FURTHER ADOPTING AND INCORPORATING PROVISIONS SET FORTH IN MIAMI-DADS COUNTY ORDINANCE NO. 97-107, ADOPTED JULY 9, 1997 (WHICH ORDINANCE AMENDED THE SOUTH FLORIDA BUILDING CODE), ATTACHED HERETO AND MADE A PART HEREOF, AS PART OF THE BUILDING CODE OF THE CITY OF MIAMI; AND DIRECTING THE CITY MANAGER TO INSTRUCT THE BUILDING OFFICIAL OF THE CITY OF MIAMI TO IMPLEMENT THE PROVISIONS OF SAID ORDINANCEVID NG pRp FOR TIME LIMITATIONS AND AN EFFECTIVE DATE. WHEREAS; the South Florida Building amended pursuant to Miami -Dade Count Code ("SFBC01) was Y Ordinance No. 97-107, adopted July 8, 1997 to provide for an amnesty period to allow property owners to bring into compliance additions or repairs to Group I and Group J Occupancies and accessory structures, bui without proper Permits 1t or Permits which had expired issued during the period of October 29, 1957 and July, 1997; and WHEREAS; said Ordinance allows that said repairs or additions be deemed to be in compliance with the SFBC provided CITY COMUSSION MEETING OF MAR 2 3 1999 Resolation 14, 99- 206 r1 S �5 Y Y. the owner furnishes satisfactory evidence to the Building Official that the repairs or additions to the structures satisfy the requirements of the Code in effect on the date such repairs or additions were made; and WHEREAS, the City Commission wishes to adopt and incorporate the provisions set forth in Miami -Dade Ordnance No. 97-107 in order to assure the safety of its citizens, and to identity any structures not properly calculated as part of the City,s tax base; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. An amnesty period, ending December 31, 2000, is hereby established to allow repairs and additions, built without proper permits, or permits which expired without the issuance of certificates of completion from October 29, 1957 through July, 1997, to be brought into conformance with the provisions of the South Florida Building Code in effect at the time the construction of such repairs or additions were made. Section 3. The provisions set forth in Miami -Dade County Ordinance No. 97-107, adopted July 9, 1997, attached hereto and made a part hereof, (which ordinance amended the South Florida - 2 99- 206 CD Building Code) are hereby adopted and incorporated as part of the Building Code of the City of Miami. Section 4. The City Manager is hereby directed to instruct the Building Official of the City of Miami to implement and enforce the provisions of Miami -Dade County Ordinance No. 97-107. Section 5. Warshaw REFERENCES Dade County on 7/8/97 City Manager ENCLOSURES: City Commission Meeting RECOMIVIENDATYON It is respectfully recommended that the City Commission adopt the attached Resolution accepting Ordinance #97-107 adopted by Miami -Dade County on July 8, 1997, and extended though December 31, 2000, establishin Procedures to bring additions or repairs, for Group I and J occupancy, which have not received permits or certificates of completion into compliance with the Code. BACKGROUND Ordinance #97-107, the amnesty ordinance, was adopted by Miami -Dade County. The ordinance is an amendment to the South Florida Building Code (SFBC) which established a procedure to bring additions or repairs which have not received permits or where permits were issued, but did not receive mandatory inspections, into compliance with the South Florida Building Code. Legalization of the structures must take place during the amnesty period and must satisfy the Code in effect at the time that the construction took place. The amnesty period will run until December 31, 2000. The current owner of the property is ultimately responsible for bringing the property into compliance. The ordinance is not only beneficial to the community by giving homeowners an amnesty period in which to come into compliance, but it helps the City in making sure that properties will be brought up to code. Additions/repairs done without permits or certificates are unsafe and a hazard to the community. The Procedures established will not only promote safety in the neighborhoods, but all illegal additions will then become part of the tax base.
