HomeMy WebLinkAboutR-99-00381 0 9 J-99-110 1/12/99 RESOLUTION NO. 99 9 ` v 8 A RESOLUTION BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MIAMI CITY COMMISSION APPROVING THE REQUEST OF THE MIAMI SPORTS AND EXHIBITION AUTHORITY ("MSEA") BY AUTHORIZING THE CITY ATTORNEY, ON BEHALF OF MSEA, TO RETAIN THE LAW FIRM OF DAVIS WEBER & EDWARDS TO REPRESENT MSEA IN THE CASE OF DECOMA, LTD-, A TEXAS LIMITED PARTNF`RSHTP VS CTTY 09 MIAMI, A FLORIDA MIMI PAT CORPORATIONO -AM MIAMI SPQRTS AND ETTON AUTHORITY, CASE NO. 96-12055 CA 04 IN THE CIRCUIT COURT OF THE ELEVENTH JUDICIAL CIRCUIT, IN AN AMOUNT NOT TO EXCEED $30,000, PLUS COSTS AS APPROVED BY THE CITY ATTORNEY; ALLOCATING FUNDS THEREFOR FROM THE MSEA OPERATING ACCOUNT, NO. 0189001117384. WHEREAS, at the December 16, 1998 meeting of the Miami Sports and Exhibition Authority ("MSEA"), Meeting No. 159, it was deemed timely and in the best interest of the City of Miami. and MSEA to request approval of the City Commission for the City Attorney to retain the law firm of Davis Weber & Edwards to represent MSEA in the above cited lawsuit; and WHEREAS, pursuant to Section 2-1018 of the Code of the City of Miami, Florida, as amended, retention of said law firm and the terms and conditions thereof require approval by a four -fifths CITY COTMMSSIOII MEETING OF Resolution No. (4/5ths) affirmative vote of the members of the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Miami City Commission, by a four -fifths (4/5ths) affirmative vote, hereby approves the request of the Miami Sports and Exhibition Authority ("MSEA") and hereby authorizes the City Attorney, on behalf of MSEA,, to retain the law firm of Davis Weber & Edwards to represent MSEA in the case of Decoma , Ltd , a Texas limited Dar np_rs i jp va City of Miami-, A Florida m nicipal cornorat_jnn., and Miami Sports and Exhibition A» or; v, Case No. 96-12055 CA 04 in the Circuit Court of the Eleventh Judicial Circuit, in an amount not to exceed $30,000, plus costs as approved by the City Attorney, with funds therefor hereby allocated from the MSEA Operating Account, No. 0189001117384. Section 3. This Resolution shall become effective - 2 - 99- 38 immediately upon its adoption and signature of the Mayor-/.
