A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AFFIRMING THE DECISION OF
THE ZONING BOARD THEREBY GRANTING A SPECIAL
EXCEPTION FROM THE ZONING ORDINANCE OF THE
CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION
401, SCHEDULE OF DISTRICT REGULATIONS, TO
PERMIT A DRIVE THR.0 FACILITY FOR A PROPOSED
RESTAURANT WITH SIX (6) SPACES BEFORE THE
WINDOW (EIGHT (8) SPACES REQUIRED), FOR THE

WHEREAS, the Miami Zoning Board at its meeting of December
7, 1998, Item No. 5, adopted Resolution No. ZB 1998-0121 by a
vote of eight to zero (8-0), recommending the granting of a
Special Exception requiring City Commission approval as

hereinafter set forth; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of. Miami, requires City Commission approval
of the Special Exception as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter, finds the application for Special Exception does
meet the applicable requirements of Zoning Ordinance No. 11000,
as amended, and deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to
affirm the decision of the Zoning Board and grant the Special.
Exception as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Zoning Board to grant a
Special Exception from Ordinance No. 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, Article 4,
Section 401, Schedule of District Regulations, to permit a drive
through facility for a proposed restaurant with six (6) spaces
before the window (eight (8) spaces required) for the property
located at 3535 Coral Way, Miami, Florida, legally described as
shown as Exhibit "A" attached hereto and made a part hereof
subject to plans on file, with a time limitation of twelve months
in which a building permit must be obtained and subject to: (1) a
new plan which depicts a fence restricting access through the

review and approval by the planning department prior, to the
issuance of any building permits, (2) the landscape plan shall be
implemented in its entirety prior to the issuance a certificate
of occupancy and said plan shall be augmented with larger
specimens of shade trees to the maximum extent possible, (3) all
employee and patron parking shall be retained on site, (4) all
parking area lighting shall be directed away from the adjacent
residential area, and (5) the existing wall that separates
residential from commercial is to remain with the new wall, as
required, to be placed on the commercial side, is hereby affirmed
and the Special Exception is Granted.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor-'/.

ANALYSIS FOR SPECIAL EXCEPTION
3535 Coral Way.
Case No. 1998-0145
Pursuant to Section 931.2 of Ordinance 11000, as amended, The Zoning Ordinance of
the City of Miami, Florida, the subject proposal has been reviewed for drive-thru that
does not meet the minimum reservoir spaces required as follows:
Required reservoir spaces before window - 8
Proposed reservoir spaces before window - 6
The following findings have been made:
• It is found that upon review of the statistical information provided by the applicant,
the requested reduction of reservoir spaces from 8 spaces to 6 spaces will not have a
significant detrimental effect on the proposed establishment; any potential adverse
effect will occur during the peak lunch hour period when the stacking is heaviest; the
parking spaces depicted at the northermnost portion of the site should be reserved for
employees during this period so that they are not impacted (or blocked) by potential
stacking overflows.
It is found that use is compatible with the area and will be beneficial by providing a
needed service to the community, and it is also found that the use is in scale and
character with the surrounding area.
• It is found that the proposed layout provides adequate parking and circulation
however, the access depicted could be problematic and may have an adverse impact
on the adjacent low -density residential area by allowing vehicles to cut through the
parking lot into the adjacent neighborhood; this could be remedied by providing a
fence of some sort to prohibit such vehicular movements.
• It is found that the proposed landscape plan is adequate, however specimen sizes
should be increased to the extent possible in order to provide a more mature natural
setting in keeping with the location of this project on Coral Way.
• It is found that the parking area lights may have an adverse effect on the adjacent low -
density residential area by spilling bright lights into single family homes; this could
be averted by ensuring that all parking area lights are directed away from the adjacent
residential area.

It is found that upon compliance with the conditions set forth below, this project will
not have any adverse impacts on the surrounding area.
Based on these findings, the Planning Department is recommending approval of the
application subject to the following conditions:
1. A new plan which depicts a fence restricting access through the property and
into the adjacent neighborhood must be submitted for review and approval by
the Planning Department prior to the issuance of any Building Permits.
2. The proposed landscape plan shall be implemented in its entirety prior to the
issuance of a Certificate of Occupancy; said landscape plan shall be augmented
with larger specimens of shade trees to the extent possible.
3. All employee and patron parking shall be retained on site.
4. All parking area lighting shall be directed away from the adjacent residential
area.

I move that the request on Agenda Item # be (DENIED)
(GRANTED) in that the requirements of Artie e 16 (WERE) (WERE
NOT) satisfied by relevant evidence in the record of the public hearing.
(a) as stated in the City's findings of fact, or
(b) as demonstrated by the petitioner, or
(c) on the basis of the following:
The Zoning Board, in its decision to (GRANT) (DENY) the special
exception, shall make written findings that the applicable requirements of
this Zoning Ordinance, Section 2305, (HAVE) (HAVE NOT) been met.
(CIRCLE APPROPRIATE CONDITIONS)
1305.1 Ingress and Egress.
Due consideration shall be given to adequacy of ingress and egress to
the property and structure and uses thereon, with particular reference to
automotive and pedestrian safety and convenience, traffic flow and
control, and access in case of fire and emergency.
1305.2 Offstreet Parking and Loading
Due consideration shall be given to offstreet parking and loading
facilities as related to adjacent streets, with particular reference to
automotive and pedestrian safety and convenience, internal traffic flow
and control, arrangement in relation to access in case of fire or other
emergency, and screening and landscaping.
1305.3 Refuse and Service Areas.
Due consideration shall be given to the location, scale, -design, and
.screening of refuse and service areas to the manner in which refuse is to
be stored, and to the manner and timing of refuse collection and deliveries,
shipments, or other service activities, as such matters relate to the location
and nature of uses on adjoining properties and to the, location and
character of adjoining public ways.
1305.4 Signs and Lighting.
Due consideration shall be given to the number, size, character,
location, and orientation of proposed signs, and of proposed lighting for
signs and premises, with particular reference to traffic safety, glare, and
compatibility and harmony with adjoining and nearby property and the
character of the area

1305.5 Utilities.
Due consideration shall be given to utilities required, with particular
reference to availability and capacity of systems, location of connections,
and potentially adverse appearance or other adverse effects on adjoining
and nearby property and the character of the area.
1305.6 Drainage.
Due consideration shall be given for drainage, with particular reference
to effect on adjoining and nearby properties and on general drainage
systems in the area. Where major drainage volumes appear likely and
capacity of available systems is found marginal or inadequate,
consideration shall be given to possibilities for recharge of groundwater
supply on the property, temporary retention with gradual discharge, or
other remedial measures.
1305.7 Preservation of Natural Features.
Due consideration shall be given to provision for the preservation of
existing vegetation and geological features whenever possible.
1305.8 Control of Potentially Adverse Effects Generally.
In addition to consideration of detailed elements indicated above, as
appropriate to the particular class or kind of special permit and the
circumstances of the particular case, due consideration shall be given to
potentially adverse effects generally on adjoining and nearby properties,
the area, the neighborhood, or the City, of use or occupancy as proposed,
or its location, construction, design, character, scale or manner of
operation. Where such potentially adverse effects are found,
consideration shall be given to special remedial measures appropriate in
the particular circumstances of the case, including screening or buffering,
landscaping, control of manner or hours of operation, alteration of use of
such space, or such other measures as are required to assure that such
potential adverse effects will be eliminated or minimized to the maximum
extent reasonably feasible, and that the use of occupancy will be
compatible and harmonious with other development in the area to a
degree which will avoid substantial depreciation of the value of nearby

The undersigned represents Tricon Global Restaurants
("Tricon"), the lessee of a portion of the subject parcel. Tricon
proposes to place a completely rebuilt Kentucky Fried Chicken
outlet on property that already contains a Kentucky Fried Chicken
restaurant. The proposal, as illustrated on the attached plans
prepared by Zamora & Associates, illustrates a plan which otherwise
meets the criteria in the City of Miami Zoning Ordinance and
provides sufficient parking and open space. The proposed auto

Thank you for meeting with me on November 4 for the purpose of
discussing the upcoming zoning application as titled above.
Enclosed please find statistics from Kentucky Fried Chicken
outlets in Miami, Tampa, and Raleigh, North Carolina. The Miami
store is located at 3515 NW 7 Avenue within the City. These
statistics are submitted in an effort to illustrate the efficiency
of the new KFC outlets, which feature certain speed of service
enhancements not previously available in the market place. The
statistics illustrate a seven day review of statistics for each
location. To better understand the statistics, please note that
along the left hand column, the 712.5 minute" column indicates the
percentage of vehicles served in a drive-thru capacity in less than
2.5 minutes, while the 115 minute" column indicates the percentage
of vehicles whose drive-thru time exceeded 5 minutes. As you can
see, the number and percentage of cars waiting more than 5 minutes
is quite small for each of these locations, with the busy periods
generally occurring during the expected lunch and dinner rush
hours. We believe that this information supports our contention
that the plans as designed for this application will provide
sufficient stacking area for drive-thru patrons. In addition, in
an effort to alleviate any backup arising during peak customer
periods, please note that the applicant would accept a condition
requiring that employees park in the three parking spaces located
adjacent to the northeast corner of the restaurant building (the
area that might be affected during peak customer periods) during
peak hour periods.

During our meeting, we also discussed the issue of cross -
parking and adequate easements between the leased KFC parcel and
adjacent properties. Please be advised that since the leased KFC
parcel and the easterly adjacent parcel remain under one unified
ownership, that no special exception for shared access is required
at this time. With respect to the shared access planned in the
westerly property area adjacent to the Walgreens parcel., please be
advised that shared parking is planned in that area as well;
however, since development plans for the westerly adjacent parcel
are not immediately available, the applicant in this matter has
decided to proceed with the application for a variance of stacking
spaces only. As noted above, however, it is the intention of the
applicant (indeed, a practical necessity), to effectuate cross -
access in the area to the east as depicted on the plans
concurrently with development and to effectuate cross -access to the
west at the earliest practical time.
