HomeMy WebLinkAboutR-99-0184J-99-263 3/5/99 RESOLUTION NO. 009 s 184 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE ALLOCATION OF SEVEN THOUSAND DOLLARS ($7,000) OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS, THE COMMERCIAL CODE COMPLIANCE PROGRAM (PROGRAM), PROJECT N0. 799613, TO THE SMALL BUSINESS OPPORTUNITY CENTER, INC., FOR THE REHABILITATION OF ONE (1) BUSINESS, THE CASA PANZA RESTAURANT, LOCATED AT 1620 S.W. 8TH STREET, MIAMI, FLORIDA; IN THE LITTLE HAVANA TARGET AREA; SAID ALLOCATION REPRESENTS 70%- OF THE TOTAL REPAIR COST, WITH THE PROPERTY OR BUSINESS OWNER PROVIDING A 30% MATCH AS HEREIN SPECIFIED; FURTHER PROVIDING THAT THE SMALL BUSINESS OPPORTUNITY CENTER, INC. SHALL PROVIDE CERTAIN SERVICES IN CONNECTION WITH THE PROGRAM. WHEREAS, the City-wide Commercial Code Compliance Program ("Program") was approved pursuant to Resolution No. 95-413, adopted May 25, 1995; and WHEREAS, the Program is designed to promote Commercial Code Compliance in low and moderate income neighborhoods in the City of Miami, and is an important component of the City's economic development strategy; and WHEREAS, the property to be rehabilitated, the Casa Panza Restaurant, located at 1620 S.W. 8th Street, Miami, Florida, in the Little Havana neighborhood, has been cited for plumbing code violations; and WHEREAS, eligibility for assistance under said Program is CM GOIMaSSIO3f NZETHNG OF LIAR z 3 1999 Q X(asolution no. V9J 184 based upon a 70%-30* match, with the City providing 70$ (up to $7,000) per business and the business or property owner providing 30% (up to $3,000) per business, and 100% thereafter to correct said plumbing violations; and WHEREAS, the property requiring compliance has been reviewed by the City of Miami Neighborhood Enhancement Team ("NET") and the Small Business Opportunity Center, Inc., and is eligible for said Program: and WHEREAS, funds for said Program are available from Community Development Block Grant Funds, Commercial Code Compliance Program, Project No. 799613; and WHEREAS, the Small Business Opportunity Center, Inc., has the necessary expertise to provide the services necessary to implement said Program and disburse funds allocated to the participating business, pursuant to a previously executed agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Funds in the amount of seven thousand dollars ($7,000) are hereby allocated from Community Development Block Grant Funds, the Commercial Code Compliance Program, Project No. 799613, to the Small Business Opportunity Center, Inc. ("SBOC"), for the rehabilitation of one (1) business, the Casa Panza 2 Q) 9 -- 184 Restaurant, located at 1620 S.W. Sth Street, Miami, Florida, in the Little Havana Target area, said funds to be disbursed to Casa Panza Restrauant by SBOC for the Project and, upon completion thereof, the SBOC shall present all documents and invoices generated by, or pertaining to, said Project to NET, in accordance with a previously executed document. Section 3. Financial assistance to be contributed by the City pursuant to the Program, shall be based upon a 70% - 30% match, with the City contributing up to a maximum of seven thousand dollars ($7,000) per business and the business or property owner contributing up to 30% ($3,000), and 100% thereafter to correct said plumbing violations. BACKGROUND: Resolution No. 95-413, adopted May 25, 1995, created the Code Compliance Program to assist businesses in blighted neighborhoods in the City of Miami to meet code compliance requirements. The Little Havana NET Office has cited Casa Panza Restaurant, a business in the Little Havana target area, for plumbing violations. The immediate correction of these violations will result in upgraded living conditions and increased benefits to residents in the community. CDBG funds from the Code Compliance Program are available to assist this business in making the necessary repairs to meet the code regulations. Therefore, it is requested that the City of Miami allocate CDBG funds in the amount of $7,000 to the Small Business Opportunity Center, Inc., from the Commercial Code Compliance Program for the business operating at the following property: Business Target Area Violation(s)_ Casa Panza Restaurant Little Havana Plumbing 1620 S.W. 80' Street Miami, FL 33135 77 1W, The Honorable Mayor and Members of the City Commission Page 2 The total contract cost for this project is $10,000. Under the Code Compliance .Program, the City of Miami contributes 70% of the repair costs up to $10,000. The maximum City of Mami contribution is $7,000. The business or property owner will contribute 30% of the repair costs up to $10,000 and 100% of any costs over $10,000. The Small Business Development Authority, Inc. will assume responsibility for completing all pertinent documentation and forward the information to the City of Miami NET, which will ensure that the plumbing violations have been corrected and the property is in compliance with the code. The proposed resolution allocates $7,000 of CDBG funds from the Code Compliance Program to assist Casa Panza Restaurant in correcting code violations at this business located in the Little Havana target area. The City Manager is hereby authorized to amend the City of Miami's FY 1995-96 proposed Consolidated Plan for the City of Miami's CDBG, HOME, ESG, and HOPWA programs as attached to Resolution No. 95-179, adopted March. 9, 1995, in amounts as specified by the City Commission. Section 2.
