HomeMy WebLinkAboutR-99-0024,tf 44 F'- J-99-16 12/16/98 n RESOLUTION NO. O �� A RESOLUTION TO TEMPORARILY RESTRICT VEHICULAR ACCESS TO S. W. 2 COURT AT ITS INTERSECTION WITH S. W. 18 ROAD IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE PROVISIONS CONTAINED HEREIN. WHEREAS, the property owners abutting Southwest 2 Court, between Southwest 18 Road and I-95 have petitioned the City to restrict vehicular access to S.W. 2 Court at its intersection with S.W.18 Road; and WHEREAS, the petition sets forth concern about unsafe conditions within this poorly developed right-of-way; and WHEREAS, the Police Department, Fire -Rescue Department and General Services Administration/Solid Waste Department have been notified of the proposed vehicular access restriction of S. W. 2 Court and have expressed no objection to the restriction; and WHEREAS, the proposed vehicular access restriction shall be accomplished by the placement of a fence across S. W. 18 Road; and WHEREAS, Section 54-16 of the Code of the City of Miami, Florida, as amended, ("City Code") gives the City Commission the power, after a properly advertised public hearing, to recommend that vehicular access to a particular street be restricted at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on this date to hear objections to said course of action on a temporary basis and no objections of substance were voiced by participants; and WHEREAS, the City Commission finds that the herein restriction should be instituted until such time as S. W. 2 Court is closed and vacated in accordance with the subdivision regulations contained in Chapter 55 of the City Code, or until such time as the Director of the Department of Public Works makes a finding that S. W. 2 Court should be reopened to vehicular access; and WHEREAS, the City Commission finds that the herein - 2 - 39-- 24 �� .�, ,, .r1 ..� �, ...g y� . _ y. r y prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section i. Warshaw REFERENCES City Manager ENCLOSURES: The purpose of the January 12, 1999 public hearing is to hear comments and consider a Resolution authorizing the restriction of vehicular access to S. W. 2 Court at its intersection with S. W. 18 Road. BACKGROUND S. W. 2 Court between S. W. 18 Road and 1-95 is a very short and poorly developed f public right of way with a substandard pavement width in poor condition. Very I little vehicular and pedestrian traffic utilizes this roadway. k r The property owners ad,iacent to this roadway have recently developed a new shopping center and have tentative approval to replat and close S. W. 2 Court. Since the replatting process will take several months to complete, these property I owners are very concerned about security, public safety and illegal dumping on S. W. 2 Court and have requested that access to S. W. 2 be temporarily restricted e until completion of the platting process. It is respectfully recommended that the restriction to vehicular access be implemented on a temporary basis until such time that the right of way is closed and vacated in accordance with the City Code or until such time that the Director of the Public Works Department makes a finding that S.
