A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENTS, APPROVING THE RELEASE OF A
ZONING COVENANT RUNNING WITH THE LAND, DATED
FEBRUARY 27, 1992, RECORDED IN THE OFFICIAL
RECORDS OF MIAMI-DADE COUNTY, FLORIDA,
NO. 92RO70219 FOR THE PROPERTY LOCATED AT
2828 NORTHWEST 19TH AVENUE, MIAMI, FLORIDA,
FOR THE PURPOSE OF REDEVELOPING THE PROPERTY
FOR A DUPLEX RESIDENCE.
WHEREAS, the property located at 2828 Northwest 19th Avenue,
Miami, Florida, more particularly described on attached
Exhibit "A" (the "Property") is subject to a zoning covenant (the
"Zoning Covenant"), dated February 27, 1992, recorded in the
Official Records of Miami -Dade County, Florida, No. 92R070219,
(attached as Exhibit "B"), by which Zoning Covenant the owner of
the property acknowledged and agreed that said Property was zoned
R-3 and that the use of the Property, including any addition (s)
or remodeling, was restricted to single family use only; and
WHEREAS, the single family residence that was subject to
said Zoning Covenant, has been demolished, and the property
owners, Lynn and Susan Fuelling, have requested release of said

Zoning Covenant to develop the property as a duplex residence,
which is a R-3 permitted use; and
WHEREAS, the City Commission after careful consideration of
this matter finds that it is in the best interest of the general
welfare of the City of Miami and its inhabitants to release the
Zoning Covenant for said Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The release of a Zoning Covenant Running With
the Land, dated February 27, 1992, recorded in the Official
Records of Miami -Dade County, Florida, No. 92R070219, attached
and incorporated as Exhibit "B" (the "Zoning Covenant"), is
hereby approved and the proper City officials are hereby
authorized to execute a release in connection therewith for the
property located at approximately 2828 Northwest 19th Avenue,
Miami, Florida, more particularly described on Exhibit "A",
attached hereto and made a part hereof, to allow said Property to

be developed as a duplex residence.
Section 3. This Resolution shall become effective
immediately upon its adoption.11

The Building and Zoning Department has no objections to the attached request to release
a Covenant running with the land for the property located at 2828 NW 19`� Avenue.
BACKGROUND
The property located at approximately 2828 NW 19t' Avenue has a covenant recorded
against it which limits use of the property to a single family use only; however, the
Property is zoned R-3 Medium -Density Multifamily Residential. The attached request is
to release the covenant recorded in 1992 in order to redevelop the property for a duplex
use. The property is currently vacant since the once existing structure has been
demolished. There are no records to indicate why this covenant was required.
The Building and Zoning Department has no objections to the requested release due to
the fact that the new proposed use, a duplex residence, is permissible within the R-3
Zoning District.
