A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE; WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES AND APPROVING THE PURCHASE OF
MOTOROLA DIGITAL PORTABLE RADIOS WITH
ACCESSORIES FROM MOTOROLA, INC THE SOLE
SOURCE PROVIDER, FOR THE DEPARTMENT OF
FIRE -RESCUE, IN AN AMOUNT NOT TO EXCEED
$125,021.90; ALLOCATING FUNDS THERFOR FROM
THE CAPITAL IMPROVEMENT PROGRAM, PROJECT NO.
313303, "FIRE -RESCUE DEPARTMENT COMPUTERS AND
COMMUNICATIONS", ACCOUNT CODE NO. 289401.840.
WHEREAS, the Fire -Rescue Department has a critical need for
new radios, essential to the mission of the Department, to
replace 12-year-old models for which replacement parts will soon
be unavailable; and
WHEREAS, the older models have been routinely used by the
Fire -Rescue Department during fire, medical, and other hazardous
situations and attrition has created a shortage of reliable
radios; and
WHEREAS, Motorola, Inc. is the sole provider of the 800 MHZ
Radio System, which was previously acquired by the City after a
sole source finding, and the operating and maintenance software

for the system is proprietary to said company; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that Motorola, Inc., is the only vendor able to provide Motorola
Digital Portable Radios with accessories to the Department of
Fire -Rescue; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Director of the Department
of Fire -Rescue recommend that the requirements for competitive
formal sealed bids be waived and the purchase of twenty-four (24)
XTS 3000 Digital Portable Radios and thirteen (13) MCS 2000
Mobile Radios with Accessories from Motorola, Inc., the sole
source provider, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findinas contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the
members of the City Commission, after a duly advertised public
hearing, hereby ratify, approve, and confirm the City Manager's
finding of sole source, waive the requirements for competitive
sealed bidding procedures, and approve the purchase of Motorola
Digital Portable Radios with Accessories from Motorola, Inc., the
sole source provider for said radios, for the Department of
Fire -Rescue, in an amount not to exceed $125,021.90, with funds
therefor hereby allocated from the Capital Improvement Program,

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor11.

RECOMMENDATION:
It is respectfully recommended that the City Commission waive the necessity of
competitive bids and approve the attached Resolution for the purchase of twenty
four (24) XTS 3000 Digital Portable Radios and thirteen (13) MCS 2000 Mobile
Radios with accessories, from Motorola, Inc., a non-local/non-minority vendor
located at 4660 SW 158 Avenue, Miami, Florida, 33183, at a total estimated cost
not to exceed $ l 25,021.90. Funding is available from the CIP Project entitled
"Fire Department Computers and Communications", Project #313303, Account
Code 289401-840. This purchase is funded by the Fire Assessment.
BACKGROUND:
The Department of Fire -Rescue has a critical need for new radios. The existing
radios are over 12 years old and the manufacturer will discontinue the
manufacturing of parts for the old radios in the near future. Due to the age of the
radios and the extreme conditions of use in the Fire Service, normal attrition has
created a departmental radio shortage. Due to the nature of emergency services,
these radios are essential to service delivery.
Motorola, Inc., is the sole manufacturer of the existing 800 MHZ Radio System,
which was previously acquired by the City via a sole source finding. The operating
and maintenance software for the system is proprietary to Motorola, Inc. In
addition, via Resolution 98-432, the City has previously determined the acquisition
of the XTS 3000 Portable Radios from Motorola, inc., was a sole source.
The Chief Procurement Officer has determined that Motorola, Inc., due the
proprietary nature of their trunking technology, is the sole manufacturer of the XTS
3000 Digital portable radios and the MCS 2000 Mobile radios with accessories for
both.

An investigate was conducted by staff to determine whether Motorola, Inc., a non -minority I non -local
vendor, locate at 4660 S.W. 158th Avenue, Miami, Florida 33183, is the sole source provider of the XTS
3000 Digital ortable Radios and MCS 2000 Mobile Radios, with accessories. Both types of radios contain
the SMAR ET system software. The Department of Fire -Rescue has requested the acquisition of twenty-
four (24) XTS 3000, and thirteen (13) MCS 2000 radios with accessories, for a total estimated amount not to
exceed $125,021.90.

from Motorola, Inc. was a sole source. The acquisition of the MCS 2000 radios, also containing the
SMARTNET software, is propriety as they are also part of the 800 MHz radio system and are fixed mobile
radios within the rescue vehicles.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these
findings be approved: Motorola, Inc. is the sole source supplier of the XTS 3000 Digital Portable Radios and
the MCS 2000 Mobile radios, both with the SMARTNET software, with related accessories. Funds are
available from the CIP Project entitled "Fire Department Computers and Communications," Project
#313303, Account Co 01-840, for an amount not to exceed $125,021.90.

A public hearing will be held by the City Commission of the City of Miami, Florida
