ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE; WAIVING THE

WHEREAS, the Department of Parks and Recreation requires the
installation of ten US Filter/Stranco automated pool water
treatment systems before the summer season; and
WHEREAS, the existing system is outdated, costly and does
not meet industry standards; and
WHEREAS, Commercial Energy Specialists, Inc., is the sole
manufacturer and distributor of Stranco pool water treatment

system; and
WHEREAS, the Chief Procurement Officer_ has adopted a finding
that Commercial Energy Specialists, Inc., is the only vendor able
to provide US Filter/Stranco pool water treatment system,
service, warranty, and support programs for the product; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Director of Parks and
Recreation recommend that the requirements for competitive formal
sealed bids be waived and the purchase of ten US Filter/Stranco
pool water treatment systems from Commercial Energy Specialists,
Inc., the sole source provider, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote,
of the members of the City Commission, after a duly advertised
public hearing, hereby ratifies, approves, and confirms the City
Managers finding of sole source, waives the requirements for
competitive sealed bidding procedures, and approves the
procurement of ten US Filter/Stranco pool water treatment system

amount not to exceed $48,536; with funds therefor hereby
allocated from the Safe Neighborhood Park Bond Program, Capital

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/

RECOMMENDATION:
It is respectfully recommended that the City Commission waive the requirement of
competitive bids and approve the attached Resolution for the purchase of ten (10) US
Filter/Stranco pool water treatment systems, from Commercial Energy Specialists, Inc.
("CES"), a non-local/non-minority vendor located at 860 Jupiter Park Drive, Suite 2,
Jupiter, Florida 33468-8958, at a total estimated cost not to exceed $48,536.00. Funding
is available from the Safe Neighborhood Park Bond Program allocated for this purpose in
Capital Improvement Project Nos. 331070, 333113, 331341, 331391, 331385, 331313,
331360, 331316, and 333107.
BACKGROUND:
The Department of Parks and Recreation has a critical need for the US Filter/Stranco pool
water treatment system. This type of system needs to be installed before the beginning of
our summer pool season. Consequently, time is of the essence in this endeavor, so that
our pools may be ready for our residents to enjoy.
The current gas chlorinating pool water treatment system in our pools is in need of
replacement, because it soon will not meet industry standards and it is an increasingly
expensive item in our operating budget.
It is important to note that the modernization of our City pools is a Safe Neighborhood
Park Bond Project and this carries a priority designation for this administration and our
residents.
Commercial Energy Specialists, Inc. ("CES") has been the sole factory representative for
Stranco pool water treatment system since 1985, and as such is fully responsible for all
sales, distribution, service, warranty, and support programs within its Florida and
Caribbe territo

An investigat n was conducted by staff to determine whether Commercial Energy Specialists, Inc. (CES), a non -
minority / non-1 cal vendor, located at 860 Jupiter Park Drive, Suite 2, Jupiter, Fla. 33468, is the sole source provider of the
US Filter/Strain pool water treatment system to replace the existing gas chlorination system in the pools at ten (10) City
parks.
The Department of Parks and Recreation has indicated that the gas chlorination system requires upgrading. It was reported
the current system needs to be replaced because it will not meet industry standards in the near future, and the repairs are
costly. Ten (10) parks were identified by the department having the immediate need for the US Filter/Stranco automated pool
water treatment system.
In investigating the product, contact was made with Mr. Alvaro Mendoza, President of Commercial Energy Specialists
(CES). He advised that CES is the sole distributor for the automated Stranco pool water treatment system in the entire State
of Florida and the Caribbean, and only CES provides service, warranty, and support programs for the product. The
technology of this water treatment system of Stranco is patented and is proprietary to Stranco. He provided documentation
where Miami -Dade County, Ft. Lauderdale, Sarasota County, and Palm Beach County have all purchased this system as a
sole source. According to Mr. Mendoza, his product is unique and proprietary as it includes hardware, software, training,
service, and on -going support. The line is fully -interactive, and Stranco is a pioneer in the on-line control of water chemistry
from remote locations. Because of its on-line use of technology in their treatment processes, they hold several patents for this
type of service.
Contact was also made with Mr. Mark Voet from the City of Ft. Lauderdale. He advised the pool at the Hall of Fame, has
used the Stranco System 4 in the past, and now uses the System 5, both of which were purchased as a sole source. He advised
he is very pleased with the automated system as it has saved his facility money over the years in chlorination costs. He
thought Stranco is the only turn -key automated pool system that can operate from remote locations, and advised Disney is
one of their clients. Staff was unable to locate any other vendors on the Internet or from other sources who could provide
this same type of remote automated system.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be approved:

CES respectfully submits a plan for the modernization of the City of Miami swimming
pool water treatment systems. For over 15 years, CES has been providing this
modernization service to thousands of the most demanding pools and spas in Florida
,and the Caribbean. These includes municipal, competitive, Disney, institutional,
hotel, club, and condo pools of all sizes and scope.
CES has been the sole factory representative for Stranco since 1985, and as such is
fully responsible for all sales, distribution, service, warranty, and support programs
within its Florida and Caribbean territory. As sole source of this modemizaGon
equipment, CES currently has open purchase orders with local municipalities PL
_ such as City of Fort Lauderdale, Palm Beach County, and Sarasota County

= The CES Water Quality Control program is unique in that it includes all the pb, F,334,

long-term success of these types of treatment system conversions. The equipment s1-W -1w

used is US Filter / Stranco exclusive line of fully -interactive, multii-parameter, activec�sw,,.cx�n
control systems. Stranco pioneered on-line control of water chemistry in the early sty in w&.
1970's, and they hold multiple patents on several of their treatment processes.
As per the City of Miami conversions, here are some important points to consider.
L A gronounced trend away from gas chlorinatign As a result of increased
regulations by EPA, OSHA, Department of Health (DOH), Department of labor
and Employment Security (DLES) and others, most municipal pool operator
have switched away from highly toxic gas chlorine. CES has converted
hundreds of these pools to safer and less costly alternatives since 1988. Local
conversions include: City of Miami Beach (3 pools), City of Homestead, City of
North Miami (3 pools), City of Miami Shores, City of Coral Gables, City of
Miami Springs, City of Hialeah, and Miami -Dade County (20+ pools). The
1988 SARA Title III regulations, along with others mentioned above forced
many of these municipalities to switch. This year several new regulations will
take effect making the use of gas chlorine even more difficult. At this time City
of Miami is the only known municipality in Dade County that is still using this
form of chlorination on their pools. The CES proposal will complete a turn -key
switch away from gas including all engineering, health department approvals,
installation, equipment, training, and technical support.

2. Current Gas Chlorination equipment is in need of repair and replacement: The
current gas chlorine I soda ash systems are in definite need of modernization
from operational and safety standpoints. The existing gas chlorinators are
outdated and currently are requiring specialized and expensive repairs. Other
items such as scales, gas detectors, eductors, booster pumps, gas masks, and
other equipment also need replacement in order to comply with codes. Many
times the cost of the CES conversion is considerably less than the cost of
bringing these facilities within compliance of the various codes. New codes also
call the installation of gas scrubbers in order to comply with certain safety
standards. These scrubbers can cost more that $25,000 per pool site. The
proposed CES water treatment conversions provides all new chlorination
equipment for the City of Miami pools, thus avoiding these considerable
replacement costs.
5 Current chemistry dispensing system are not up to indust standards: The
dispensing of chlorine and pH materials is still being done on a manual basis.
This produces unavoidable peaks and valleys that cause aggressive water,
wastes chemicals, and may provide unhealthy water parameters. The City of
Miami pools are the only municipal pools in Dade County that are not equipped
with an automated chemical control and feed system. These chemical control
systems automatically monitor the pool water chemistry 24 hours a day, and
dispense chemicals on an as needed basis to maintain preset desired levels
regardless of bather load or weather conditions. The CES proposal provides
new state of the art chemical control equipment on designated City of Miami
pools.
4. Long term chemical and maintenance savings: By dispensing only what
chemical are necessary to hold desired parameters, the City of Miami will
assure taxpayers of the lowest possible chemical costs, while guaranteeing
safe and appealing water. Since the water is maintained in perfect balance 24
hours a day, there will be less impact on the mechanical components of the
swimming pool, thus lowering the incidence of repair.
5. Success of this program is based on proprietary DVT technology' Vlerith this
water quality control program, the City of Miami and CES will be in continual
contact with all of the pools from any central location via phone lines and PC's.
The on -site chemical control systems are also continually self -monitoring and
recording chemistry level and alarm occurrences 24 hours a day. The systems
will alert City personnel on all out of range alarm conditions (even pool pump
failures), and will assist City of Miami personnel in pinpointing these alarms for
quicker troubleshooting and repair. CES will interactively monitor the pools and
assist the City in maintaining hourly printed logs of all chemical levels, chemical
feed events, and employee Interactions with the systems for maximum in liability
avoidance. The CES proposal provides for this proprietary interactive interface
on each of the City of Miami Pools.

Sz On-slte training. service, and technigal support: The CES program includes on -
site factory training,warranty administration, service and technical support. Each
site receives full factory orientation and training on all mechanical feed systems,
chemical controllers, water chemistry, and all aspect of code compliant pool
operation. If City of Miami is in need of service, CES's support team conducts
full factory service and repairs, on -site and on -tame. Annual preventive
maintenance programs are available after the warranty period has expired.
CES has an extensive track record of supporting similar installations In Dade
County of over 15 years.
Z, Direct 2uLQhasiag Dower on treatment syst, ems. garts, and accessories: As
mentioned, CES is the exclusive factory representative for the proposed
chemical treatment packages. Many Florida municipalities use the CES
standard on a sole source basis. As territory representatives, CES also
distributes this equipment to selected pool builders and service companies, but
is willing to work directly with the City in order to provide direct pricing. The City
of Miami may also take advantage of special savings on over 2,500 specialized
swimming pool parts and accessories including filtration and treatment
equipment, deck and safety equipment, test kits, chemicals, and other support
products and services. All CES support services catalog items are fully
supported on -site by the CES tech services staff.
We sincerely look forward to working with the Parks and Recreation staff in
modernizing the chemical treatment systems on the City of Miami pools. We are
confident that the transition between the current antiquated system and the proposed
state of art program will be handled smoothly, professionally, and completely. Please
