J-99-47 12/31/98 V2 C1 3 RESOLUTION NO._f A RESOLUTION OF THE MIAMI CITY COMMISSION AtTI'HORIZING THE CITY MANAGER TO ENGAGE THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT (FDLE) FOR THE PURPOSES OF: 1) CONDUCTING BACKGROUND INVESTIGATIONS ON INDIVIDUALS PARTICIPATING IN JOB TRAINING PROGRAMS FOR POSSIBLE EMPLOYMENT WITH THE CITY OF MIAMI, UNDER THE MIAMI -DADE/MONROE COUNTY WAGES COALITION AND, 2) CONDUCTING BACKGROUND INVESTIGATIONS AND CREDIT CHECKS ON INDIVIDUALS, OFFICERS AND OWNERS OF COMPANIES REQUESTING LOANS FROM THE CITY OF MIAMI; ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $25,000, FROM 24TH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT ADMINISTRATIVE FUNDS, PROJECT NO. 799302-452423. WHEREAS, the City of Miami has received funds from the Miami-Dade/Monroe County Work and Gain Economic Self -Sufficiency (WAGES) Coalition to assist City residents impacted by welfare reform actions to qualify for employment with the City of Miami; and WHEREAS, the City of Miami and the WAGES Coalition have established a job training program for said residents for the above purpose and in compliance with funding specifications; and WHEREAS, background investigations and ancillary tests are required prior to becoming a City employee; and WHEREAS, additional pre -employment testing required for the above program's newly qualified applicants will CITY co?msslom MEETING OF Resolution No. 0 F R,� E necessitate the services of the FDLE; and WHEREAS, the City of Miami Commission, at the December 81 1998 Commission Meeting, requested that similar background investigations and credit checks be conducted on individuals, officers and owners of companies requesting loans from the City of Miami; and WHEREAS, these background and credit check services are outside of the purview of the City of Miami's Department of Human Resources and can be performed by the FDLE in a timely manner; and WHEREAS, funding for this service is available from 24th Year Community Development Block Grant .Administrative Funds, Project No. '799302-452423; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to engage the Florida Department of Law Enforcement (FDLE) for the purposes of: i) conducting background investigations on individuals participating in job training programs for possible employment with the City of Miami, under the Miami-Dade/Monroe County WAGES Coalition and, 2) conducting background investigations and credit checks on individuals, officers and owners of companies requesting loans from the I 9 9 13 F�yy AA. Check Services FROM: D8 /M Wrs REFERENCES: Commission meeting City Manager of January 12, 1999 ENCLOSURES: RECIDAIN7ENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution directing the City Manager to ezigage the services of the Florida Department of Law Enforcement (FDLE) to conduct background checks on individuals participating in a special program under the Miami-Dade/Monroe County WAGES Coalition Program leading to employment for participants with the City of Miami. Additionally, in compliance with the City Commission's direction, to engage the FDLE to perform background and credit checks, under specified circumstances, on individuals, officers and owners of companies requesting loans from the City of Miami. Funding for the engagement of the FDLE is available from CDBG Administrative Funds 24`h Year (799302-452423) and will not exceed an amount of S25,000. BACKGROUND The City of Miami has received funds from the Miami-Dade/Monroe County WAGES Coalition to assist City of Miami residents who have been impacted by welfare reform. A special program has been established between the City and the WAGES Coalition whereby qualified City of Miami WAGES clients will be assessed and processed for participation in special training programs leading to employment in the City's Police Department, Fire Department and the Departments of Public Works, Parks and Recreation, General Services Administration, and Solid Waste, as well as the NET's and some Administrative Departments. During the course of an employment preparation segment of the client's participation, hundreds of clients will be completing the necessary background checks, drug screening and physical examination that is required for all City employees. The services of the FDLE is being requested to provide these checks. At a recent Commission meeting, in response to questions raised about the backgrounds of individuals and companies who had been awarded loans from the City, the Commission requested that background and credit checks be performed for those individuals, officers and owners of companies making loan application.
