HomeMy WebLinkAboutR-99-0156L - of J-99-198(a) 2/22/99 RESOLUTION NO. 9 9 A RESOLUTION OF THE MIAMI CITY COMMISSION AFFIRMING THE DECISION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO PERMIT A HEALTH CLINIC IN THE R-3 ZONING DISTRICT FOR THE PROPERTY LOCATED AT APPROXIMATELY 1355 SOUTHWEST 37TH AVENUE, MIAMI, FLORIDA, PURSUANT TO PLANS ON FILE, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A CERTIFICATE OF USE MUST BE OBTAINED AND SUBJECT TO THE CONDITION THAT THE PROPOSED FACILITY BE LIMITED TO OUTPATIENTS ONLY WITH NO OVERNIGHT STAY. WHEREAS, the Miami Zoning Board at its meeting of January 25, 1999, Item No. 1, adopted Resolution No. ZB-1999-0135 by a vote of six to zero (6-0), recommending the granting of a Special Exception requiring City Commission approval as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, finds the application for Special Exception does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special C= CONI USSION MEETING OF FEB 2 3 1999 Resolution No. 99- 156 Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1, The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to permit a health clinic in the R-3 zoning district for the property located at 1355 Southwest 37th Avenue, Miami, Florida, legally described as Lot 2, less the west 10 feet, Block 4, ENGLEWOOD, according to the Plat thereof, as recorded in Plat Book 7 at Page 38 of the Public Records of Miami -Dade County, Florida, is hereby affirmed and the issuance of the Special. Exception is hereby approved pursuant to plans on file, with a time limitation of twelve (12) months in which a Certificate of Use must be obtained and subject to the condition that the proposed facility be limited to outpatients only with no overnight stay.
