HomeMy WebLinkAboutR-99-0163J-99-247 2/23/99 RESOLUTION NO. 9 9 - 163 A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO THE CUBAN MUNICIPALITIES FAIR TO BE CONDUCTED BY THE CUBAN MUNICIPALITIES FAIR CORPORATION ON APRIL 8-11, 1999, ON THE GROUNDS OF THE FLAGLER DOG TRACK; AUTHORIZING AND DECLARING: (1) THAT SAID FAIR SHALL NOT BE CONSIDERED AS ONE OF THE TWO TEMPORARY SPECIAL EVENTS PERMITTED PER SITE PER YEAR, PURSUANT TO SECTION 906.9 OF ORDINANCE NO. 11000, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, (2) AN EXEMPTION FROM THE PROHIBITIONS AND RESTRICTIONS CONTAINED IN SECTIONS 36-4(a) AND 36-5(a) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS THEY RELATE TO THE LEVEL AND HOURS OF NOISE CONCERNING SAID EVENT; CONDITIONING SAID AUTHORIZATIONS HEREIN UPON THE ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH SAID EVENT AND OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Cuban Municipalities Fair (the "Fair") to be conducted by the Cuban Municipalities Fair Corporation on April 8-11, 1999, on the grounds of the Flagler Dog Track, is hereby authorized and shall not be counted as one of the two CITY CONNI33ION METIRG OF FEB 2 3 1999 Resolution No. 99-- 163 temporary special events permitted per site, per year, pursuant to Section 906.9 of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. Section 2. An exemption from the prohibitions and restrictions contained in Sections 36-4(a) and 36-5(a) of the Code of the City of Miami, Florida, as amended, is hereby declared as they relate to the level and hours of noise concerning the Cuban Municipalities Fair, for the hours between 11:00 P.M. and Midnight on April 8 and 9, 1999. Section 3. The herein approvals and authorizations are hereby conditioned upon the organizers paying for all costs of City services and fees associated with said event and obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee. Section 4.
