A RESOLUTION BY A FOUR -FIFTHS (4/5ths)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, RATIFYING, APPROVING, AND
CONFIRMING THE CITY MANAGER'S FINDING OF AN
EMERGENCY, WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDS, AND APPROVING THE
EMERGENCY PROCUREMENT OF PRE -EMPLOYMENT
PSYCHOLOGICAL SCREENING & PSYCHOLOGICAL
COUNSELING SERVICES FROM LAW ENFORCEMENT
PSYCHOLOGICAL AND COUNSELING ASSOCIATES,
INC., FOR THE PERIOD JANUARY 1 - APRIL 30,
1999, IN AN AMOUNT NOT TO EXCEED $103,000.00,
FOR THE DEPARTMENT OF POLICE; ALLOCATING
FUNDS THEREFOR FROM THE FY 98/99 POLICE
GENERAL OPERATING BUDGET, ACCOUNT CODE
NOS. 001000.290201.6.260 ($65,000) AND
001000.290201.6.270 ($38,000); FURTHER,
RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S ISSUANCE OF AN EMERGENCY PURCHASE
ORDER FOR THIS SERVICE.
WHEREAS, a Request for Proposals (RFP) has been initiated.
for the procurement of pre -employment psychological screening and
psychological counseling services for the Department of Police;
and
WHEREAS, said RFP process will be completed and is scheduled
for City Commission approval on March 9, 1999, and it is
anticipated a final contract will be executed by April 30, 1999;
and
WHEREAS, during the time from the expiration of the prior
contract and prior to final execution of a new contract, the
Department of Police must continue to provide the above services

for its employees for a four month interim period; and
WHEREAS, the City Manager approved the emergency procurement
of said services for the above time period from Law Enforcement
Psychological and Counseling Associates, Inc.; and
WHEREAS, funding for this expenditure is available from the
FY 98/99 Police General Operating Budget, Account Code
Nos. 001000.290201.6.260 ($65,000) and 001000.290201.6.270
($38, 000) ;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA;
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote,
the members of the City Commission hereby ratify, approve and
confirm the City Manager's finding of an emergency, waiving the
requirements for competitive sealed bids and approve the
emergency procurement of pre -employment psychological screening
and psychological counseling services from Law Enforcement
Psychological and Counseling Associates, Inc., for the period
January 1 - April 30, 1999, in an amount not to exceed
$103,000.00, for the Department of Police, with funds therefor
hereby allocated from the FY 98/99 Police General Operating
Budget, Account Code Nos. 001000.290201.6.260 ($65,000) and

Section 3. The City Manager's issuance of an emergency
purchase order for this purpose is further ratified, approved and
confirmed.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor11.

It is respectfully recommended that the City Commission adopt the attached Resolution ratifying
the City Manager's emergency action authorizing the provision of Psychological Pre -Employment
Screening & Psychological Counseling Services from Law Enforcement Psychological and
Counseling Associates, Inc., in an amount not to exceed $103,000.00.
Funding is available from the Police General Operating Budget, Account Code Nos.
001000.290201.6.260 ($65,000) and 001000.290201.6.270 ($38,000).
BACKGROUND
The Police and Purchasing Departments have initiated the Request for Proposal for these services.
It is anticipated that the RFP process will be completed and scheduled for Commission approval on

services under the same terms, conditions, and pricing, through April 30`�, 1999, or until a new
