ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A SPECIAL REVENUE
FUND ENTITLED: "OFFICE OF THE CITY
CLERK/PASSPORT ACCEPTANCE FACILITY (FY 2000)"
AND APPROPRIATING FUNDS FOR ITS OPERATION IN
THE AMOUNT OF $113,260; AUTHORIZING THE CITY
MANAGER TO (1) ACCEPT REVENUES DERIVED AS A
RESULT OF THE CITY'S SERVICES AS A U.S.
PASSPORT ACCEPTANCE FACILITY, (2) DIRECTING
THAT THE REVENUES GENERATED BE USED
EXCLUSIVELY TO FUND THE GENERAL OPERATING
BUDGET OF THE OFFICE OF THE CITY CLERK, AND
(3) EXECUTE THE NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
SAID PURPOSE; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, Resolution No. 98-353, adopted April 14, 1998,
authorized the City Clerk to formally submit written notification
to the United States Department of State, Office of Passport
Services, of the City of Miami's expressed interest in becoming
an authorized Passport Acceptance Facility; and
WHEREAS, effective April, 16, 1998, the United States
Department of State, Office of Passport Services, instituted a
policy change from walk-in service to an automated appointment
system for passports, thus necessitating the demand for more

authorized passport acceptance facilities; and
WHEREAS, the Office of the City Clerk of the City of Miami,
has employees of its staff serve in the capacity of (subject the
U.S. Secretary of State granting a certificate of designation)
Passport Agents; and
WHEREAS, a $15.00 execution fee is collected by the City
Clerk for each passport application accepted, which fee is
retained by the City of Miami and serve as a recurring revenue
source; and
WHEREAS, a $12.00 fee for photographic services is also
collected for passport photographs; and
WHEREAS, the establishment of such a revenue source will
enable the Office of the City Clerk to generate funds to
partially sustain its office operations;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this

Section.
Section 2. The following new Special Revenue Fund is
hereby established and resources are hereby appropriated as
described herein:

RESOURCES: U.S. Department of State, $113,260
Office of Passport Services
APPROPRIATIONS: Office of the City Clerk/ $113,260
U.S. Passport Acceptance Facility
(FY 2000)
Section 3. The City Manager is hereby authorized to
accept all revenues derived as a result of the City's service as
a U.S. Passport Acceptance Facility, and is hereby directed that
said revenues generated be used exclusively to fund the General
Operating Budget of the Office of the City Clerk.
Section 4. The City Manager is hereby authorized!/ to
execute the necessary documents, in a form acceptable to the City
Attorney, with the U.S. Department of State, Office of Passport

requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Services, for said purpose.
Section 5. All ordinances or parts of ordinances insofar
as they are consistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debt, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.

Section 8. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 9. This Ordinance shall become effective

immediately upon its adoption./

ENCLOSURES:
It is respectfully recommended -that the City Commission adopt the attached Ordinance
establishing a Special Revenue Fund entitled Office of the City Clerk/Passport Acceptance Facility
(FY `2000).
BACKGROUND:
Currently, citizens desiring to obtain passports must schedule an appointment and submit their
applications in person to the Office of Passport Services, U.S. Department of State, Federal
Building (Monday through Friday between 10:00 a.m. and 4 p.m.) or walk into any one of the
Passport Acceptance Facilities located throughout Miami -Dade County.
Section 51.21, Title 22 of the Code of Federal Regulations provides for additional designations for
authorized passport acceptance facilities. To this end, the U.S. Secretary of State, in response to
Vice President Gore's proposal for more efficient government, has provided for municipal clerks
--(through the governing bodies of their respective municipalities) and other local government
agencies to serve as authorized passport acceptance agents.
Because of the increased volume of over the counter requests for passports, there has been a need
to increase the number of passport acceptance facilities. The aforementioned Federal Passport
Agency processes approximately 350,000 applications annually or approximately 350-400 a day.
Because of a change in policy (effective April 20, 1998), the Office of Passport Services, Federal
Passport Agency, has established an automatic appointment system. The result of this change in
federal policy has increased the need for acceptance facilities south of the (Circuit Court)
downtown area.
Since February 1, 1998, for each passport application accepted, a $15 execution fee has been
collected and retained by the City. A $12-fee for photographic services (two prints per person) is
also retained for passport photos taken. This has become a recurring revenue source.

The requested budget for FY `2000 is $113,260. The City Clerk realized revenues from November
1998 through. September 30, 1999 in the amount of $86,458.25. Some of this revenue is reflected
in FY `2000, due to.the Department of Finance' book closing date for the posting of revenues.
In FY `2000, ' several new marketing initiatives are envisioned to increase our revenue stream
including: request for assistance through the Department of Community Development in meeting
with community -based organizations and informing them of services being offered at Passport
Acceptance Facility, and organizational and institutional networking (Downtown Development
Authority, local consulate ' offices, International Trade Board's website, immigration attorneys,
etc.).

A RESOLUTION AUTHORIZING THE CITY CLERK TO
FORMALLY SUBMIT WRITTEN NOTIFICATION TO THE
U.S. DEPARTMENT OF STATE, OFFICE OF PASSPORT
SERVICES, OF THE CITY OF MIAMI'S EXPRESSED
INTEREST IN BECOMING AN AUTHORIZED PASSPORT
ACCEPTANCE FACILITY.
WHEREAS, Section 51.21, Title 22, of the Code of Federal
Regulations provides .that a clerk any federal court, a clerk of
any state court of record, a postal- employee designated by a
postmaster at a post office, and any other person specifically
designated by the Secretary of State of the United States to
accept passport applications; and
WHEREAS, the City Clerk previously informally inquired
through written communications to the U.S. Department of State,
Office of Passport Services, as to the possibility of the City of
Miami becoming an authorized Passport Acceptance Facility; and
WHEREAS, the Secretary of State of the United States, in
response to Vice -President Al Gore's proposal for more efficient
government, has provided for local government agencies to service
as authorized passport acceptance agents; and
WHEREAS, the Miami Region (which comprises Florida, Georgia,
South Carolina and the U.S. Virgin Islands), is one of the
regional passport agencies in the United States, and maintains

only one municipality - through its City Clerk's Office - that
services as an authorized Passport Acceptance Facility; and
WHEREAS,. effective April 16, 1998, the U.S. Department of
State, Office of�Passport Services, will institute .a policy
change, from walk-in service to an automated appointment system
for passports, thereby requiring an increase in the number of
authorized passport acceptance facilities; and
WHEREAS, the responsibility of the City Clerk, as well as
those employees who would be, officially deputized by the City
Clerk as acceptance agents, would be to: examine applications,
screen for citizenship evidence . and photographs, record
identifications proffered; collect fees; administer an oath to
applicants, sign applications, authorize the seal of the
acceptance facility, as well transmit same to the passport
agency; and
WHEREAS, said process shall provide the City of Miami with a
recurring revenue source, as a $15.00 processing fee shall be
collected and retained, by the City Clerk for each passport
application accepted; and
WHEREAS, as an authorized Passport Acceptance Facility, the
City will provide a positive community.' service by providing a
local source for residents to easily obtain and process passport
applications, as well as promote sound public relations with the
realization that government recognizes the importance of its
citizens in making additional services and opportunities
available to the public;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
