Community Services for the provision of utilities assistance to very low income persons living
with HIV/AIDS. Resolution No. 98-1211, also adopted at the December 8, 1998 City
Commission meeting, awarded funding in the amount of $320,000 from the FY 1998-99 HOPWA
Program Grant to the Everglades Center Apartment Project. The proposed project is a forty-two
(42) unit rehabilitation project planned in the Downtown Target Area, and will provide permanent
housing units for eight (8) low income persons living with HIV/AIDS. Additionally, the City
Commission adopted Resolution No. 99-141 at the February 23, 1999 meeting, allocating
$198,839 in FY 1998-99 HOPWA funds to the Economic Opportunity Family Health Center to
complete the twenty-four (24) unit Sugar Hill housing project in the Model City Target Area for
low income persons living with HIV/AIDS.

Moreover, at the July 15, 1998 HOPWA Advisory Board meeting, the HOPWA Advisory Board
recommended funding in the amount of $500,000 from the FY 1998-99 HOPWA Program Grant,
to the Miami Beach Community Development Corporation, in connection with the acquisition and
rehabilitation of an eighteen (18) unit housing project known as Fernwood Apartments Project,
located in Miami Beach, for the provision of permanent housing units for low income persons
living with HIV/AIDS. At the August 12, 1998 and September 22, 1998 HOPWA Advisory
Board meetings, the HOPWA Advisory Board recommended funding in the amount of $425,000
from the FY 1998-99 HOPWA Program Grant to the BANE Development Corporation of South
Florida, Inc., in connection with the acquisition and rehabilitation of a twelve (12) unit apartment
building located in the Overtown Target Area at 269 NW 8`h Street, for the provision of
permanent housing units for low income persons living with HIV/AIDS.
In order to make the aforementioned funding available, it is necessary that the City Commission
approve the reallocation of funds in the amount of $3,274,764 to the Utilities Assistance and
Permanent Housing categories. It is also necessary that the City Commission authorize and direct
the City Manager to submit an amendment to the City of Miami's Annual Action Plan to the U.S.
Department of Housing and Urban Development for the reallocation of said HOPWA funds.
The Department of Community Development has identified available FY 1998-99 HOPWA
Program funds and recommends the reallocation of said funds as follows:

FISCAL YEAR 1998 CONSOLIDATED PLAN
The Public Heating originally scheduled for April 13,1999 has been rescheduled
for April 27,1999. This Public Hearing will be held anytime after 10:00 AM during
the regularly scheduled City Commission meeting located at 3500 Pan Amedcpn,
Drive, Miami, Florida.
Federal regulations governing the City of Miami Housing Opportunities for
Persons With Aids Program (HOPWA) the Community Development Block Grant
(CDBG) Program, and its Consolidated Plan require that a participating jurisdiction
provide citizens with reasonable notice of and the opportunity to comment on any
substantial amendment to the City of Miami's 1998-1999 Action Plan.
The City of Miami is proposing to reprogram $3,274,764 in available HOPWA
funding from the Long Term Rental Assistance category to the Utilities Assistance
and Permanent Housing Assistance categories.

Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of the Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.

SUBMITTAL. OF THE CITY OF NUAMI'S FY 1998-1999
PROPOSED CONSOLIDATED PLAN, INCLUDING A FY 1998
ACTION PLAN WITH PROJECTED USES OF FUNDS FOR THE
CITY'S CONWLitiZTY DEVELOPMENT BLOCK GRANT (CDBG),
HOME INVESTMENT PARTNERSHIPS (HOME), EMERGENCY
SHELTER GRANT (ESG) AN-D HOUSING OPPORTU-NITIES FOR
PERSONS WITH AIDS (HOPWA) PROGRAMS TO THE UNITED
STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT (USHUD); FURTHER AUTHORIZING THE CITY
MANAGER, UPON APPROVAL OF SAID PLAN AND GRANTS BY

SPECIFICALLY APPROVED BY THE CITY COMMISSION, WITH
FUNDS ALLOCATED THEREFOR FROM THE
AFOREMENTIONED GRANTS AND PROGRAMS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIA U, FLORIDA:
Section 1. The City Manager is hereby authorized to submit the City of Miami's Proposed
Consolidated Plan for Fiscal Year 1998-1999, including a FY 1998 Action Plan with

recommended funding projections for the City's Community Development Block Grant (CDBG),
HOME Investment Partnership (HONIE), Emergency Shelter Grant (ESG) and Housing
Opportunities for Persons with Aids (HOPWA) Programs, and a grant application for the four
specified programs, to the Li. S. Department of Housing and Urban Development (USHUD).
Section 2. The City Manager is hereby authorized, upon approval of the Consolidated
Plan and grants by US HL1), to accept and execute the necessary implementing agreements, in a
form acceptable to the City Attorney.
Section 3. The City Manager is further authorized' to execute individual contractual
agreements, in a form acceptable to the City Attorney, with the community based neighborhood
organizations, as approved by the City Commission, for the purpose of implementing
neighborhood economic development, social services and housing development programs, for the
amounts specifically approved by the City Commission, with funds therefor allocated from i
aforementioned Community Development Block Grant, HOME Investment Partnerships Prograr,►,
Emergency Shelter Grant, and the Housing Opportunities for Persons with Aids Program..
Section 4. This Resolution shall become effective immediately upon its adoption.

WHEREAS, the Housing Opportunities for Persons With AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and
WHEREAS, Section 606(d)(2) of the Housing and Community
Development Act of 1992 stipulates that the City of Miami, being
the most populous unit of general local government in an eligible
metropolitan statistical area (EMSA), not including county
government, shall be the applicant for the HOPWA Grant and be
allocated the related funding; and
WHEREAS, the City of Miami has been awarded funding from the
U.S. Department of Housing and Urban Development (U.S. HUD) for

the implementation of the 1998 HOPWA Program Grant; and
WHEREAS, on March 14, 1998, the City Commission adopted
Ordinance No. 11643, which established a special revenue fund
entitled "Housing Opportunities for Persons With AIDS Grant", and
appropriated $7,732,000 in funding from U.S.HUD for the
implementation and administration of the 1998 ROPWA Program; and
WHEREAS, on April 14, 1998, the City Commission adopted
Resolution No. 98-402.1 which authorized the City Manager to
submit the City:eof Miami's FM 1998-1999 Consolidated Plan for
funding the 1998 HOPWA Program; and
WHEREAS, the HOPWA Advisory Board (HAS), at its meeting on
November 6, 1998, recommended funding, in the amount of
$2,400,000 to Miami -Dade County, Office of Community Services,
for the provision of utilities assistance to very low income
persons with HIV/AIDS; and
WHEREAS, HOPWA Program funding is available from the 1998
HOPWA Program Grant to fund said Service Provider;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MXAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Funding, in the amount of two million, four
hundred thousand dollars ($2,400,000) to Miami -Dade County,
Office of Community Services (Service Provider), for the
provision of utilities assistance to very low income persons

PROGRAM, IN THE AMOUNT OF $320,000, FOR THE
DEVELOPMENT OF THE EVERGLADES CENTER
APARTMENT PROJECT, CONSISTING OF 42 UNITS, TO
BE LOCATED IN THE DOWNTOWN TARGET AREA AT 282
NORTHEAST 2M STREET, MIAMI, FLORIDA, BY
EVERGLADES CENTER APARTMENTS PARTNERSHIP;
AUTHORIZING THE CITY MANAGER TO SUBMIT AN
AMENDMENT TO THE CITY OF MIAMI' S 1998 ANNUAL
ACTION PLAN TO THE U.S. DEPARTMENT OF HOUSING
AND URBAN DEVELOPMENT FOR THE REALLOCATION OF

WHEREAS, in April 1997, the City of Miami's Housing Loan
Committee approved financial assistance to Everglades Center

Downtown Realty Investment Corporation and Kapustin Corporation,
the sponsor of the proposed 42 unit Everglades Center Apartment
Project, which involves the conversion/rehabilitation into
residential housing reuse of a commercial property located at
282 Northeast 2nd Street, Miami, Florida; and
WHEREAS, approximately $629,580 in HOME Investment
Partnership Program funds and $200,000 in Community Development

Block Grant Program funds have been allocated by the City of
Miami for said purpose; and
WHEREAS, in November 1997, a loan closing was held by the
Department of Community Development, and the Partnership
commenced the process of pulling building permits; and
WHEREAS, the Department of Building and Zoning required
certain changes to the conversion/rehabilitation plans which has
resulted in substantial increases in the cost of the project,
creating an approximate short fall in the amount of $400,000; and
WHEREAS, the Partnership is seeking an additional $320,000
in City financial assistance to move forward with the proposed
project; and
WHEREAS, it is recommended that the City Commission
authorize the allocation of funding from the City's FY 1998-1999
HOPWA Program funds, in the amount of $320,000 for the
development of .the Everglades Center Apartment Project and
authorize the City Manager to submit an amendment to the City of

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
allocate funding from the City's FY 1998-1999 Housing
Opportunities for Persons with Aids ("HOPWA"), in the amount of
$320,000 for the development of the -Everglades Center Apartment
Project, consisting of 42 units, to be located in the Downtown
Target Area at 282 Northeast 2nd Street, Miami, Florida, by
Everglades Center Apartments Partnership.
Section 3. The City Manager is hereby authorized1l to
submit an amendment to the City of Miami's 1998 Annual Action
Plan to the U.S. Department Of Housing And Urban Development for
the reallocation of said funds, and to execute the necessary
documents, in a form acceptable to the City Attorney, for said

WHEREAS, the Housing Opportunities for Persons With AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and
WHEREAS, Section 606(d)(2) of the Federal Housing and
Community Development Act of 1992 stipulates that the City of
Miami, as the most populous local government in an eligible
metropolitan statistical area (EMSA), not including county
government, must be the applicant for the HOPWA Grant in order
for grant funding to

be awarded; and
WHEREAS, the City of Miami has been awarded funding from the
U.S. Department of Housing and Urban Development (U.S. HUD) for
the implementation of the 1998 HOPWA Program Grant; and
WHEREAS, on March 14, 1998, the City Commission adopted
Ordinance No. 11643, which established a special revenue fund
entitled "Housing Opportunities for Persons With AIDS Grant" and
appropriated $7,732,000 in funding from U.S. HUD for the
implementation and administration of the 1998 HOPWA Program; and
WHEREAS, on April 14, 1998, the City Commission adopted
Resolution No. 98-402.1, which authorized the City Manager to
submit the City of Miami's FY 1998-1999 Consolidated Plan and the
uses of said HOPWA funds; and
WHEREAS, at the November 6, 1998 HOPWA Advisory Board
meeting, it was recommended that funding, in the amount of
$198,839, for the completion of the rehabilitation -of a
twenty-four (24) unit housing project for low income persons
living with HIV/AIDS located at 7104, 7126, 7160, 7186 N.W. 14th
Place, Miami, Florida, be allocated to Economic vpportunIty
Family Health Center, Inc.; and
WHEREAS, HOPWA Program funding is available from the City's
1998 HOPWA Program Grant, Account No. 194006.590606.6860.94654
for this purpose;
