AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 29/ARTICLE IV/SECTION 29-122
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "LANDFILLS AND WATERFRONT
IMPROVEMENTS/WATERFRONT ADVISORY BOARD/SCOPE",
TO REQUIRE THAT THE WATERFRONT ADVISORY BOARD
BE INFORMED OF ANY DEVELOPMENT AND/OR
DISPOSITION OF WATERFRONT PROPERTY AT THE
CONCEPTUAL PLANNING STAGE FOR SUCH DEVELOPMENT
AND/OR DISPOSITION; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Waterfront Advisory Board ("WAB") is
responsible for reviewing and evaluating issues related to the
use and development of City -owned waterfront property and
providing advice to the City Commission concerning those issues
and such other matters as are referred to it by the City
Commission; and
.WHEREAS, heretofore, due to time constraints for the
approval of certain proposed waterfront developments, the WAD has
not been given the opportunity to review and evaluate such issues
in a timely and meaningful manner;
NOW, THEREFORE, BE IT.ORDAINED BY THE -COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 29/Article IV/Section 29-122 of the
Code of the City of Miami, Florida,. as amended, entitled
"Landfills And Waterfront Improvements/Waterfront Advisory
Board/Scope" is hereby amended in the following particulars:-'/
"Chapter 29
LANDFILLS AND WATERFRONT IMPROVEMENTS
Article IV
WATERFRONT ADVISORY BOARD
Sec. 29-122. Scope.
(b) The Miami waterfront advisory board shall be
informed of all issues concerning the major development
and/or disposition of city -owned waterfront property

and/or disposition; "mayor development and/or
disposition" shall be defined as such activities that
require public notice and hearings pursuant to the City

changes, renovations and/or alterations to any existing
city -owned waterfront property. Nothing herein is
intended to interfere or conflict with any existing
provisions in the City of Miami Charter and Code
setting forth procedures concerning the development
and/or disposition of city -owned waterfront property.

in effect and remain unchanged. Asterisks indicate omitted and

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21

Ordinance Amending Section 29-122
of Article IV of the City of Miami
Code, as Amended, Entitled
Waterfront Advisory Board
Recommendation
On February 10, 1999, the Waterfront Advisory Board. unanimously passed a motion to present
the attached Ordinance to the City Commission for adoption. The Ordinance, if adopted, will
require the Waterfront Advisory Board be informed of all issues concerning the major
development and/or disposition of City -owned property for its input and advice at the conceptual
planning stage for such development and/or disposition.
Background
The Waterfront Advisory Board (WAB) is responsible for reviewing and evaluating issues
related to the use and development of city -owned waterfront property and providing advice to the
City Commission concerning those issues and such other matters as are referred to it by the City
Commission.
Due to time constraints for the approval of certain proposed waterfront developments, the WAB
has not always been given the opportunity to review and evaluate such issues in a timely manner.
The proposed ordinance, if adopted, will require the Waterfront Advisory Board's input and
advice at the conceptual planning stage for all issues concerning the major development and/or
disposition of City -owned waterfront property.
Major developments and/or dispositions is defined as such activities that require hearings
pursuant to the City of Miami Charter and Code and shall not encompass minor changes,
renovations, and/or alterations to any existing city -owned waterfront property.

the March 23, 1999 City Commission Meeting, be placed on the agenda of the next City

conceptual planning stage.
