ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI ' CITY
COMMISSION AMENDING SECTIONS VI OF ORDINANCE
NO. 11705, ADOPTED SEPTEMBER 28, 1998, AS
AMENDED; REVISING PREVIOUSLY APPROVED CAPITAL
IMPROVEMENT PROJECTS IN THE GENERAL
GOVERNMENT, SOCIAL AND ECONOMIC ENVIRONMENT,
PARKS AND RECREATION, AND TRANSPORTATION
AREAS; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
.WHEREAS, the City Commission adopted Ordinance No. 11705, as
amended, on September 28, 1998, establishing appropriations for
Capital Improvement Projects; and
WHEREAS, the City Commission adopted Resolution No. 99-854,
on November 16, 1999, to reprogram Community Development Block
Grant funding for Capital Improvements at the Tower Theater,
Virrick Park and Manuel Artime Center; and
WHEREAS, the City has been awarded several grants for Capital
Improvements at Merrie Christmas, Kinloch, Simpson, Margaret Pace
and Kenneth Myers Parks, and the Manuel Artime Center; and
WHEREAS, it is necessary to revise existing Capital
Improvement Project appropriations to reflect the monies received
as grants and/or reprogrammed funding;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference thereto
and incorporated herein as if fully set forth in this Section.
Section 2. Section 6 of Ordinance No. 11705, as amended,
adopted September. 28, 1998, is hereby amended in the following
particulars to revise previously approved projects:!'
Section 6. The following appropriations are
made for implementation of all municipal capital
improvements of the City of Miami, Florida, including
new capital improvement projects scheduled to begin
during Fiscal Year.1998-1999. The appropriations which
are designated by reference to descriptive project title
and number also include appropriations for previously
approved scheduled projects as well as reappropriat ions
of prior fund appropriations. The sources of revenues
to support the appropriations are identified and being
set forth for seven program (I-VII) areas based upon use
or functional category within said areas:

Section 3. All ordinances or parts of ordinances insofar
as they are in conflict with provisions of this Ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City of
Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,

payment of its debts, necessary and required purchases of goods
and supplies and to generally carry on the functions and duties of
municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor2�.
PASSED AND ADOPTED BY TITLE ONLY this 14th day of
December 1999.

RECONENIENDATION:
It is respectfully requested that the City Commission adopt the attached Emergency Ordinance
revising various Capital Projects.
BACKGROUND:
The City Commission adopted Ordinance No. 11705 on September 28, 1998, as amended,
appropriating all on -going Capital. -Projects.
On November 16, the City Commission passed Resolution No. 99-854 to reprogram previously
allocated Community Development- Block Grant (CDBG) Program Funds. This reprogramming
included funds needed for Virrick Park, the Manuel Artime Center and the Tower Theater.
The increased funding for the Tower Theater is for additional furnishings and equipment needed to
make the Theater completely operational. The completion of the Tower Theater will serve to improve
the quality of life and protect the welfare of the public who would utilize the facility. In order to
procure the necessary items in a timely manner, the additional CDBG funds approved by the City
Commission need to be appropriated in Capital Project No. 322061.
Additionally, the Parks and Recreation Department has been awarded grants from the Florida Inland
Navigation District (FIND) for capital improvements at Margaret Pace and Kenneth Myers Parks, and
from the Miami -Dade County Office of ADA Coordination for capital improvements at Merrie
Christmas, Kinloch and Simpson Parks.
The Department of Conferences, Conventions and Public Facilities has also been awarded a grant in
the amount of $145,000 for the Manuel Artime Theater from the Miami -Dade Cultural Arts Council.
The CDBG funds reprogrammed for the theater will act as matching funds for this grant.
An amount of $1 million is being added to Capital Project No. 311016 for infrastructure assessment
and Information Technology Strategic Plan necessary for the completion of the City's Comprehensive
Financial Plan.
This Emergency Ordinance is necessary to have the appropriations in place in the respective capital
accounts since- time•is of the utmost importance in implementing these projeos_for the use of City of
Mi i residents.
