BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following individuals are hereby appointed as members of the Citywide Community Development Advisory Board, each to serve a term expiring May 5, 1999, or until the nominating Commissioner leaves office, whichever occurs first: Radames Peguero Vice Chairman Wifredo Gort Frankie Rolle Chairman J.L. FLORIDA INTER -OFFICE MEMORANDUM 48 DATE: December 16, 1998 FILE SUBJECT: Citywide Community Development Advisory Board REFERENCES: January 12, 1999 Agenda ENCLOSURES: fist of Members, Resolution The Citywide Community Development Advisory Board was created to advise the City Commission on community development and housing needs. The board will be responsible for providing a leadership role in encouraging target area -wide resident participation in the citywide grant process as follows: (1) Promoting interest in grant activities in the target areas; (2) Providing residents with an opportunity to discuss community concerns and related issues; (3) Providing an opportunity for City residents to identify community needs; (4) Facilitating two-way communication with government representatives and target area residents, and assisting the City in communicating its program services and benefits to residents; (5) Recommending priorities for community improvements; (6) Reviewing the progress of community improvement activities; and (7) Conducting public meetings. City Code Section 2-886, attendance requirement, states in part: "...any board member shall be automatically removed if, in a given calendar year: (1) He or she is absent from three consecutive meetings; or (2) He or she is absent from four of the board's meetings... ...The provisions of this section may be waived by a four -fifths vote of the members of the full city commission." City Code Section 2-884, membership on boards, states in part: "(b) Unless the city commission by four -fifths vote of its membership waives the requirement that board members either reside .in the city, own real property in he city or maintain a business in the city, any member of a city board who ceases to own real property or maintain a business in the city during the term of his or her office shall immediately advise the city clerk. The city clerk shall infonn the city commission whenever a board member has ceased to be in compliance with said eligibility requirements for board membership and said board member shall be automatically removed from the board." Three appointments are needed at this time: • Vice Chairman Gort has one nomination: for vacant seat created because James Simmons was excessively absent. • Chairman Plummer has one nomination for vacancy created because Mario Gutierrez does not comply with the City residency requirement. • The Commission at -large has one appointment for vacancy created because Frankie Rolle, elected to represent the Coconut Grove target area has been excessively absent. Any of the individuals listed above may be reappointed by a four -fifths vote of the City Commission. There are eight members xvho are elected to represent target areas, whose terms have all expired. The Department of Community Development is currently in the process of restructuring this board and will have a proposal. for Commission consideration in the future. For your information, attached please find a cop}, of the current membership to said board. By copy of this memorandum, we are requesting the Agenda Office place this issue on the January 12, 1998 Commission agenda. Abella REFERENCES Assistant City Attorney ENCLOSURES You have asked for this office's interpretation of Sec. 2- 430 of the code of the City of Miami as to whether or not the provisions of said Code section apply to those members of the Citywide Development Advisory Board who are representatives from community development target areas of the City. The answer to your question is in the affirmative. Sec. 2-430 of the City Code, which sets forth the attendance requirements applicable to all City boards, provides in pertinent part: "Sec. 2-430. Attendance requirements. Notwithstanding any other provisions of this code, any board member shall be automatically removed if in a given calendar year: (1) he or she is absent from three (3) consecutive meetings; or (11) if he or she is absent from four (4) of the board's meetings, (iii) provided that regardless of their compliance with subsection (i) and (ii) hereinabove, members must attend at least fifty (50%) percent of all the board meetings held during a year...". It is this office's opinion that Sec. 2-430 of the City Code applies to all those individuals appointed by the City Commission to membership of City boards. Resolution No. 86-47, adopted January 23, 1986, as amended by Resolution No. 87-1006, adopted November 19, 1987, sets forth the requirements for membership to the Citywide Community Development Advisory Board, providing in pertinent part: Section 2. March 23, 1995 Page Two membership is hereby created to advise the City Commission on community development and housing needs: - One representative (resident or property owner) from each eight Community Development target areas, to be appointed by the City Commission. - Ten representatives to be appointed by the City r Commission, providing each Commissioner with twos= appointments to the Community Development Advisory Board." J Since pursuant to Resolution No. 87-1006, the City 4/ Commission has the power of appointment over the members of the Citywide Community Development Advisory Board, the provisions pertaining to the removal of board members contained in Sec. 2- 430 of the City Code apply to said board members.
