RESOLUTION NO. 9 9 134
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT, ELECTING TO USE THE UNIFORM
METHOD OF COLLECTING NON -AD VALOREM SPECIAL
ASSESSMENTS FOR THE COST OF SOLID WASTE
SERVICES AND FACILITIES LEVIED IN THE
INCORPORATED AREA OF THE CITY OF MIAMI,
FLORIDA; STATING A NEED FOR SUCH LEVY;
DIRECTING THE TRANSMITTAL OF THIS RESOLUTION;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission intends to use the uniform
method for collecting non -ad valorem special assessments for the
cost of providing residential solid waste services and facilities
to property within the incorporated area of the City of Miami,
Florida, as authorized by Section 197.3632, Florida Statutes, as
amended, because this method will allow such special assessments
to be collected annually commencing in November 1999, in the same
manner as provided for ad valorem takes; and
WHEREAS, the City Commission held a duly advertised public
hearing prior to the adoption of this Resolution, proof of
publication of such hearing being attached hereto as Exhibit A;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Commencing with the Fiscal Year beginning
October 1, 1999 and with the tax statement mailed for such Fiscal
Year, the City intends to use the uniform method of collecting
non -ad valorem assessments authorized in Section 197.3632,
Florida Statutes, as amended, for collecting non -ad valorem
assessments for the cost of providing residential solid waste
services and facilities. Such non -ad valorem assessments shall
be levied within the incorporated area of the City of Miami,
Florida. A legal description of such area subject to the
assessment is attached hereto as Exhibit B and incorporated by
reference.
Section 3. The City Commission hereby determines that
the levy of the assessments is needed to fund the cost of
residential solid waste services and facilities within the
incorporated area of the City of Miami, Florida.
Section 4. Upon adoption, the City Clerk is hereby
directed to transmit a copy of this Resolution by United States
mail to the Florida Department of Revenue, the Miami -Dade County
Tax Collector, and the Miami -Dade County Property Appraiser by
March 1, 1999.
Section 5. This Resolution shall evidence the City of
Miami's written agreement to reimburse the Miami -Dade County Tax
Collector and the Miami -Dade County Property Appraiser for all

necessary administrative costs and the actual collection costs
associated with the City of Miami's use of the uniform method of
collecting non -ad valorem assessments as provided for and
authorized in Section 197.3632, Florida Statutes, as amended.
Section 6. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor11.

It is respectfully recommended that the City Commission adopt the attached Resolution
allowing for the use of the Uniform Method of Colle ting Non -Ad Valorem S Assessments for the cost of solid waste services. ecial
BACKGROUND
Currently, solid waste fees are collected through two separate billings per year. Approval
of the proposed resolution would allow this fee to be placed on the property tax bill as a
non-advalorem assessment thereby eliminating the two separate billings.
There are a number of advantages to such a change. First, there will be a net positive
financial impact to the City of approximately $127,000 along with increased efficiency
for the City's Customer Services Department.
Second, for those residents whose taxes are paid through mortgage companies, the
financial burden would be spread over a 12-month period versus twice per year. While it
is true residents who pay their taxes directly could potentially be adversely affected, there
are alternatives to lessen the impact. As previously pointed out by Commissioner Gort,
the County offers a program that allows the entire property tax bill to be paid quarterly.
Residents who experience hardships would be encouraged to take advantage of this
program.
Finally, we are sensitive to the issues previously raised by the Commission. I want to
assure you that the City will be actively involved in the process. We will maintain our
own database and transfer data to the County to reduce the potential of billing errors.
When questions or issues arise, the City's Customer Services Department will continue to
be the contact source for assistance.
