A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE EXTENSION OF THE TERM OF THE
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE
CITY OF MIAMI AND WOLFBERG/ALVAREZ &
PARTNERS, INC., FOR AN ADDITIONAL TWO YEAR
PERIOD TO ALLOW SAID FIRM TO COMPLETE THE
DESIGN OF THE NEW RECREATIONAL BUILDING AT
JOSE MARTI PARK; AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, TO SAID AGREEMENT FOR
THESE PURPOSES.
WHEREAS, pursuant to Resolution No. 95-57, adopted January
12, 1995, the Miami City Commission approved the selection of six
(6) engineering firms, including Wolfberg/Alvarez & Partners,
Inc. ("Provider"), to provide general engineering services for
several City projects scheduled for calendar years 1995 and 1996,
and authorized the City to enter into professional services
agreements with said firms, in an amount up to $250,000 each; and
WHEREAS, pursuant to said Resolution, the City and Provider
entered into a professional services agreement dated October 30,
1995 (the "Agreement"), and in accordance with the terms of said
Agreement, the City issued a work order for the design of a new
recreational building at Jose Marti Park (the "Project"), to be
paid from certain grant funds awarded to the City for the
Project; and
WHEREAS, during the design process, the City received

additional grant funds for the Project which permitted the
expansion of the proposed recreational building and necessitated
a complete revision of the design plans; and
WHEREAS, Paragraph 6 of the Agreement states that, in the
event the Provider is engaged in any project on the expiration
date of the Agreement, said Agreement shall remain in effect
until the project is completed, however the Agreement prohibits
the issuance of new work orders beyond the expiration date; and
WHEREAS, pursuant to paragraph 6 of said Agreement, the
Provider has continued to provide the necessary services to
complete the Project, notwithstanding the expiration of the term
of the Agreement; and
WHEREAS, in light of the availability of additional funds
and the expansion of the Project, it is now necessary to issue a
new work order for the revision of the recreational building
design plans; and
WHEREAS, compensation for the additional work is within the
$250,000 limit set forth in the Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Miami City Commission hereby authorizes
the extension of the term of the professional services agreement
between the City of Miami and Wolf berg/Alvarez & Partners, Inc.,

for an additional two year period, to allow said firm to complete
the design, of the new recreational building at Jose Marti Park.
Section 3. The City Manager is hereby authorizedll to
execute an amendment, in a form acceptable to the City Attorney,
to said Agreement for these purposes.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor2l.

i� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

for Jose Marti Park Recreation Building

It is respectfully recommended that the City Commission adopt the attached
resolution authorizing the extension of the professional Services Agreement between
the City of Miami and Wolfberg/Alvarez & Partners, Inc. ("Provider") to allow said firm
to complete the design of the new recreational building at Jose Marti Park; further
authorizing and directing the City Manager to execute an amendment to said
Agreement for this purpose.
BACKGROUND
The Jose Marti Park, located in the eastern portion of Little Havana, is in one of the
poorest neighborhoods of the City of Miami. The park is the most important park in
Little Havana, but presently has no space for indoor recreational activities which
limits the services that can be provided at this park. City staff, working with area
residents, have developed a design program for a new recreational building that will
serve the needs of the residents, especially the youth.
On October 30, 1995, the City entered into a Professional Services Agreement with
Wolfberg/Alvarez & Partners, Inc. , and in accordance with the Agreement, a work
order for a design of a new recreational building at Jose Marti Park was issued.
Funds for this project and other park improvements originally came from the City
Community Development Block Grant (CDBG). After the building design was well
advanced, the City saw the opportunity of obtaining additional funds which will
result in a larger building with added recreational activities. The City staff applied
and obtained additional funds from the Miami -Dade County Safe Neighborhood Park
Bond Program and from the State of Florida Direct Budget Appropriations, in order to
be able to expand the proposed recreational building. The funds available for design
and construction is approximately $1.1 million. This action necessitated a complete
revision of the design plan done by the Provider.

Applying for different funding sources required additional time, which delayed the
project. In order to continue with the revisions of the plans and completion of the
design by the Provider, a new work order is necessary which requires an extension of
the term of the Professional Services Agreement between the City of Miami and
Wolfberg Alvarez & Partners, Inc. We recommended an additional twenty four (24)
months extension to the existing Agreement.
