A RESOLUTION BY A FOUR FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE MIAMI
CITY COMMISSION, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDING THAT AN
EMERGENCY SITUATION EXISTS, WAIVING THE
REQUIREMENTS FOR COMPETITIVE BIDDING
PROCEDURES, AND APPROVING A CONTRACT TO THE
CONSULTING ENGINEERING FIRM OF BLISS &
NYITRAY, INC., FOR THE PREPARATION OF
CONSTRUCTION PLANS AND SPECIFICATIONS OF
REPAIRS AT THE ORANGE BOWL STADIUM FOR ALL
EXTERIOR PEDESTRIAN RAMPS AND COMPLETE
REMEDIAL STRUCTURAL REPAIRS; AUTHORIZING THE
CITY MANAGER TO SOLICIT INFORMAL BIDS AND
EXECUTE A CONTRACT WITH THE LOWEST RESPONSIVE
AND RESPONSIBLE BIDDER(S) FOR SAID STRUCTURAL
REPAIR WORK; AND ALLOCATING FUNDS THEREFOR,
IN AN AMOUNT NOT TO EXCEED $900,000.00, FROM
CAPITAL IMPROVEMENT PROJECT NO. 324002, AS
APPROPRIATED BY ORDINANCE NO. 11705, AS
AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE
FOR FISCAL YEAR ENDING SEPTEMBER 30, 1999,
FOR SAID PLANS AND REPAIRS.
WHEREAS, the Orange Bowl Stadium ("Stadium"), which was
constructed in 1937, and has had at least five subsequent
expansions, is the City of Miami's premier stadium facility and
currently hosts major football, soccer, entertainment- and civic
events; and
WHEREAS, the Stadium is largely a steel frame structure
subject to the deteriorating effects of subtropical salt air

environment which requires regular inspection and maintenance, -
and
WHEREAS, previous inspections by structural engineering
consultants and Public Works Department engineers indicate a need
to repair the stadium ramps; and
WHEREAS, Bliss & Nyitray, Inc., engineering consultants
experienced in stadium structures, prepared a condition
assessment report, dated December 28, 1998, which indicated that
certain portions of the stadium ramp decking and structural steel
framing members throughout the Stadium present a possible threat
to the safety and welfare of the public; and
WHEREAS, the City Manager has made a written finding that
said repairs constitute a valid public emergency and requires the
immediate procurement of professional services, materials, goods,
and/or equipment to protect the health, safety and welfare of the
public; and
WHEREAS, the Code of the City of Miami, Florida, as amended,
provides for the emergency procurement of required goods and
services in connection with Public Works projects, including
professional design services; and
WHEREAS, the City Manager recommends that the requirements
to negotiate a contract for the services of Bliss & Nyitray,
Inc., consulting engineers, be waived as said firm is most
familiar to provide construction plans and specifications and to
coordinate work with City staff for the bidding and inspection

phases of said repair work for the Stadium; and
WHEREAS, due to time constraints and the specialized nature
of the structural repair work, it is further recommended that
informal solicitations be utilized to procure the needed
services, equipment, goods and/or materials for the construction
associated with the necessary structural repairs; and
WHEREAS, after the receipt of such informal solicitations,
contracts for said construction may be awarded to the lowest
responsive and responsible bidder(s) by the City Manager; and
WHEREAS, the herein Resolution has been the subject of a
properly advertised public hearing before the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By four -fifths (4/5ths) affirmative vote of
the members of the Miami City Commission, the City Managers
finding that a valid public emergency exists, and that the
requirement of formal competitive bidding procedures be waived
are hereby ratified, approved and confirmed for the procurement
of services, equipment, goods and/or materials for the
construction work required for the emergency repair of all

exterior pedestrian ramps and complete remedial structural
repairs throughout the Orange Bowl Stadium.
Section 3. The City Manager is hereby authorizedl/ to
negotiate a contract and execute the necessary professional
services agreement, in a form acceptable to the City Attorney,
with the structural engineering firm of Bliss & Nyitray, Inc.,
for the preparation of constructions plans and specifications for
the aforementioned repairs.
Section 4. Upon receipt of informal solicitations, the
City Manager is hereby authorized to enter into contracts for
said services, equipment, goods and/or materials with the lowest
responsive and responsible bidder(s) for the construction work
required for the emergency repair of all exterior pedestrian
ramps and complete remedial structural repairs throughout the
Orange Bowl Stadium.
Section 5. Funds therefor, in the amount not to exceed
$900,000.00, are hereby allocated from Capital Improvement
Project No. 324002, as appropriated by Ordinance No. 11705, as
amended, the Annual Appropriations Ordinance for Fiscal Year
ending September 30, 1999, for said professional services and
structural repairs.
Section 6. This Resolution shall become effective

2. In addition to No. 1 above, direct B&N to complete Its structural
investigation and prepare construction plans and specifications with
estimates of costs for the repair of the eight (8) exterior ramps and other
structural deficiencies as indicated in B&N's report.
3. Proceed with the solicitation of informal bids once plans and
specifications for Nos. 1 and 2 above have been completed. Execute a
contract and proceed with construction. The repair work will be done in
stages based on B&N's assessment of the existing structural conditions. The
critical repairs will be completed before the commencement of the 1999
football season. The balance of the repair work will resume after the 1999
season has ended. The probable estimated cost for all repairs is as follows:
a)Crltical repairs prior to 1999 football season

and four (4) ramps) $800,000
b)Balance of repairs following the 1991 football season
(miscellaneous repairs
and four (4) ramps) $600,000
Funds to pay for the B&N contract and the actual repair work must be
appropriated for CIP Project No. 324002 as appropriated by Appropriations
Ordinance No. 11705, as amended, for fiscal years 1999 and 2000.

ENCLOSURES:
Based on information supplied to me by the Director of the Department of Public
Works, I have found that a valid EMERGENCY exists at the Orange Bowl Stadium
Justifying the necessity of contracting for professional engineering services with
the consulting firm of Bliss & Nyitray, Inc. (B&N), structural engineers, with primary
offices in the City of Miami, to prepare construction documents for the
replacement of the Orange Bowl Stadium ramp decking, the repair of certain
structural framing, and other miscellaneous structural repairs. Upon completion of
the construction plans by B&N, the required work should then proceed on an
EMERGENCY basis with the solicitation of informal bids to restore structural
integrity at the Orange Bowl Stadium.
on December 28, 1998, B&N completed a preliminary report on the assessment of
the structural conditions of the Orange Bowl Stadium as requested by the
Department of Public Facilities. In that report, B&N addressed thirty-five (35)
locations of concern that could present a threat to the safety and welfare of the
general public attending the stadium. Also in this report, B&N expressed an
opinion that the eight (8) ramps, including both concrete and steel decking,
needed to be replaced. The Director of the Department of Public Works confirms
the existence of these conditions and is in agreement with the findings and
conclusions of the report.
Due to time constraints imposed by the college football season, the magnitude of
the needed repairs and the consideration to protect the welfare and safety of the
users of the facility, we recommend the following emergency action plan to solve
the structural deficiencies at the orange Bowl Stadium:
1. Waive the requirements of Section 18-81 of the Miami City Code and
negotiate a contract with B&N, the structural engineering firm now most
familiar with the structural deficiencies at the Orange Bowl, for the
preparation of construction plans and specifications for the repair of the 35
locations of concern addressed in the aforementioned report.

A Public Hearing will be held by the Commission of the City of
Miami, Florida, on March 23, 1999, at A.M. in the Cit
Commission Chambers at City Hall, 3500 Pan American,Drive, Miami,
Florida, for the purpose of hearing objections from any
interested parties affected by the City Commission's
ratification, confirmation and approval of the City Manager's
finding of an emergency at the Orange Bowl Stadium for the repair
of the exterior pedestrian ramps and other remedial structural
repairs and the waiving of Section 18-81 of the Miami
"Professional Services'' City Code,
by negotiating a contract with the
consulting engineering firm of Bliss & Nyitray, Inc., for
Professional services in connection with the preparation of
construction documents for said repairs and approval by the City
Commission to proceed with informal bids for said repairs at the
Orange Bowl Stadium.
All interested persons are invited to appear and may be heard
concerning the City Manager's finding of an emergency. Should
any person desire to appeal any decision of the City Commission
with respect to any matter considered at this hearing, that
person shall ensure that a verbatim record of the proceedings is
made, including all testimony and evidence upon which any appeal
may be based.

Schedule of Remedial Structural Work
Gentlemen:
Due to the time constraints of developing design documents, limited demolition, unforeseeable
conditions and the University of Miami football schedule it is our recommendation that the remedial
structural work outlined in our Structural Condition Assessment Report submitted February 26, 1999
be accomplished over a two year time period. The work should commence as soon as possible and be
under a single corYtramor with the understanding that the construction will be phased.
The largest single undertaking of this work is the replacement of the eight switchback ramps. We
believe that it is possible to complete four of these this year and the remaining fbur after the 1999
football season ends. During this time period vehicular traffic is to be Dept off ofthese ramps,

Based on the Bliss & Nyitray report and the recommendations of
the Departments of Public Works and Public Facilities, the City
Manager has made a written finding that a valid EMERGENCY, under
the City Code, exists at the Orange Bowl Stadium justifying the
necessity of contracting with Bliss & Nyitray, Inc., the
structural engineering firm currently most familiar with the
structural deficiencies at the stadium, to provide structural
repair plans and specifications and to inspect the repair work.
Upon completion of the construction repair documents by Bliss &
Nyitray, the Department of Public Works will then proceed to have
the repair work done on an EMERGENCY basis with the solicitation
of informal bids from qualified contractors to restore the
integrity of the Orange Bowl structure. After receipt of
informal bids, contracts for the structural repair work will be
awarded to the lowest responsive and responsible bidder(s) by the
City Manager.
Due to the time constraints imposed by the football season, the
most critical structural deficiencies will be repaired prior to
the beginning of the 1999 football season. Immediately following
the end of the football season, the contractor will resume work
to complete the required structural repairs. On the
recommendation of the structural engineers, the use of the ramps
by vehicles and utility carts to stock concession booths or haul
other heavy goods has been halted. The existing ramps can be
used for normal pedestrian use until they are repaired.
Bliss & Nyitray will be paid on an hourly rate basis in
accordance with the "Hourly Rate Schedule for Structural
Engineering Services" in Exhibit "A".
These services will
include the following: investigation of existing stadium plans
and devising structural solutions to specific problems;
preparation of construction repair plans and specifications;
review of contractor submittals; field inspections and to resolve
unforeseen field problems. The City is to administer the bidding
process and the construction repair contract. On a not to exceed
contract basis, the proposed budget for Bliss & Nyitray services
is $65,000.00. The engineer's nrFj i-inary estimate on the cost of
all �tu�tural repairs is roughly $1.5 million.

It is respectfully recommended that the City Commission adopt the
attached Resolution ratifying, confirming and approving the
findings of the City Manager of an EMERGENCY at the Orange Bowl
Stadium to repair the exterior pedestrian ramps and complete
remedial structural repairs to certain structural steel framing
members at various locations throughout the stadium; authorizing
the City Manager to negotiate and execute a contract with Bliss &
Nyitray, Inc., a consulting engineering firm, for the preparation
of construction plans, specifications and inspections on said
repairs and to solicit informal bids and execute a contract with
the lowest responsive and responsible bidder for the structural
repair work.
The Orange Bowl Stadium is the City of Miami's major stadium
facility which hosts a variety of sports and entertainment events
including the University of Miami football games. The stadium was
originally built in 1937 and has had five (5) subsequent
expansions. The structure is largely of structural steel
construction which is subject to the deteriorating effects of a
subtropical salt air. environment. Inspections done in the recent
past by structural engineering consultants and by Public Works
engineers indicate a need to repair the stadium ramps which are
deteriorating due to salt corrosion of the steel deck. The 1998-99
CIP included $250,000.00 in funding to repair the ramps as the
first step in a $1 million, four (4) year repair program.
The latest structural inspection was recently completed by Bliss &
Nyitray, Inc., a structural engineering firm located in the City of
Miami, with extensive national experience in stadium structures.
The report of this inspection, dated December 28, 1998, indicated
that the condition of portions of the stadium ramp decks and steel
framing members are in need of repair and could possibly present a
threat to the safety and welfare of the public if repairs are not
promptly started and completed within the next two (2) years. The
report identified thirty-five (35) locations of concern as well as
the eight (8) exterior pedestrian ramps which need remedial work.
