AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING SECTIONS 1, 2, 3, 4, AND 5 OF ORDINANCE NO. 11705, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1999, FOR THE PURPOSE OF ADJUSTING SAID APPROPRIATIONS RELATING TO OPERATIONAL AND BUDGETARY REQUIREMENTS OF CERTAIN CITY DEPARTMENTS AS ARE MORE PARTICULARLY DESCRIBED HEREIN; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted _Ordinance No. 11705, the Annual Appropriations Ordinance, on September 28, 1998, establishing revenues and appropriations for the City of Miami, Florida, for the Fiscal Year ending September 30, 1999; and WHEREAS, the City Commission made several adjustments to this annual budget which were made pursuant to Ordinance No. 11796, adopted May 11, 1999; and WHEREAS, a complete reconciliation of the Special Revenue Funds, including the Community Development Fund, has revealed General Fund obligations dating back to 1994; and WHEREAS, the City is desirous of providing financial support to meet these obligations; and WHEREAS, the Fraternal Order of Police ("FOP") Health Trust made concessions pertaining to its labor agreement in order to assist the City during the fiscal emergency; and 11867 WHEREAS, based on these concessions, the City is obligated to pay the FOP Health Trust if its fund equity fell below $2.3 million; and WHEREAS, the City is obligated to pay the sum of $888,227 since the FOP Health Trust's fund equity fell below the threshold; and WHEREAS, funds in the amount of $1,000,000 need to be designated from the Fiscal Year 1998-99 year-end surplus for the preparation and implementation of the Information" Technology Strategic Plan and for the procurement of architectural and engineering services to conduct structural assessments of the City's major buildings and related facilities; and WHEREAS, the total appropriations in the General Fund for the Fiscal Year ending on September 30, 1999 increased from $300,003,817 to $303,024,771; and WHEREAS, various revenue sources will be increased to support the proposed General Fund increases; and WHEREAS, the total appropriations in the Special Revenue Fund for the Fiscal Year ending on September 30, 1999, increased from $114,818,326 to $150,793,328; and WHEREAS, the Special Revenue Fund has been reorganized into sixteen new funds to facilitate concise management reports; and WHEREAS, the sixteen new Special Revenue Funds reflect income from taxes, grants, fees and contributions from other funds; Page 2 of 7 1 O {A NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Sections 1, 2, 3, 4, and 5 of Ordinance No. 11705, as amended, adopted September 28, 1998, the Annual Appropriations Ordinance for the Fiscal Year ending September 30, 1999, are hereby amended in the following particulars:l/ "Section 1. All ordinances or parts.of ordinances insofar as they are in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon adoption and signature of the Mayor/. If the Mayor does not sign this ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this ordinance, it shall become effective immediately upon override of the veto by the City Commission. Warshaw REFERENCES: City Manager `ENCLOSURES: RECOMMENDATION I OB FILE It is recommended that the City Commission approve the attached Ordinance which adjusts appropriations, by fund, for the closeout of Fiscal Year 1999. This Ordinance, presented as an emergency, seeks to facilitate closing entries necessary to complete the annual audit by December 31, 1999. Additionally, it proposes funding support to meet outstanding obligations of the City. BACKGROUND First, the Ordinance seeks to provide additional appropriations in the General Fund for five departments amounting to $3,021,478 and $1,642,000 in transfers as outlined below. Various revenue sources will be increased to support the additional requests.. AMOUNT DEPARTMENT PURPOSE $2, 288,227 Risk Management $1.4 million for workers comp. and liability judgments and settlements; and $998,227 to meet a contractual obligation to the FOP Health Trust. $ 201,489 Police Provides appropriation for four Law Enforcement Block grants recently approved by the Commission that sup orted general fund activities. $ 31,500 Media Relations Discussions were underway to reorganize the department, which would have impacted the FY `99 budget. Unfortunately, the reorganization was not accomplished prior to the close of the fiscal year. $ 262) Public Facilities Correcting a scrivener error $ 500,000 Pension To fund the Elected Officials Retirement Trust Net Budget Non -Departmental This request seeks to provide for the following: Impact is $0. $241,163 to reimburse the CRA for parking revenues collected by Offstreet Parking; $101,417 $1, 642, 000 in to reimburse HUD for interest earned by Miami transfers Capital; $300,000 for the State Financial Oversight from savings Board; and $1,000,000 for infrastructure assessments and the IT Strategic Plan. 0 � 0 While many of the aforementioned items were raised during recent discussions with the Commission, the obligation for the State Financial Oversight Board has not been recently discussed. The City's financial statements for FY 1999 carry a long-term liability of approximately $900,000 as reimbursement to the State for expenses associated with the Financial Oversight Board. By the close of FY 1999, this liability is expected to be approximately $1.2 million. The Administration is attempting to negotiate the "forgiveness" of portions, if not all, of the past liability in exchange for a commitment to reimburse future expenses. Second, the Ordinance proposes to adjust and, in some cases, provide new appropriations to reflect the reorganization of the Special Revenue Fund. This is the first step in the discontinuation of automatic rollover of Special Revenue Funds. This Ordinance would provide an appropriation for all expenditures occurring in FY 1999. By April of 2000, a similar Ordinance will be presented for FY 2000. This would complete the reconciliation process and all programs, projects, etc. wishing to expend funds in a given fiscal year will be required to prepare a budget during the annual budget process. In addition, the Ordinance proposes increases in previously authorized Special Revenue Funds as listed below: AMOUNT DEPARTMENT PURPOSE $101,417 CD -Housing Provides for the repayment of interest earnings by Miami Capital to the federal government. Miami Capital used the aforementioned funds for administrative support, which are now unavailable for reimbursement to HUD. Consequently, this becomes an obligation of the Cit 's general fund. $1,055,846 Miami- Dade Originally, this fund was set-up as an interim step Tourist Tax in the distribution of revenue to the Convention Center and Orange Bowl. This step is being eliminated so that these funds will go directly to the Convention Center and/or Orange Bowl. For FY 1999, all of the funds will be used for the Convention Center. $1,056,108 Convention Center See note above-$1,055,846 plus scrivener error of $262. $ 241,163 CRA The Law Department opined that certain parking revenues collected by the Department of Offstreet were due to the CRA. These funds were used to support the Gusman Theatre, which is subsidized by the City. Finally, the Ordinance places the Commission on notice of Equity Transfers affecting the cash balances of various funds. Two such transfers affecting the general fund, as reflected on the following page, will be made as closing entries for FY 1999. 11867 AMOUNT DEPARTMENT PURPOSE $3,664,390 From the General Two projects were created in the Community Fund to the Development Fund for expenses that relate to Community general , fund activity. These two projects, Development Fund Development and Asset Management, currently have negative balances and are adversely affecting Community Development's balance sheet. $1,300,296 From the General Lot clearing and demolition program income for Fund to the FY '96, '97 and '98 totaling $1,300,296 will be Community credited to the appropriate projects in the Development Fund Community Development Special Revenue Fund. In closing, approval of this Ordinance accomplishes the following: • Facilitates a timely completion of the FY 1999 Financial Audit by allowing for certain closing entries to be approved by the City Commission; • Approves the reorganization of the Special Revenue Funds, which will facilitate the preparation of concise, all inclusive, management reports with annual appropriations approved by the City Commission; • Acknowledges and provides for reimbursement of disallowed CDBG costs and program income under review by the U.S. Office of the Inspector General; • Allows for the timely settlement of worker's compensation and liability claims thereby reducing the long-term liabilities reflected on the City's balance sheet; and • Allows the City to appropriately assess its capital infrastructure in order to develop a financial plan that incorporates capital needs into the operating needs, including debt obligations of the City. Approval of the requests made above, places the City closer to redressing all of the known past financial management issues and still provide for a steady annual improvement in its financial health. Staff will be prepared to discuss each of these items in detail at the Commission Meeting. In the meantime, if you have any questions, please feel free to contact me.
