A RESOLUTION OF THE MIAMI CITY COMMISSION
EXTENDING FOR THIRTY (30) DAYS FROM THIS DATE,
THE TIME FOR WHICH THE PLAT ENTITLED "RITZ
CARLTON", A PROPOSED SUBDIVISION IN THE CITY
OF MIAMI, FLORIDA, ACCEPTED BY THE CITY
COMMISSION PURSUANT TO RESOLUTION NO. 98-752,
MUST BE RECORDED IN THE PUBLIC RECORDS OF
MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, pursuant to Resolution No. 98-752, adopted July 21,
1998, the City Commission accepted the plat entitled "Ritz
Carlton", accepted the dedications shown on said plat, authorized
and directed the City Manager and City Clerk to execute said
plat, and further provided for the recordation of said plat in
the Public Records of Miami -Dade County, Florida; and
WHEREAS, Section 55-8(e), of the Code of the City of Miami,
Florida, as amended, requires the owner of the property being
platted to cause the recordation of said plat by Miami -Dade
County, in the Public Records of Miami -Dade County, Florida,
within 120 calendar days of the approval of the plat by the City
Commission; and
WHEREAS, the owners of the "Ritz Carlton" plat property did
not cause the recordation of the said plat by Miami -Dade County
in the Public Records of Miami -Dade County, Florida, within the

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution
rescinding Resolution No. 98-752, which accepted the plat of RITZ CARLTON. The plat
of RITZ CARLTON being a proposed subdivision in the City of Miami.
BACKGROUND:
On July 21, 1998, the City Commission adopted Resolution No. 98-752, accepting the
plat of RITZ CARLTON, and accepting the dedications shown on said plat; authorizing
and directing the City Manager and City Clerk to execute the plat; and providing for the
recordation of said plat in the Public Records of Miami -Dade County, Florida.
After the plat's acceptance by the City Commission, it was forwarded to Miami -Dade
County for recordation; and the Department of Public Works, through its letter of October
5, 1998, advised the owners of the subdivision property that the plat had to be recorded
within 120 calendar days of its approval by the City Commission, or it would be in default
and deemed abandoned. Subsequently, the property owners did not proceed with the
recordation of the plat by Miami -Dade County in the Public Records of Miami -Dade
County,. Florida.

A RESOLUTION, WITH ATTACHMENT(S), ACCEPTING THE
PLAT ENTITLED RITZ CARLTON, A SUBDIVISION IN THE CITY
OF MIAMI, SUBJECT TO ALL OF THE CONDITIONS OF THE
PLAT AND STREET COMMITTEE, AND ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT; AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE THE PLAT; AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF
MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends the acceptance of
the plat entitled Brickell West, a subdivision in the City of Miami, subject to certain.
conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1 The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The plat entitled RITZ CARLTON, is a subdivision of the property
described on the attached Attachment 1, which plat by reference is made a part hereof as
if fully incorporated herein, and, subject to all of the conditions required by the Plat and
Street Committee as set forth as Exhibit "A" attached hereto is hereby accepted. The
dedications shown on the plat together with the dedications to the perpetual use of the

public of all existing and future planting, trees, and shrubbery on said property, are also

Miami -Dade County, Florida.
Section 3. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor'.

Re: RITZ CARLTON -NEW TENTATIVE PLAT #1517•-A
The City of Miami Plat and Street Committee, at Its meeting of March 5, 1998,
approved the above tentative plat subject to the following revisions being made
to the tentative plat, additional information being provided and/or variances
being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied:
• Show centerline of adjacent streets in main sketch.
• Parking lot encroachment needs to be removed or a bond with appropriate
Insurance until December, 2000 needs to be provided, unless extended by
Public Works Director.
• A unity of title will be required for bank building.
• Opinions of Title will be required for roadway vacations. Provide square
footage of area to be vacated and legal descriptions. Provide a statement
from a Florida attorney addressing the Issue of reversionary rights with regard
to the vacation and closure of the streets. This statement must be provided at
the public hearing before the Miami Zoning Board.
• Provide an express purpose statement.
• Reference section line as centerline. Also reference monument line.
• Two (2) new fire hydrants will be required.
• A 20-foot emergency access easement will be required between Tigertail
Avenue and S.W. 27 Avenue.
• Remove building encroachment on S.W. 27 Avenue or post bond along with
appropriate insurance.

• Several interior buildings encroach across tract lines. Provide a unity of title
for same.
• Provide square footage for each tract.
• The Plat and Street Committee in reviewing the request to close Cornelia Drive
and Greenwood Road has considered the public interest requirements as found
In Chapter 55 of the Miami City Code. These requirements having been met,
the Plat and Street Committee recommends the vacation and closure of these
two (2) rights of way.
in addition to the above requirements, You should be aware of the following:
1. State and local laws require the installation of various physical improvements in
the public rights-of-waY when property is platted. These subdivision
improvements include paving, drainage, landscaping, sidewalks, etc. in some
cases this could represent a substantial investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary
sewers, electric, telephone, water, etc., caused by this plat will be at the
property owners expense. Also, utility easements may be required on the
property being platted.
3. A building permit wili'not be issued on the property being platted until the
final plat is recorded. Also, the Certificate of occupancy for any building
construction will be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit.
S. Additional items must be provided to the City of Miami Department of Public
Works before the final plat is submitted to the City Commission for approval.
You will be notified in writing as to what these items are after the amount of
the bond has been determined for the necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat
and Street Committee meeting at which time it was approved.
