A RESOLUTION OF THE MIAMI CITY COMMISSION
STRONGLY URGING THE DEVELOPER OF THE SITE
LOCATED AT THE MOUTH OF THE MIAMI RIVER,
KNOWN AS THE MIAMI CIRCLE, TO RECOGNIZE SAID
PROPERTY'S POTENTIAL FOR HISTORIC
SIGNIFICANCE AND TAKE ALL STEPS POSSIBLE TO
COOPERATE IN THE PRESERVATION OF SAID SITE
AS IS.
WHEREAS, discovery of momentous archeological indicia at a
site located at the mouth of the Miami River may be of profound
historical. significance; and
WHEREAS, the site, known as the Miami Circle, has heightened
community appreciation and awareness of the legacy of the
Tequesta Indians which could conceivably be reflected by
archeological objects on the site; and
WHEREAS, while the City Commission recognizes and
appreciates the property rights of the developer of the site, it
is gravely concerned that the imminent development planned and
permitted on the Miami Circle may forever destroy irreplaceable
historical treasures which may be located at the Miami Circle;
and
WHEREAS, the City Commission desires that the developer of
the site take extraordinary measures to assure the preservation
of all artifacts on the site and of the historical site itself

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The developer of the site located at the
mouth of the Miami River, known as the Miami Circle, is hereby
strongly urged to recognize said property's potential as a
historically significant site, as is.
Section 3. Further, the developer of the property is
strongly urged to voluntarily cooperate with archeologists to
ensure that mutually beneficial development and research
timelines are obtained.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/ i

In anticipation of the Commission's decision to convene a discussion today (4:00
p.m. in the Chambers), Mayor Penelas requested that I summarize they ,

advantages and disadvantages of various alternatives surrounding the Miami;
Circle archaeological discovery. Mayor Penelas has also asked me to identify r
funding for the mold of the Circle, which is essential to a majority of the options.
The estimated cost of the mold is $38,000, and I will report to the Board later on
possible funding sources.
There has been considerable work done since the last meeting of the ad hoc task E
force that the Commission directed me to chair. These actions include the
identification of eminent national and state archaeological authorities,
discussions by the Mayor, Manager and staff with federal leaders, Governor
Bush, Secretary of State Harris, Mayor Carollo, City of Miami Manager Donald
Warshaw, Native -American leaders, foundations, the developer and legal
counsel, etc. In addition, Mayor Penelas has expressed his desire that, whatever
action is decided upon by the County Commission, collaborative participation
would be sought from the City of Miami, the Governor's office, and possibly
federal authorities.
Attached you will find a table of advantages and disadvantages for options
regarding the Miami Circle. As part of that attachment is a list identifying
potential funding sources. We are continuing to research funding options and
expect to refine that information over the next several days.

People's Petition to create a Heritage Park on the site of the Miami River Circle
We the undersigned believe that the preservation of historical treasures and archaeological sites is critical to our
community's sense of place and identity and should be preserved for posterity to serve as an important
educational and cultural resource to the world. We hereby petition the Govenor of the State of Florida and the
members of the State Legislature to allocate the necessary funds to create a Heritage Park on the site where
archaeologists have uncovered the Miami River Circle, a prehistoric stone circle carved into the bedrock
limestone on the site of an ancient Tequesta Indian Village,

RE: "Miami Circle" Donation to the City of Miami
Dear Mr. Baumann:
It is with pleasure and great appreciation that I send you this letter confirming
your public-spirited offer and commitment to donate that certain archaeological
artifact commonly known as the "Miami Circle" (Artifact"). The Artifact was
discovered and is presently situated upon property located at approximately
401 Brickell Avenue (a/k/a "Brickell Point) in the City of Miami ("City").
You have graciously agreed, at your expense, to utilize archaeologists to
carefully excise and relocate the Artifact to a site to be identified by the City.
Further, you have advised me that the legal title to the Artifact shall be
transferred to and at no cost to the City, for the City to hold in perpetuity as a
public treasure for the general welfare, wonder, appreciation and understanding
of all humanity.
Again, please accept my wholehearted appreciation, on behalf of the citizens of
Miami. Final acceptance of your generous offer and any site designated in the
City for relocation of the Artifact is, of course, subject to an affirmative vote of
the City Commission. -
