A RESOLUTION OF THE MIAMI CITY COMMISSION
APPROVING THE ALLOCATION OF FUNDS, IN THE
AMOUNT OF ONE HUNDRED NINETY-EIGHT THOUSAND
EIGHT HUNDRED THIRTY-NINE DOLLARS ($198,839)
IN REHABILITATION ASSISTANCE FUNDING TO
ECONOMIC OPPORTUNITY FAMILY HEALTH CENTER,
INC. IN CONNECTION WITH THE COMPLETION OF A
TWENTY-FOUR UNIT HOUSING PROJECT TARGETED FOR
LOW INCOME PERSONS LIVING WITH HIV/AIDS,
LOCATED AT 7104, 7126, 7160, 7186 N.W. 14TH
PLACE, MIAMI, FLORIDA; ALLOCATING FUNDS FROM
THE FY 1998 HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS (HOPWA) PROGRAM GRANT, ACCOUNT N0.
194006.590606.6860.94654, FOR THE PROVISION
OF SAID SERVICE; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AMENDMENT TO THE
CON
EXISTING TRACT WITH SAID AGENCY TO
EVIDENCE SAID ALLOCATION.
WHEREAS, the Housing Opportunities for Persons With .AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
Of 1992; and
WHEREAS, Section 606 (d) (2) of the Federal Housing and
Community Development Act of 1992 stipulates that the City of
Miami, as the most populous local government in an eligible
metropolitan statistical area (EMSA), not including county
government, must be the applicant for the HOPWA Grant in order
for grant

be awarded; and
WHEREAS, the City of Miami has been awarded funding from the
U.S. Department of Housing and Urban Development (U.S. HUD) for
the implementation of the 1998 HOPWA Program Grant; and
WHEREAS, on March 14, 1998, the City Commission adopted
Ordinance No. 11643, which established a special revenue fund
entitled "Housing Opportunities for Persons With AIDS Grant" and
appropriated $7,732,000 in funding from U.S. HUD for. the
implementation and administration of the 1998 HOPWA Program; and
WHEREAS, on April 14, 1998, the City Commission adopted
Resolution No. 98-402.1, which authorized the City Manager to
submit the City of Miami's FY 1998-1999 Consolidated Plan and the
uses of said HOPWA funds; and
WHEREAS, at the November 6, 1998 HOPWA Advisory Board
meeting, it was recommended that funding, in the amount of
$198,839, for the completion of the rehabilitation of a
twenty-four (24) unit housing project for low income persons
living with HIV/AIDS located at 7104, 7126, 7160, 7186 N.W. 14th
Place, Miami, Florida, be allocated to Economic Opportunity
Family Health Center, Inc.; and
WHEREAS, HOPWA Program funding is available from the City's
1998 HOPWA Program Grant, Account No. 194006.590606.6860.94654
for this purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby approves the
allocation of funds, in the amount of $198,839, to Economic
Opportunity Family Health Center, Inc., for the completion of the
rehabilitation of a twenty-four unit housing project for low
income persons living with HIVJAIDS located at 7104, 7126, 7160,
7186 N.W. 14th Place, Miami, Florida, with funds therefor hereby
allocated from the FY 1998 HOPWA Program, Account. No.
194006.590606.6860.94654.
Section 3. The City Manager is hereby authorized/ to
execute an amendment, in a form acceptable to the City Attorney,
to the contract, with Economic Opportunity Family Health Center,
Inc., to evidence said allocation.
Section 4. This Resolution shall become effective upon

RECOMIIZENDATION:
It is respectfuHy recommended that the City Commission adopt the attached resolution awarding and
allocating $198,839 in rehabilitation assistance funding to Economic Opportunity Family Health
Center, Inc., for the completion of a twenty-four (24) unit housing project targeted for low income
persons living with HIV/AIDS, located at 7104, 7126, 7160, 7186 NW 14`s Place, Miami, Florida.
The attached resolution further authorizes the City Manager to execute an amendment to the existing
contract with said agency for the provision of the aforementioned housing related assistance.
Funding for the said service is being provided from the U.S. Department of Housing and Urban
Development from the FY 1998 HOPWA Program.
BACKGROUND:
At the April I4, 1998 City Commission meeting, through Resolution No. 98-402.1, the City
Commission approved and authorized the City Manager to submit the City of Miami's FY 1998-99
Consolidated Plan for the planned use of funding from the Community Development Block Grant
Program, HOME Investment Partnership Program, Housing Opportunities for Persons With AIDS
Program and the Emergency Shelter Grant Program Approximately $7,732,000 in funding was
awarded to the City of Miami from the U.S. Department of Housing and Urban Development in
connection with the implementation of the City's 1998 HOPWA Program.
At the November 6, 1998 HOPWA Advisory Board meeting, the HOPWA Advisory Board
recommended allocating an additional $198,839 in rehabilitation assistance funding from the FY
1998 HOPWA Program to Economic Opportunity Family Health Center, Inc., for the completion of
a twenty-four (24) unit housing project targeted for low income persons living with HIV/AIDS,
located at 7104, 7126, 7160, 7186 NW 14 Place, Miami, Florida. Funding is available from the

Section 1. The City Manager is hereby authorized to submit the City of Miami's Proposed
Consolidated Plan for Fiscal Year 1998-1999, including a FY 1998 Action Plan with

recommended funding projections for the City's Community Development Block Grant (CDBG),
HOME Investment Partnership (HOME), Emergency Shelter Grant (ESG) and Housing
Opportunities for Persons with Aids (HOPWA) Programs, and a grant application for the four
specified programs, to the U. S. Department of Housing and Urban Development (USHUD).
Section 2. 'The City Manager is hereby authorized, upon approval of the Consolidated
Plan and grants by US HUD, to accept and execute the necessary implementing agreements, in a
form acceptable to the City Attorney.
Section 3. The City Manager is fiutlter authorized' to execute individual contractual
agreements, in a fbhh acceptable to the City Attorney, with the community based neighborhood
organizations, as approved by the City Commission, for the purpose of implementing
neighborhood economic development, social services and housing development programs, for the
amounts specifically approved by the City Commission, with funds therefor allocated from the
aforementioned Community Development Block Grant, HOME Investment Partnerships Program.,
Emergency Shelter Grant, and the Housing Opportunities for Persons with Aids Program..
Section 4. This Resolution shall become effective immediately upon its adoption.

WHEREAS, it is aaticipaied that the U.S. Department of Housing and
Urban
Development (HUD") will award to the City of Miami a grant of S12,655,000 . entitled
"Community Development Block Grant (Twenty -Fourth Year)" to provide community
development activities for the period commencing June 1, 1998, and ending May 31, 1999; and

WHEREAS, the City of Miami Department of Community Development projected thz
program income amounting to S3,000,000 will be generated during the period commencin
June 1, 1998, and ending May 31, 1999, and
WHEREAS, HUD approved the programming of said anticipated program income o
_ S3,000,000 to provide community development activities for the period commencing June 1
1998, and ending May 31, 1999, as set forth in Housing and Urban Development Rules anc
Regulations Subpart 1, Section 570-506, paragraph (c); and
WHEREAS. City of Miami T. Department of Community Development recommends the

$1.5 Million for theL Housing
Rehabilitation Loan Program including delivery cost; $1.4 Million for Miami Capital Development
Inc. Revolving Loan Fund Pro r` gram, including delivery cost; and S 100,000 for BuiIdiag

WHEREAS, it is anticipated that HUD will award to the City of Miami a ..,

WHEREAS, HUD approved the reallocation of S200,000 in HOME prop,, -am income to
be spent on eligible HOME activities in the City of Miami; and
WHEREAS, it is anticipated that HUD will award to the City of Miami a grant of
S501,000 entitled "Emergency Shelter Grant" to provide community development activities for
the period commencing June 1, 1998, and ending May 31, 1999; and
WHEREAS, it is anticipated that HUD will award to the City of Miami a grant of
S7,732,000 entitled "Housing Opportunities for Persons with AIDS" for the period commencing
June 1, 1998, and ending May 31, 1999; and

WHEREAS, the herein Ordinance is a proper vehicle to appropriate the aforesaid grants;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORMA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
_ hereby adopted by 'reference thereto and incorporated herein as if fully set forth in the Section.
Section 2. The following Special Revenue Funds are hereby established and resources are
hereby appropriated as described herein:

Section 3. The herein total appropriation of $28,608,000 shall be used to carry out thosz
Publicly supported physical development activities and those related social, housing or economic
development activities within a reasonable. period of time in accordance with the rules and
regulations governing the Community Development Block Grant, DOME Investment Partnership
Chant, Emergency Shelter Grant, and the Housing Opportunities for Persons with Aids Grant as
approved by the U.S. Department of Housing and Urban Development.
Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of the Ordinance are hereby repealed.
Section S. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
